Establishments may make provision as per accounting norms,\u201d the Labour Ministry said in one of its FAQ documents.<\/p>\n<p>How will gratuity be calculated under the new rules?<\/p>\n<p>As per the new codes, fixed-term <a class=\"backlink\" target=\"_blank\" href=\"https:\/\/www.livemint.com\/money\/personal-finance\/from-company-cars-to-interest-free-loans-ca-explains-what-s-changing-for-salaried-employees-from-april-1-11774847440396.html\" data-vars-page-type=\"story\" data-vars-link-type=\"Manual\" data-vars-anchor-text=\"employees (FTEs)\" rel=\"nofollow noopener\">employees (FTEs)<\/a>become eligible for gratuity after one year of continuous service, down from the earlier requirement of five years. However, this rule only applies to employees who joined a company on or after the new Labour Codes were implemented.<\/p>\n<p>Notably, gratuity is calculated based on the last drawn wages and years of service. He explained that under the new definition of \u201cwages\u201d, if an employee&#8217;s sum of allowances exceeds 50% of CTC, the excess is automatically added back to basic pay.<\/p>\n<p>\u201cBecause gratuity is calculated based on the \u2018last drawn wage\u2019, this requirement effectively establishes a higher legal floor for the payout, increasing the employer&#8217;s total liability,\u201d he added.<\/p>\n<p>Also Read | <a href=\"https:\/\/www.livemint.com\/money\/personal-finance\/govt-keep-small-savings-schemes-april-june-2026-no-change-interest-rates-how-much-get-ppf-nsc-deposits-sukanya-samriddhi-11774888529543.html\" rel=\"nofollow noopener\" target=\"_blank\">Govt keeps interest rates on PPF, NSC unchanged: Here&#8217;s how much you get<\/a><\/p>\n<p>Pooja Ramchandani, Partner at Shardul Amarchand Mangaldas &amp; Company, concurred that under the earlier legal framework, gratuity was typically computed on basic pay and dearness allowance only. \u201cFor a person with  \u20b912 lakh CTC, if the basic pay is 50,000, special allowance is 20,000, <a class=\"backlink\" target=\"_blank\" href=\"https:\/\/www.livemint.com\/money\/personal-finance\/claiming-hra-new-rental-rules-kick-in-from-1-april-what-are-the-changes-and-what-happens-if-they-are-ignored-11773820799330.html\" data-vars-page-type=\"story\" data-vars-link-type=\"Manual\" data-vars-anchor-text=\"HRA\" rel=\"nofollow noopener\">HRA <\/a>is 15,000 and conveyance is 15,000, wage for gratuity payment under the erstwhile legal regime would be  \u20b950,000 and gratuity payment would be 1.44 lakh; and under the Labour Code, wage would be  \u20b970,000 and gratuity would be  \u20b92,01,923.\u201d<\/p>\n<p>Will the new gratuity rules impact take-home pay and PF?<\/p>\n<p>According to Agrawal, while this shift raises the long-term terminal benefits for the employee, it simultaneously increases the Defined Benefit Obligation (DBO) that companies must provision for on their balance sheets. \u201cIt also leads to a reduction in monthly take-home pay, as <a class=\"backlink\" target=\"_blank\" href=\"https:\/\/www.livemint.com\/money\/personal-finance\/ppf-withdrawal-steps-how-you-can-access-public-provident-fund-balance-before-lock-in-period-ends-interest-tax-retirement-11773488942622.html\" data-vars-page-type=\"story\" data-vars-link-type=\"Manual\" data-vars-anchor-text=\"provident fund\" rel=\"nofollow noopener\">provident fund<\/a> (PF) contributions, which are also tied to the wage base, increase alongside the gratuity base,\u201d he added.<\/p>\n<p>Ramchandani added: \u201cWages for computing PF can be limited to the threshold of  \u20b915,000 as per the <a class=\"backlink\" target=\"_blank\" href=\"https:\/\/www.livemint.com\/money\/personal-finance\/ppf-public-provident-fund-employees-epf-national-pension-scheme-nps-retirement-invest-compare-interest-rates-tax-benefit-11774536040281.html\" data-vars-page-type=\"story\" data-vars-link-type=\"Manual\" data-vars-anchor-text=\"EPF Scheme\" rel=\"nofollow noopener\">EPF Scheme<\/a> or the actual basic, where basic is more than  \u20b915,000. Employers are required to pay up to 12% of your basic pay, and if they already do so, there would likely be little to no change to your PF contribution..<\/p>\n<p>\u201cIn the short term, employees may see a lower take-home salary if CTC remains unchanged. In the long term, <a class=\"backlink\" target=\"_blank\" href=\"https:\/\/www.livemint.com\/money\/personal-finance\/retirement-planning-indians-ca-money-advice-inflation-healthcare-longevity-expenses-lifestyle-financial-freedom-wealth-11773225465090.html\" data-vars-page-type=\"story\" data-vars-link-type=\"Manual\" data-vars-anchor-text=\"retirement\" rel=\"nofollow noopener\">retirement <\/a>savings improve meaningfully. The trade-off is between liquidity today and social security tomorrow,\u201d Agrawal added.<\/p>\n<p>He noted that the law directly impacts <a class=\"backlink\" target=\"_blank\" href=\"https:\/\/www.livemint.com\/money\/personal-finance\/how-your-in-hand-salary-change-1-april-2026-new-income-tax-act-exempt-basic-pay-pf-hra-meal-card-gift-coupon-labour-code-11774976223499.html\" data-vars-page-type=\"story\" data-vars-link-type=\"Manual\" data-vars-anchor-text=\"salary\" rel=\"nofollow noopener\">salary <\/a>structuring, and if companies maintain the same overall CTC, higher statutory contributions will reduce in-hand salary. \u201cAnnual increments and performance bonuses will need to be recalibrated within this framework. The shift is structural, not discretionary.
