{"id":88480,"date":"2025-08-22T10:32:06","date_gmt":"2025-08-22T10:32:06","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/88480\/"},"modified":"2025-08-22T10:32:06","modified_gmt":"2025-08-22T10:32:06","slug":"federal-judge-orders-alligator-alcatraz-to-be-shut-within-60-days","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/88480\/","title":{"rendered":"Federal Judge Orders \u2018Alligator Alcatraz\u2019 To Be Shut Within 60 Days"},"content":{"rendered":"<p>Topline<\/p>\n<p>A federal judge on Thursday blocked the Trump administration and the Florida government from bringing any new detainees to \u201cAlligator Alcatraz\u201d and ordered the relocation of existing detainees within 60 days, and ruled that both federal and state officials failed to conduct necessary environmental reviews before building the immigration detention site in the Everglades. <\/p>\n<p>A sign along the Tamiami Trail, also known as U.S. Highway 41, marks the entrance to Alligator Alcatraz.<\/p>\n<p>NurPhoto via Getty ImagesKey Facts<\/p>\n<p>In her <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.692544\/gov.uscourts.flsd.692544.131.0_1.pdf\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.692544\/gov.uscourts.flsd.692544.131.0_1.pdf\" data-ga-track=\"ExternalLink:https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.692544\/gov.uscourts.flsd.692544.131.0_1.pdf\" aria-label=\"ruling\">ruling<\/a>, Southern District of Florida Federal Judge Kathleen Williams also ordered the state and federal officials to begin dismantling fencing, lighting, gas, sewage, power generators and other items used to set up the facility withing 60 days.<\/p>\n<p>The judge noted she expects a \u201cprogrammatic\u201d winding down of the detainee population at the site during this 60-day period to allow the equipment and fencing removal to be done \u201cin a safe, humane, and responsible manner.\u201d<\/p>\n<p>The judge acknowledged the government was under \u201cpressure to respond and regulate\u201d immigration, but noted that the federal and state governments shared \u201clittle to no evidence why this detention camp\u201d in the Everglades was \u201cuniquely suited and critical to that mission.\u201d<\/p>\n<p>Williams then chastised government officials, saying it was apparent that \u201cin their haste to construct the detention camp, the state did not consider alternative locations.\u201d<\/p>\n<p>The ruling dismissed the state and federal government\u2019s argument that an environmental assessments of the site under the National Environmental Policy Act\u2014a requirement for federal agency actions\u2014was not necessary as the site was operated by by the state government.<\/p>\n<p>The judge pointed out that the project was \u201crequested by the federal government; built with a promise of full federal funding; constructed in compliance with ICE standards; staffed by deputized ICE Task Force Officers\u201d and wrote: \u201cif it walks like a duck, quacks like a duck, and looks like a duck, then it\u2019s a duck.\u201d<\/p>\n<p>What To Watch For<\/p>\n<p>Shortly after the ruling, Florida Gov. Ron DeSantis\u2019 administration <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.692544\/gov.uscourts.flsd.692544.132.0.pdf\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.692544\/gov.uscourts.flsd.692544.132.0.pdf\" data-ga-track=\"ExternalLink:https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.692544\/gov.uscourts.flsd.692544.132.0.pdf\" aria-label=\"filed a notice\">filed a notice<\/a> saying it intended to appeal the ruling before the Eleventh Circuit federal appellate court. DeSantis has not commented on the ruling yet, but earlier this week he said: \u201cIt\u2019s pretty clear we\u2019re in front of a judge who is not going to give us a fair shake on this.\u201d<\/p>\n<p>How Did The Plaintiffs React To The Ruling?<\/p>\n<p>Friends of the Everglades, one of the environmental groups that had filed the lawsuit against the detention site, cheered the ruling in a <a href=\"https:\/\/www.everglades.org\/judge-halts-operations-at-everglades-detention-center-with-preliminary-injunction\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/www.everglades.org\/judge-halts-operations-at-everglades-detention-center-with-preliminary-injunction\/\" data-ga-track=\"ExternalLink:https:\/\/www.everglades.org\/judge-halts-operations-at-everglades-detention-center-with-preliminary-injunction\/\" aria-label=\"statement\">statement<\/a>. The group\u2019s Executive Director, Eve Samples, said: \u201cThis is a landmark victory for the Everglades and countless Americans who believe this imperiled wilderness should be protected, not exploited. It sends a clear message that environmental laws must be respected by leaders at the highest levels of our government \u2014 and there are consequences for ignoring them.\u201d<\/p>\n<p>What Else Did The Judge Say In Her Ruling?<\/p>\n<p>Williams, an Obama appointee, invoked President Harry Truman&#8217;s 1947 address at the dedication of the Everglades National Park, where he described the site as an \u201cirreplaceable primitive area.\u201d The judge also mentioned that two decades later, an effort to build the world\u2019s largest jetport\u2014at the site where the so-called Alligator Alcatraz is located\u2014was abandoned due to environmental concerns. \u201cSince that time, every Florida governor, every Florida senator, and countless local and national political figures, including presidents, have publicly pledged their unequivocal support for the restoration, conservation, and protection of the Everglades. This Order does nothing more than uphold the basic requirements of legislation designed to fulfill those promises,\u201d she wrote.<\/p>\n<p>Chief Critic<\/p>\n<p>Jeremy Redfern, the communications director for Florida Attorney General James Uthmeier, attacked Williams and her ruling in an <a href=\"https:\/\/x.com\/jeremyredfernfl\/status\/1958721257773404453?s=46\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/x.com\/jeremyredfernfl\/status\/1958721257773404453?s=46\" data-ga-track=\"ExternalLink:https:\/\/x.com\/jeremyredfernfl\/status\/1958721257773404453?s=46\" aria-label=\"X post\">X post<\/a>, saying: \u201cJust this week, a judge in the same district as Judge Williams refused to hear a case because the Southern District of Florida was the improper venue for suits about Alligator Alcatraz. Once again, she oversteps her authority, and we will appeal this unlawful decision.\u201d<\/p>\n<p>Key Background<\/p>\n<p>Earlier this month, Williams had ordered authorities to halt construction at the Everglades detention facility. The earlier order blocked construction from adding new filling, paving, or infrastructure at the \u201cAlligator Alcatraz\u201d facility. Multiple environmental groups had filed the case against the facility, and the Miccosukee Tribe later <a href=\"https:\/\/www.cbsnews.com\/miami\/news\/judge-miccosukee-tribe-alligator-alcatraz-environmental-lawsuit\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/www.cbsnews.com\/miami\/news\/judge-miccosukee-tribe-alligator-alcatraz-environmental-lawsuit\/\" data-ga-track=\"ExternalLink:https:\/\/www.cbsnews.com\/miami\/news\/judge-miccosukee-tribe-alligator-alcatraz-environmental-lawsuit\/\" aria-label=\"joined\">joined<\/a> the suit. The groups argued that the facility\u2019s construction flouted environmental laws and endangered the wetlands and its protected animals and plants.
