{"id":746360,"date":"2026-06-19T02:54:11","date_gmt":"2026-06-19T02:54:11","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/746360\/"},"modified":"2026-06-19T02:54:11","modified_gmt":"2026-06-19T02:54:11","slug":"caqs-quebec-constitution-plan-was-assimilationist-experts","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/746360\/","title":{"rendered":"CAQ&#8217;s Quebec constitution plan was assimilationist: experts"},"content":{"rendered":"<p>Five United Nations human rights experts say the Coalition Avenir Qu\u00e9bec\u2019s now-shelved proposed constitution could have violated international law on minority, Indigenous and religious rights, describing part of the plan as \u201cassimilationist.\u201d<\/p>\n<p>Though the CAQ abandoned the proposal, one of the lawyers who asked the UN rapporteurs to investigate says some of their conclusions apply to a law already on Quebec\u2019s books and could be used to challenge it.<\/p>\n<p>\u201cWe strongly recommend that Bill 1, Quebec\u2019s Constitutional Act, be reconsidered and revised,\u201d the rapporteurs say in their report, which was submitted to Quebec on June 11, the day the government withdrew the plan.\u00a0<\/p>\n<p>The Gazette obtained a copy of the rapporteurs\u2019 15-page report.<\/p>\n<p>Appointed by the UN Human Rights Council, rapporteurs are independent human rights experts. The five who signed the report focus on cultural rights, Indigenous Peoples, migrants, minority issues and freedom of religion. The report was released through the UN human rights office in Geneva.<\/p>\n<p>The report is in response to a December request for an investigation into the proposal by the International Commission of Jurists Canada, a group that promotes human rights and the rule of law.<\/p>\n<p>In the report, the rapporteurs focused much of their criticism on Bill 1\u2019s \u201cnational integration\u201d model.<\/p>\n<p>They note its \u201cexplicit objective is the civic assimilation of all residents within a single francophone identity, without any recognition of the distinct cultural identities and contributions of non-francophone and immigrant communities, and without any provision creating the conditions for their meaningful cultural participation.\u201d<\/p>\n<p>If adopted as drafted, Bill 1 would have risked depriving Quebec residents, whether or not they hold Canadian citizenship, \u201cof the right to identify as anything other than \u2018Qu\u00e9b\u00e9cois,\u2019 by proclaiming that all persons living in Quebec form a single nation whose identity is anchored exclusively in French as \u2018the common language of the nation\u2019 and in a single cultural environment.\u201d<\/p>\n<p>\u201cBy establishing a direct link between \u2018being a Quebecer\u2019 and the French language as a common and unifying marker of identity, and by expressly instituting a policy of \u2018national integration\u2019 aimed at absorbing minorities into this nation, the bill would infringe upon human rights principles.\u201d<\/p>\n<p>The rapporteurs noted that those principles specifically guarantee Indigenous Peoples the right to freely choose their own linguistic and cultural references and to identify voluntarily with their own national, ethnic or linguistic group.<\/p>\n<p>The report cites a series of international treaties and UN texts that oblige states to protect the cultural, linguistic and religious rights of minorities, Indigenous Peoples and migrants.<\/p>\n<p>\u201cA model of constitutional integration, whose explicit objective is the civic assimilation of all residents within a single francophone identity, without any recognition of the distinct cultural identities and contributions of\u00a0 non-francophone and immigrant communities, and without any provision creating the conditions for their meaningful cultural participation, is directly contrary to these obligations.\u201d<\/p>\n<p>The rapporteurs say that \u201cthe integration framework enshrined in the constitution by Bill 1 falls squarely within the category of assimilationist approaches,\u201d which is \u201cincompatible with international human rights obligations.