{"id":84785,"date":"2025-08-20T23:14:07","date_gmt":"2025-08-20T23:14:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/84785\/"},"modified":"2025-08-20T23:14:07","modified_gmt":"2025-08-20T23:14:07","slug":"lawsuits-begin-after-legionnaires-outbreak-tears-through-new-york-city-its-completely-preventable","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/84785\/","title":{"rendered":"Lawsuits begin after Legionnaires outbreak tears through New York City: \u2018It\u2019s completely preventable\u2019"},"content":{"rendered":"<p class=\"mb-4 text-lg md:leading-8 break-words\">Two construction workers who were infected with <a href=\"https:\/\/www.yahoo.com\/news\/articles\/legionnaires-disease-symptoms-potentially-deadly-154652793.html\" data-ylk=\"slk:Legionnaires\u2019 disease;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">Legionnaires\u2019 disease<\/a> after a \u2018completely preventable\u2019 outbreak occurred in New York City are launching lawsuits against two companies for alleged negligence that led to the outbreak.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Duane Headley and Nunzio Quinto, two men from Nassau County in Long Island, said in separate complaints on Wednesday that they were infected with the potentially deadly disease while working on construction sites at or near Harlem Hospital Center \u2013 the <a href=\"https:\/\/www.yahoo.com\/news\/articles\/one-dead-22-sick-legionnaires-093758097.html\" data-ylk=\"slk:epicenter of the outbreak.;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">epicenter of the outbreak. <\/a><\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">More than 100 people have been infected with the respiratory infection, and <a href=\"https:\/\/www.yahoo.com\/news\/articles\/two-dead-58-sick-york-131757255.html\" data-ylk=\"slk:at least five have died;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">at least five have died<\/a> after contracting it from a dozen cooling towers on top of Harlem Hospital Center that contained the Legionella bacteria and then spread through the air nearby.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Headley, who <a href=\"https:\/\/iapps.courts.state.ny.us\/fbem\/DocumentDisplayServlet?documentId=lzyBlLiZyk6iHRd1zd1Mtw==&amp;system=prod\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:filed the complaint;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">filed the complaint <\/a>against Rising Sun Construction LLC, and Quinto, who <a href=\"https:\/\/iapps.courts.state.ny.us\/fbem\/DocumentDisplayServlet?documentId=R7j0geslZEnaSKcNxKlviQ==&amp;system=prod\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:filed a complaint;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">filed a complaint<\/a> against Skanska USA Building, Inc., say the companies failed to maintain the properties or test the cooling towers for bacteria, resulting in the city\u2019s worst Legionnaire\u2019s disease outbreak in a decade.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">&#8220;This medical tragedy that led to the deaths of five citizens from Harlem, that we know about, was a completely preventable outbreak,&#8221; Ben Crump, the well-known civil rights attorney representing the men, said in a press conference on Wednesday.<\/p>\n<p><img alt=\"New Yorkers infected with Legionnaires\u2019 disease due to an outbreak in Harlem are gearing up to sue for the \u2018preventable\u2019 situation (CDC)\" loading=\"lazy\" width=\"960\" height=\"632\" decoding=\"async\" data-nimg=\"1\" class=\"rounded-lg\" style=\"color:transparent\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/08\/532654992ec2bd085405ac55eec0ae58.jpeg\"\/><\/p>\n<p>New Yorkers infected with Legionnaires\u2019 disease due to an outbreak in Harlem are gearing up to sue for the \u2018preventable\u2019 situation (CDC)<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">&#8220;It was completely preventable. And so when corporations cut corners, tragedies like this happen, preventable tragedies, unnecessary tragedies, people being hospitalized for days and weeks, having issues that cause them permanent damage,\u201d Crump said.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">A spokesperson for Skanska told The Independent that they cannot comment on pending litigation, but that the company has \u201cfully cooperated with the New York City Department of Health and Mental Hygiene to facilitate the inspection and disinfection of the cooling tower at the building currently under construction at 40 West 137th Street.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cWe will continue to implement all necessary mitigation and communication procedures to ensure the safety of our workers and the surrounding public,\u201d the spokesperson for Skanska said.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The Independent has asked Rising Sun Construction LLC for comment.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">New York City Health and Hospitals reportedly sent out a \u201cbulletin\u201d in early July warning construction companies of legionella developing, Jared Scotto, an attorney also representing the workers, said.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">However, upon a series of cases developing in Central Harlem, the city discovered that several cooling towers atop the buildings tested positive for the bacteria.
