{"id":578474,"date":"2026-04-03T00:43:14","date_gmt":"2026-04-03T00:43:14","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/578474\/"},"modified":"2026-04-03T00:43:14","modified_gmt":"2026-04-03T00:43:14","slug":"new-lmia-rules-double-advertising-period-and-require-employers-to-target-youth","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/578474\/","title":{"rendered":"New LMIA rules double advertising period and require employers to target youth"},"content":{"rendered":"<p>Employers must now advertise for longer and must try to recruit youth before they can hire a foreign worker through the low-wage stream of the Temporary Foreign Worker Program (TFWP).<\/p>\n<p>As of April 1, 2026, employers applying for a Labour Market Impact Assessment (LMIA) under the low-wage stream of the Temporary Foreign Worker Program (TFWP) must advertise positions for a minimum of eight consecutive weeks \u2014 double the previous four-week requirement.<\/p>\n<p class=\"bottom-btn\" style=\"text-align: center;\"><a style=\"color: #ffffff; background: #e52237;\" href=\"https:\/\/www.canadavisa.com\/wpteam.html?utm_source=cicnews.com&amp;utm_medium=article&amp;utm_campaign=2026-04-03_new-lmia-rules-double-advertising-period-and-require-employers-to-target-youth_73796&amp;utm_content=Schedule+a+Free+TFWP+Consultation\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-utm-content=\"Schedule a Free TFWP Consultation\">Schedule a Free TFWP Consultation<br \/><\/a><\/p>\n<p>Starting on this date, employers must also demonstrate that they made efforts to recruit youth before hiring a foreign national through the TFWP.<\/p>\n<p>The new requirements from Employment and Social Development Canada (ESDC) add to the advertising obligations employers must complete before applying for an LMIA under the low-wage stream.<\/p>\n<p>Advertising period doubles from four weeks to eight<\/p>\n<p>Previously, employers were required to advertise <a href=\"https:\/\/www.canadavisa.com\/labour-market-impact-assessments.html\" rel=\"nofollow noopener\" target=\"_blank\">LMIA<\/a>-based positions for a minimum of four consecutive weeks within the three months before submitting their LMIA application. As of April 1, that minimum has doubled to eight consecutive weeks.<\/p>\n<p>The advertisement must still occur within the three months before the LMIA application is submitted.<\/p>\n<p>At least one of the three <a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/median-wage\/low\/requirements.html#:~:text=the%20information%20provided.-,Recruitment%20and%20advertisement,-Recruitment%20is%20the\" rel=\"nofollow noopener\" target=\"_blank\">required recruitment activities<\/a> must also remain ongoing until <a href=\"https:\/\/www.canadavisa.com\/esdc.html\" rel=\"nofollow noopener\" target=\"_blank\">ESDC<\/a> issues a positive or negative LMIA decision.<\/p>\n<p>For employers, the longer advertising window means more lead time is needed before an LMIA application can be filed. Employers who are planning to hire through the low-wage stream must now factor this extended timeline into their recruitment planning.<\/p>\n<p>Further details on new LMIA requirements<\/p>\n<p>Under the updated minimum recruitment requirements for low-wage LMIA applications, employers must now also demonstrate recruitment efforts to reach and encourage youth to apply for the job.<\/p>\n<p>According to ESDC, this is to ensure that youth &#8220;were provided with every opportunity to obtain employment.&#8221;<\/p>\n<p>This is separate from the existing requirement to target underrepresented groups \u2014 including vulnerable youth \u2014 through two additional recruitment methods.<\/p>\n<p>While ESDC does not have a formally published definition for the &#8220;youth&#8221;, the department&#8217;s &#8220;Youth Employment and Skills Strategy&#8221; targets individuals aged between 15 and 30.<\/p>\n<p>The new rule makes youth outreach its own category of recruitment activity that employers must fulfill.<\/p>\n<p>To meet this requirement, employers can take steps such as<\/p>\n<p>Posting on Job Bank&#8217;s youth section and youth-specific job boards;<br \/>\nWorking with schools or colleges;<br \/>\nParticipating in youth employment programs; and<br \/>\nUsing other platforms popular with youth.<\/p>\n<p>How ESDC will assess youth outreach<\/p>\n<p>Alongside the new requirement, ESDC has also added &#8220;targeted outreach to youth&#8221; as an acceptable method of recruitment. The government lists five specific activities that can count toward this:<\/p>\n<p>Youth-focused job advertisements: Post job vacancies on youth-oriented platforms, such as Job Bank&#8217;s youth section, provincial or territorial youth employment programs, and post-secondary career centers. Job ads should clearly encourage youth to apply.