An appeals court upheld Harvey Weinstein<\/a>\u2019s 2022 rape and sexual assault conviction in California<\/a> on Friday, but ordered his trial judge to resentence him.<\/p>\n

The disgraced film tycoon, whose misconduct spurred a social movement in Hollywood, was found guilty of assaulting an Italian model in her hotel room during a film festival. Her identity was kept private during a trial in Los Angeles. Weinstein was sentenced to 16 years in prison.<\/p>\n

\u201cWe are disappointed by today\u2019s decision and respectfully disagree with the Court of Appeal\u2019s conclusions regarding the fairness of Mr. Weinstein\u2019s trial,\u201d Juda Engelmayer, a Weinstein spokesperson, said in an email. \u201cAt the same time, the court correctly recognized that his sentence cannot stand.\u201d<\/p>\n

Weinstein\u2019s lawyers, Jennifer Bonjean and Michael Freedman, had sought to overturn the conviction, arguing their client\u2019s trial had been \u201cdoomed from the start\u201d in a 2024 motion to appeal.<\/p>\n

The attorneys took fault with the jury learning Weinstein had been convicted<\/a> of rape in New York<\/a> during jury selection, saying that knowledge \u201cinfected\u201d the proceedings.<\/p>\n

They said during the trial, the state had focused on Weinstein\u2019s character over his charged offenses, citing evidence put forth by prosecutors related to the former producer\u2019s \u201cmistreatment\u201d of women, according to the motion.<\/p>\n

More than 80 women have come forward with allegations of sexual assault or misconduct against Weinstein. He has denied the claims.<\/p>\n

Weinstein\u2019s legal team also alleged that Jane Doe 1 provided false testimony about the \u201csexual\u201d nature of her relationship with Pascal Vicedomini, the head of a film festival. The attorneys characterized the information as instrumental to proving their client\u2019s innocence.<\/p>\n

The questioning would have shown she perjured herself when she said she and Vicedomini were just friends and colleagues, Weinstein\u2019s lawyers argued. And they said it would have bolstered their argument that she was not even in her room on the night of the alleged assault.<\/p>\n

The California court\u2019s ruling comes just one day after New York prosecutors dismissed<\/a> a rape charge against Weinstein.<\/p>\n

In 2020, Weinstein was found guilty of raping an actress Jessica Mann in a New York hotel. A higher court overturned<\/a> the conviction in 2024, saying Weinstein\u2019s trial had been prejudiced by the judge allowing woman who alleged they were sexual assault victims of Weinstein to testify, despite not being plaintiffs in the case.<\/p>\n

Prosecutors brought a new case against Weinstein in 2025, which ended in a mistrial<\/a> after the jury was deadlocked and its foreperson declined further deliberations. A third case this May also ended<\/a> in a mistrial.<\/p>\n

The case was dropped this week after Mann declined to testify for a fourth trial.<\/p>\n

In New York, Weinstein is awaiting a September sentencing on his still-standing assault conviction involving a different woman. Prosecutors are seeking a 20-year prison term. He would serve his California<\/a> sentence only after that.<\/p>\n
