Under the Trump administration\u2019s <a href=\"https:\/\/www.sierraclub.org\/sites\/default\/files\/2026-09\/fws-internal-memo-on-scope-of-esa-s-22take-22-prohibition.pdf\" rel=\"nofollow noopener\" target=\"_blank\">new interpretations of the law<\/a>, as long as <a href=\"https:\/\/www.nytimes.com\/2026\/09\/16\/climate\/endangered-species-act-change.html\" rel=\"nofollow noopener\" target=\"_blank\">the animal isn\u2019t directly targeted<\/a>, there is no violation.<\/p>\n<p>The new interpretations, <a href=\"https:\/\/theconversation.com\/why-trumps-move-to-gut-the-endangered-species-act-likely-wont-hold-up-in-court-287671\" rel=\"nofollow noopener\" target=\"_blank\">if they hold up to court challenges<\/a>, could leave a vast number of endangered species at higher risk. Many of the country\u2019s shipping, logging, mining and development practices are <a href=\"https:\/\/www.fisheries.noaa.gov\/topic\/endangered-species-conservation\/endangered-species-act-implementation\" rel=\"nofollow noopener\" target=\"_blank\">influenced by the Endangered Species Act<\/a>\u2019s protections. In some cases, entire species <a href=\"https:\/\/theconversation.com\/trumps-god-squad-pits-energy-vs-endangered-species-but-its-a-false-choice-protecting-wildlife-can-be-good-for-business-279433\" rel=\"nofollow noopener\" target=\"_blank\">could face extinction<\/a> if their habitats are no longer protected.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/762188\/original\/file-20260924-58-qtajme.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"People in a rubber boat near the entangled whale. Fishing gear entanglements and vessel strikes are two of the biggest threats to these endangered whales.<br \/>\n              <a class=\"source\" href=\"https:\/\/commons.wikimedia.org\/wiki\/File:USCGC_Kingfisher_with_a_view_of_the_door_to_her_stern_launching_ramp.jpg\" rel=\"nofollow noopener\" target=\"_blank\">Alicia Windham-Reid<\/a><\/p>\n<p>As an <a href=\"https:\/\/scholar.google.com\/citations?user=3_JsdOIAAAAJ&amp;hl=en\" rel=\"nofollow noopener\" target=\"_blank\">environmental conservation scientist<\/a>, I have been following these and other changes affecting endangered species. To understand what they mean, let\u2019s take a look at the potential impact on three very different species that are at risk: the Florida panther, the North Atlantic right whale and the monarch butterfly.<\/p>\n<p>What\u2019s changing in how the law is carried out<\/p>\n<p>First, here\u2019s what\u2019s changing.<\/p>\n<p>On Sept. 14, 2026, a Trump administration <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/07\/14\/2026-14195\/rescinding-the-definition-of-harm-under-the-endangered-species-act\" rel=\"nofollow noopener\" target=\"_blank\">rule change went into effect<\/a> that <a href=\"https:\/\/theconversation.com\/how-redefining-one-word-strips-the-endangered-species-acts-ability-to-protect-vital-habitat-287348\" rel=\"nofollow noopener\" target=\"_blank\">redefines harm<\/a> under the Endangered Species Act to mean only directly injuring or killing a member of an endangered species. The new definition removes an interpretation that had been used for half a century, and <a href=\"https:\/\/theconversation.com\/why-trumps-move-to-gut-the-endangered-species-act-likely-wont-hold-up-in-court-287671\" rel=\"nofollow noopener\" target=\"_blank\">upheld by the Supreme Court<\/a>, that harming an endangered species includes eliminating that species\u2019 habitat.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/762189\/original\/file-20260924-58-851v63.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"A stripped yellow and black caterpillar on a large fuzzy pod.\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2026\/10\/file-20260924-58-851v63.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              A monarch butterfly caterpillar crawls on a milkweed pod. Monarchs rely on milkweed for food and lay their eggs on the plants, but milkweed is also an aggressive weed in the Midwest.<br \/>\n              <a class=\"source\" href=\"https:\/\/commons.wikimedia.org\/wiki\/File:Monarch_butterfly_caterpillar_insect_danaus_plexippus.jpg\" rel=\"nofollow noopener\" target=\"_blank\">Ron Singer\/U.S. Fish and Wildlife Service<\/a><\/p>\n<p>That move alone could gut the law\u2019s ability to protect many species that face their biggest threat from losing habitat they rely on. <\/p>\n<p>But that isn\u2019t all. The director of the U.S. Fish and Wildlife Service <a href=\"https:\/\/www.sierraclub.org\/sites\/default\/files\/2026-09\/fws-internal-memo-on-scope-of-esa-s-22take-22-prohibition.pdf\" rel=\"nofollow noopener\" target=\"_blank\">wrote a memo<\/a> to the services\u2019 leadership team dated Sept. 14, 2026, further reinterpreting the law by arguing that it <a href=\"https:\/\/www.nytimes.com\/2026\/09\/16\/climate\/endangered-species-act-change.html\" rel=\"nofollow noopener\" target=\"_blank\">applies only to intentionally injuring or killing<\/a> an endangered species. So, if you didn\u2019t target that animal, that would be OK. If your ship strikes a whale, or you kill endangered animals while building a new data center, that would no longer be a problem under this interpretation of the law unless you meant to kill the animal.