<br \/>\nCollaboration with educational institutions: Partner with high schools, colleges, and universities to reach students and recent graduates through co-op placements, internships, career fairs, or on-campus recruitment.<br \/>\nParticipation in recognized youth employment programs: Take part in government-supported programs, such as Canada Summer Jobs or equivalent regional programs, that connect employers with youth.<br \/>\nCommunity and non-profit engagement: Promote job vacancies through local community centers, youth organizations and employment support agencies that work with young job seekers.<br \/>\nDigital and social media outreach: Advertise job opportunities on platforms popular with youth to reach a wider pool of potential candidates.<\/p>\n<p>Employers should keep in mind that ESDC requires them to keep records of all recruitment and advertising efforts for a minimum of six years. They must also provide results from the recruitment efforts they undertook to fill the position.<\/p>\n<p class=\"bottom-btn\" style=\"text-align: center;\"><a style=\"color: #ffffff; background: #e52237;\" href=\"https:\/\/www.canadavisa.com\/wpteam.html?utm_source=cicnews.com&amp;utm_medium=article&amp;utm_campaign=2026-04-03_new-lmia-rules-double-advertising-period-and-require-employers-to-target-youth_73796&amp;utm_content=Schedule+a+Free+TFWP+Consultation\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-utm-content=\"Schedule a Free TFWP Consultation\">Schedule a Free TFWP Consultation<br \/><\/a><\/p>\n<p>Context on the TFWP and youth employment<\/p>\n<p>The <a href=\"https:\/\/www.canadavisa.com\/temporary-foreign-worker-program.html\" rel=\"nofollow noopener\" target=\"_blank\">TFWP<\/a> \u2014 through which LMIA-based work permits are processed \u2014 requires employers to demonstrate that no Canadian <a href=\"https:\/\/www.canadavisa.com\/canadian-citizenship-immigration-and-settlement-in-canada.html\" rel=\"nofollow noopener\" target=\"_blank\">citizen<\/a> or <a href=\"https:\/\/www.canadavisa.com\/canadian-immigration-residency-obligations.html\" rel=\"nofollow noopener\" target=\"_blank\">permanent resident<\/a> is available to fill a position before hiring a foreign worker.<\/p>\n<p>The new youth recruitment requirement further builds on this principle by making sure young Canadians specifically aren&#8217;t overlooked in the hiring process.<\/p>\n<p>Youth unemployment in Canada has been a growing concern.<\/p>\n<p>Statistics Canada reported in October 2025 that the unemployment rate for Canadians aged 15 to 24 reached 14.7% in September 2025 \u2014 the highest for that month since 2010, outside the pandemic.<\/p>\n<p>For teenagers aged 15 to 19, the rate was even steeper at 20.8%.<\/p>\n<p>The TFWP has also become a political flashpoint.<\/p>\n<p>In September 2025, Conservative Party leader <a href=\"https:\/\/www.cicnews.com\/2025\/09\/have-work-permits-under-the-temporary-foreign-worker-program-surpassed-targets-as-poilievre-claims-0959579.html\" rel=\"nofollow noopener\" target=\"_blank\">Pierre Poilievre called for the program&#8217;s permanent abolition<\/a>, arguing that it suppresses wages and shuts young Canadians out of entry-level jobs.<\/p>\n<p>Prime Minister Mark Carney has, partly in response, <a href=\"https:\/\/www.cicnews.com\/2025\/09\/changes-in-the-works-for-the-temporary-foreign-worker-program-carney-says-0959715.html\" rel=\"nofollow noopener\" target=\"_blank\">signaled reform for the program<\/a>. In an address to the Liberal caucus in Edmonton in September 2025, Carney said the TFWP &#8220;must have a focused approach that targets specific, strategic sectors, and needs in specific regions.&#8221; No further details on the planned changes have been released.<\/p>\n<p>At the same time, the federal government recently expanded the program for rural employers. As of <a href=\"https:\/\/www.cicnews.com\/2026\/03\/canada-expands-work-permits-for-employers-and-foreign-workers-in-rural-areas-0372919.html\" rel=\"nofollow noopener\" target=\"_blank\">April 1, 2026<\/a>, employers in rural areas can hire up to 15% of their workforce through low-wage TFWP positions \u2014 up from 10% \u2014 subject to approval by their province or territory. The temporary measure runs until March 31, 2027.<\/p>\n<p>Employer groups, meanwhile, continue to push for the program&#8217;s continuation.
