Everton are exploring a possible legal challenge against the Premier League<\/a> for its handling of Chelsea\u2019s undisclosed payments sanction.<\/p>\n

The club are understood to be preparing to write to the Premier League requesting a formal explanation for its failure to take any sporting sanctions against Chelsea<\/a>, with their legal options also being considered.<\/p>\n

Chelsea were fined \u00a310.75m and given a suspended transfer ban by the \u00adPremier League last week after \u00adreporting \u00a347.5m of hidden \u00adpayments to agents and players made over a seven\u2011year period, a \u00adpunishment the rest of the top-flight clubs regarded as lenient.<\/p>\n

Executives from \u00adseveral clubs have contacted Richard \u00adMasters, the Premier League chief executive, and the chair, \u00adAlison \u00adBrittain, \u00adasking for \u00adclarity on the terms of their agreed settlement with Chelsea, with Everton<\/a> con\u00adsidering taking matters further.<\/p>\n

Everton feel particularly aggrieved<\/a> as they were docked eight points<\/a> \u00adduring the 2023-24 season for two separate profit and \u00adsustainability regula\u00adtions breaches, whereas sporting sanctions do not appear to have been considered in the Premier League\u2019s punishment of Chelsea.<\/p>\n

Everton could also still receive a further punishment as a result of their PSR breaches as they are the subject of a compensation claim from Burnley, who demanded \u00a350m at an arbitration hearing last autumn on the basis that they were relegated from the Premier League during the 2021-22 season, when Everton were found to have breached PSR.<\/p>\n

Nottingham Forest are also unhappy with the Chelsea \u00adsanction as they were docked four points<\/a> in 2023\u201124 for a PSR breach.<\/p>\n

\u00adForest \u00adofficials are understood to have held talks with Everton this week about \u00adjoining forces to challenge the \u00adPremier\u00a0League, but have yet to come to a firm \u00addecision.<\/p>\n

As a first step, the two clubs are likely to write to the Premier League \u00adrequesting a formal \u00adexplanation for Chelsea\u2019s punishment and the process behind it, a move that would have some \u00adsupport from other clubs.<\/p>\n

There are concerns throughout the top flight that the Chelsea \u00addecision could set a precedent before the verdict on Manchester City\u2019s 115 charges<\/a> of \u00adbreaching financial fair play. City\u00a0deny those charges.<\/p>\n

Arsenal and Totten\u00adham, along with Manchester United and Liverpool, instructed lawyers to reserve their right to sue for compen\u00adsation two years ago if City are found guilty in a case being heard by an indepen\u00addent tribunal, rather than the Premier League itself, as in the Chelsea case.<\/p>\n

The Premier League is believed to have explained Chelsea\u2019s punishment on the grounds that it felt it would have been unable to secure a conviction without their co-operation, so negotiated from the outset.<\/p>\n

Chelsea\u2019s current ownership of Clearlake Capital and Todd Boehly reported the offences, 36 \u00adundisclosed payments between 2011 and 2018 which helped the club to buy \u00adplayers such as Eden Hazard, Nemanja Matic, David Luiz, Willian and \u00adRamires, which they discovered during the negotiations to buy the club from Roman \u00adAbramovich four years ago. As a result the new \u00adowners received a \u00a3150m discount from the sale price agreed with \u00adAbramovich to cover any related future liabilities, and the \u00adPremier League will be paid from those funds.<\/p>\n

Everton and Forest are both \u00adtaking legal advice, with any challenge likely to be based on claims that the Premier League has been inconsistent in applying its own rulebook.<\/p>\n

There is no mention of the concept of \u201csporting advantage\u201d in the Chelsea \u00adjudgment despite the fact that the club won eight trophies, \u00adincluding two Premier League titles, during the period when the payments were made. The Everton and Forest PSR judgments, in contrast, make repeated references to the \u00adsporting advantage accrued from their overspending.<\/p>\n