\u201d<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" width=\"3000\" height=\"2000\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2026\/06\/1205-city-rightsconstitution_300195048.jpg\" alt=\"People sit at a table at a press conference\" class=\"wp-image-100234319\"  \/>Ana\u00efs Bussi\u00e8res McNicoll, representing Association Canadienne des Libert\u00e9s Civiles, speaks with other members of groups focused on human rights, immigration and the environment during a press conference on Thursday, Dec. 4, 2025 to demand that the CAQ government withdraw the proposed Quebec constitution in Bill 1. Pierre Obendrauf \/ Montreal Gazette<\/p>\n<p>Universit\u00e9 de Montr\u00e9al law professor Karine Millaire, who was involved in asking the rapporteurs to investigate, says the findings don\u2019t only apply to the now-shelved Bill 1. She said a separate law already on Quebec\u2019s books raises the same concerns.<\/p>\n<p>Last year, the CAQ government passed Bill 84, An Act respecting integration into the Quebec nation.\u00a0<\/p>\n<p>That law states that \u201cQuebec culture, of which the French language is the main vehicle, enables immigrants and persons identifying with cultural minorities to integrate into Quebec society.\u201d<\/p>\n<p>Millaire told The Gazette that the rapporteurs\u2019 finding that the integration model in Bill 1 amounts to assimilation applies equally to the integration law, which remains in force \u2014 and could be used to challenge it in court.<\/p>\n<p>\u201cA nation has the right to plan the way we would welcome, for example, immigrants, but you cannot force people to integrate because it leads to assimilation,\u2019 said Millaire, a board member of the International Commission of Jurists Canada.\u00a0<\/p>\n<p>\u201cIt\u2019s significant that the rapporteurs used the word assimilation. It\u2019s a very strong word\u00a0\u2014 assimilation means to violate the rights of minorities and Indigenous Peoples.\u201d<\/p>\n<p>The rapporteurs also criticized other parts of the proposed constitution.<\/p>\n<p>For example, they took issue with the constitutional council that would have been created. The council\u2019s members would have been chosen based on alignment with \u201cthe Quebec nation,\u201d undermining its independence and, by extension, the broader authority of the courts and rule of law, the rapporteurs found.<\/p>\n<p>The rapporteurs also flagged concerns about a provision that would have made gender equality automatically supersede religious freedom. They said human rights must be assessed in context and that no fixed hierarchy between rights should exist, warning that a rigid theoretical ranking could itself produce discrimination.<\/p>\n<p>Justice Minister Simon Jolin-Barrette unveiled the proposed constitution in October.<\/p>\n<p>He said Quebec needs its own constitution to \u201cdefend the values that unite us, to protect our language, which will always be fragile, and to strengthen our autonomy so that the collective destiny of the Quebec nation continues to be shaped by Quebecers themselves.\u201d<\/p>\n<p>The project was criticized by opposition parties, constitutional lawyers, academics and universities, with Quebec\u2019s lawyers\u2019 order decrying the proposal as part of a \u201cdrift towards authoritarianism.\u201d<\/p>\n<p>\t\tEditor\u2019s Picks\t<\/p>\n<p>Millaire said the CAQ and other parties considering proposals to create a written Quebec constitution should take note of the rapporteurs\u2019 findings.<\/p>\n<p>The Parti Qu\u00e9b\u00e9cois, the Liberals, Qu\u00e9bec solidaire and the Conservative Party of Quebec have all said they favour the idea of a Quebec constitution.\u00a0\u00a0<\/p>\n<p>Premier Christine Fr\u00e9chette has said that if the CAQ forms the next government, it will try to revive the constitutional plan.<\/p>\n<p>\u201cIt\u2019s not necessarily the content of the constitution that was an obstacle \u2026 it was seen as the process,\u201d Fr\u00e9chette said.<\/p>\n<p>UN rapporteurs have no enforcement power. However, their findings can carry moral authority.<\/p>\n<p>More than 30 years ago, the UN Human Rights Committee investigated complaints about Quebec\u2019s language laws.<\/p>\n<p>In 1993, the UN body, which monitors compliance with the International Covenant on Civil and Political Rights, upheld complaints, saying a state can choose an official language but not exclude another.<\/p>\n<p>The decision increased pressure on Quebec.
