The Oklahoma Supreme Court has overturned Oklahoma\u2019s ESG law, ruling that public retirement funds must be managed solely for the benefit of retirees.<\/p>\n
The decision stems from a legal challenge brought by Collin Walke, an attorney with Hall Estill, who argued the law improperly allowed political considerations to influence investment decisions.<\/p>\n
At issue was the Energy Discrimination and Elimination Act, a 2022 law designed to restrict state business with financial firms accused of boycotting oil and gas companies.<\/p>\n
Walke said the law allowed state officials to blacklist firms involved in environmental, social and governance (ESG) investing, even when those firms delivered strong financial returns.<\/p>\n
\n Why the court struck down the law<\/p>\n
At the center of the case is a provision in the Oklahoma Constitution requiring public pension funds be used exclusively for the benefit of their members.<\/p>\n
Walke said the court found that once investment decisions are influenced by politics, they no longer meet that standard.<\/p>\n
Rather than addressing multiple constitutional arguments raised in the lawsuit, the Oklahoma Supreme Court focused narrowly on that issue.<\/p>\n
The ruling means the law cannot be applied to the Oklahoma Public Employees Retirement System, which manages retirement funds for thousands of state workers.<\/p>\n
However, Walke said the decision does not automatically eliminate the law in all contexts, leaving open the possibility it could still affect other state entities.<\/p>\n
Walke said Oklahoma\u2019s case is part of a broader national pattern, with similar ESG-related laws facing legal challenges across the country.<\/p>\n
He pointed to developments in Texas, where a federal court has blocked similar legislation, suggesting courts are increasingly scrutinizing policies that tie financial decisions to political goals.<\/p>\n
He also referenced historical legal disputes involving economic boycotts, including those tied to apartheid-era South Africa.<\/p>\n

Walke said the issue is deeply political, with divisions among state leaders becoming more visible.<\/p>\n
He said disagreements between officials, including Oklahoma\u2019s state treasurer and other statewide leaders, reflect a broader debate over how much influence government should have on investment policy.<\/p>\n
Walke also argued the law could carry financial consequences, pointing to research suggesting the restrictions could cost taxpayers tens of millions of dollars by limiting competition among financial firms.<\/p>\n
Walke said he does not expect additional court battles over this specific case, but believes the broader issue is far from settled.<\/p>\n
