Kyle Busch<\/a>\u2019s family is still trying to process the sudden death of one of NASCAR\u2019s most successful and polarizing champions. But in the days since his passing, they have also been forced to confront a wave of online claims about his life insurance that the family\u2019s attorney says are simply false.<\/p>\n

Busch died May 21 at age 41 after pneumonia progressed into sepsis, leading to severe complications that included blood clotting and hemorrhagic shock. His death stunned NASCAR<\/a>, where he was a two-time Cup Series champion and one of the most accomplished drivers of his generation.<\/p>\n

The grief around his passing has been complicated by speculation tied to a lawsuit Busch and his wife, Samantha, settled with Pacific Life Insurance Company only months earlier.\u00a0<\/p>\n

The couple had accused the insurer of misleading them into purchasing indexed universal life insurance policies, alleging they paid more than $10.4 million in premiums based on inaccurate illustrations and promises of guaranteed returns.<\/p>\n

That case was settled confidentially in March. After Busch\u2019s death, however, some social media users suggested the family had been advised to abandon major life insurance protection before he died. Attorney Robert Rikard rejected that claim in forceful terms.<\/p>\n

\u201cSome on this platform, in the media, and elsewhere are pushing a false narrative about the Busch IUL matter,\u201d Rikard wrote on LinkedIn. \u201cIt needs to be stopped, and those publishing false statements are on notice to correct them.\u201d<\/p>\n

Coverage was replaced, not lost<\/p>\n

Rikard said the central claim circulating online is wrong that the Busch family didn’t simply walk away from valuable coverage.<\/p>\n

\u201cTwo policies had no value prior to litigation and were terminated,\u201d Rikard wrote.<\/p>\n

He said the remaining policies were reviewed by an independent insurance specialist and transitioned into replacement coverage designed to provide meaningful long-term protection.<\/p>\n

\u201cThe remaining policies were handled responsibly,\u201d Rikard wrote. \u201cThe Busch family retained an independent insurance specialist, a senior executive at a major national financial institution, who evaluated the entire portfolio and recommended a structured transition to replacement coverage that provides a substantial lifetime death benefit.\u201d<\/p>\n

He added: \u201cThe Busch family did not walk away from their coverage. They replaced it with better coverage.\u201d<\/p>\n

Rikard said suggestions that Busch and his family abandoned tens of millions in death benefit protection were not merely unfair, but false.<\/p>\n

\u201cThe suggestion that they were advised by anyone to abandon tens of millions in death benefit protection is a fabrication, and those repeating it know it is,\u201d Rikard wrote. \u201cTo continue to do so is at your own peril.\u201d<\/p>\n

NASCAR mourns while business questions continue<\/p>\n

The insurance dispute has renewed wider scrutiny of indexed universal life policies, which combine life insurance protection with a cash-value component tied to market indexes.\u00a0<\/p>\n

Critics say the products can be complicated and are sometimes marketed too aggressively as retirement tools. But Rikard\u2019s point was narrower as the debate over insurance products shouldn’t become false claims about the Busch family\u2019s financial protection.<\/p>\n

Busch is survived by Samantha and their children, Brexton and Lennix. His death has forced NASCAR and Richard Childress Racing to make immediate competitive and commercial adjustments, while sponsors and family-linked charitable work are also being reorganized.<\/p>\n

Rikard also paid tribute to Busch personally, saying he came to know him \u201cnot just as a client, but as a friend.\u201d<\/p>\n

\u201cHe was intensely driven, thoughtful, loyal to the people around him, and deeply devoted to his family,\u201d Rikard said.<\/p>\n
