Mr. Sylvestre\u2019s campaign needs 178,000 signatures to force a constitutional referendum. Earlier this week, Mr. Sylvestre declared organizers had reached that goal, one month ahead of deadline.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Organizers expect their question \u2013 \u201cDo you agree that the Province of Alberta should cease to be part of Canada and become an independent state?\u201d \u2013 will be added to a planned Oct. 19 referendum on <a href=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-alberta-premier-danielle-smith-televised-address-immigration-budget\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-alberta-premier-danielle-smith-televised-address-immigration-budget\/\">immigration and constitutional matters.<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">But there is a potential roadblock.<\/p>\n<p class=\"c-article-body__text text-pr-5\">On Tuesday, a judge in the Court of King\u2019s Bench of Alberta is scheduled to oversee a three-day hearing involving a demand by the Sturgeon Lake Cree Nation to shut the separatist campaign down. <\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/opinion\/article-alberta-independence-separatism-danielle-smith-jason-stephan\/\" rel=\"nofollow noopener\" target=\"_blank\">Gary Mason: Danielle Smith should make an example of the MLAs in her caucus who support Alberta\u2019s independence<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">The First Nation has <a href=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-first-nation-launches-legal-action-against-potential-alberta\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-first-nation-launches-legal-action-against-potential-alberta\/\">sued the provincial and federal governments<\/a> and the province\u2019s chief electoral officer, saying the separatist petition should be suspended on grounds that separation is impossible without First Nations\u2019 consent.<\/p>\n<p class=\"c-article-body__text text-pr-5\">In recent weeks, independence advocates have implored canvassers to collect as many signatures as possible before April 7, the first day of the hearing. <\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cThe government has given us a path. We\u2019ve taken advantage of that path,\u201d Mr. Sylvestre said in an interview with The Globe and Mail. \u201cWe have the signatures.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">But he said his group has a Plan B if the court agrees with the First Nation.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cThe government \u2013 even if [the courts] put an injunction on this \u2013 can call an independence referendum on their own,\u201d said Mr. Sylvestre, who owns a sporting goods and gun store. <\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/opinion\/article-alberta-independence-petition-ottawa-treatment\/\" rel=\"nofollow noopener\" target=\"_blank\">Opinion: Alberta\u2019s push for independence is the culmination of decades of poor treatment by Ottawa<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">Ms. Smith announced in February that Albertans would vote in October on wresting more control over immigration from the federal government and limiting access to education and health care for some newcomers, among other matters.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The likelihood of an independence referendum has been accelerated this year by changes to direct democracy laws implemented by Ms. Smith\u2019s United Conservative Party government. <\/p>\n<p class=\"c-article-body__text text-pr-5\">Last spring, she substantially reduced the number of signatures needed to force a constitutional referendum to nearly 178,000 from about 588,000. The change galvanized the independence movement and a countereffort advocating for <a href=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-alberta-petition-that-could-trigger-separation-referendum-faces\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-alberta-petition-that-could-trigger-separation-referendum-faces\/\">Alberta to stay in Canada<\/a>, among others.<\/p>\n<p class=\"c-article-body__text text-pr-5\">In December, the Alberta government also legislated additional changes to the act that eliminated guardrails for citizen-initiated referendums and stripped several powers from the Chief Electoral Officer. <\/p>\n<p class=\"c-article-body__text text-pr-5\">One of those provisions allows a proposed referendum question to contravene the Canadian Constitution, but it also said the Alberta government wouldn\u2019t be forced to implement the result of a referendum if acting on it would violate the Constitution.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Sturgeon Lake Cree Nation\u2019s current legal challenge is trying to reinstate the rule that a citizen-initiative petition must follow the Constitution, said Orlagh O\u2019Kelly, Sturgeon Lake\u2019s legal counsel. <\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/business\/commentary\/article-separatists-think-independence-makes-quebec-and-alberta-richer-really\/\" rel=\"nofollow noopener\" target=\"_blank\">Opinion: Separatists think independence makes Quebec and Alberta richer. Really?<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">The First Nation contends that an independence referendum is incompatible with its constitutionally protected treaty rights and would lay the <a href=\"https:\/\/www.theglobeandmail.com\/business\/article-experts-worry-elections-alberta-lacks-resources-to-deal-with-foreign\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/business\/article-experts-worry-elections-alberta-lacks-resources-to-deal-with-foreign\/\">welcome mat to foreign interference.<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">Ms. O\u2019Kelly said the judge will likely render a decision by May 2, the deadline for signature collection.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Mr. Sylvestre, also a UCP constituency president, said he \u201ccan\u2019t pressure the government to do anything.\u201d But he can present his work to it.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cThey\u2019re going to make a decision on whether or not the legislation that they passed in order to allow us to do this \u2013 and allow citizens to actually have a say in whatever democracy we have here \u2013 should be upheld or not.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">Heather Jenkins, spokesperson for Alberta Justice Minister Mickey Amery, said in a statement the government will \u201cwait to see this process play out.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cAs we have said, any current citizen initiative that meets the eligibility requirements and gets the requisite number of signatures will be put on the October 19th referendum ballot.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">Ms. Jenkins did not say whether the government would call an independence referendum if the judge stops Mr. Sylvestre\u2019s petition.<\/p>\n<p class=\"c-article-body__text text-pr-5\">In contrast to Mr. Sylvestre\u2019s petition is former Alberta deputy premier Thomas Lukaszuk\u2019s <a href=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-alberta-petition-that-could-trigger-separation-referendum-faces\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-alberta-petition-that-could-trigger-separation-referendum-faces\/\">\u201cForever Canadian\u201d petition<\/a>.