<\/p>\n<p>The administration also recently finalized its removal of what\u2019s known as the <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/07\/21\/2026-14633\/endangered-and-threatened-wildlife-and-plants-regulations-pertaining-to-endangered-and-threatened\" rel=\"nofollow noopener\" target=\"_blank\">Blanket 4(d) Rule<\/a>. That rule provided automatic protections for species listed as \u201cthreatened,\u201d one step before they become \u201cendangered,\u201d and for their critical habitat.<\/p>\n<p>As a result of these changes, species are still listed on paper as endangered but are largely unprotected.<\/p>\n<p>Florida panther: Territory loss and fragmentation<\/p>\n<p>The Florida panther (Puma concolor coryi) is a <a href=\"https:\/\/www.fws.gov\/species\/florida-panther-puma-concolor-coryi\" rel=\"nofollow noopener\" target=\"_blank\">majestic big cat<\/a> that stalks the state\u2019s <a href=\"https:\/\/myfwc.com\/wildlifehabitats\/wildlife\/panther\/description\/\" rel=\"nofollow noopener\" target=\"_blank\">southwestern pine forest and swamplands<\/a>, including the Everglades.<\/p>\n<p>Its population crashed in the 1900s from overhunting, in part to protect livestock, and from habitat loss. The Florida panther was <a href=\"https:\/\/www.fws.gov\/story\/2022-04\/florida-panther\" rel=\"nofollow noopener\" target=\"_blank\">close to extinction<\/a> when the <a href=\"https:\/\/www.ebsco.com\/research-starters\/law\/congress-passes-endangered-species-preservation-act\/\" rel=\"nofollow noopener\" target=\"_blank\">Endangered Species Preservation Act of 1966<\/a>, the predecessor of the Endangered Species Act, was passed and led to changes that <a href=\"https:\/\/myfwc.com\/media\/29517\/floridapantherssa_version1.pdf\" rel=\"nofollow noopener\" target=\"_blank\">began to help stabilize the population<\/a>. The state\u2019s wildlife agencies believe the number of adult panthers today to be <a href=\"https:\/\/wildlifeflorida.org\/florida-panthers\/\" rel=\"nofollow noopener\" target=\"_blank\">between 120 and 230<\/a>.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/762190\/original\/file-20260924-60-3hc92v.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"A big yellow cat under a tree stares into the camera.\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2026\/10\/file-20260924-60-3hc92v.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              Florida panthers are losing territory to development and face risks from road traffic. Only 120 to 230 of them remain.<br \/>\n              <a class=\"source\" href=\"https:\/\/commons.wikimedia.org\/wiki\/File:Florida_panther(2)_(5164633462).jpg\" rel=\"nofollow noopener\" target=\"_blank\">Connie Bransilver\/U.S. Fish and Wildlife Service Southeast Region<\/a>, <a class=\"license\" href=\"http:\/\/creativecommons.org\/licenses\/by\/4.0\/\" rel=\"nofollow noopener\" target=\"_blank\">CC BY<\/a><\/p>\n<p>These top predators require <a href=\"https:\/\/www.nps.gov\/teachers\/classrooms\/a-year-in-the-life-of-a-panther.htm\" rel=\"nofollow noopener\" target=\"_blank\">large home ranges<\/a> to live and hunt in, about 200 square miles (518 square kilometers) for males and 75 square miles (194 square kilometers) for females, so space is a scarce resource. And that\u2019s where the challenge lies.<\/p>\n<p>The public conservation areas are not capable of fully supporting the panther population. Roughly one-third of the panther\u2019s main habitat is <a href=\"https:\/\/wildlifeflorida.org\/how-one-florida-rancher-is-creating-space-for-panthers-to-thrive\/\" rel=\"nofollow noopener\" target=\"_blank\">on private ranches and timberlands<\/a> that are frequently targeted for suburban development in southwestern Florida.<\/p>\n<\/p>\n<p>Under the new Endangered Species Act interpretations, it would <a href=\"https:\/\/law.stanford.edu\/2026\/07\/23\/endangered-species-acts-harm-rule-explained-what-the-change-means-for-wildlife\/\" rel=\"nofollow noopener\" target=\"_blank\">not be considered a federal offense<\/a> to clear private palmetto flatwoods or cypress domes. Yet ecology research indicates that fragmenting habitat by breaking it up with roads and development results in panther deaths. The majority of panther deaths that aren\u2019t natural are <a href=\"https:\/\/myfwc.com\/wildlifehabitats\/wildlife\/panther\/biology\/\" rel=\"nofollow noopener\" target=\"_blank\">due to collisions with vehicles<\/a> as they attempt to cross busy roads.<\/p>\n<p>The revised rule also allows landowners to clear areas that had been preserved as wildlife corridors on their land without being liable for harming the panthers. That could accelerate <a href=\"https:\/\/www.fws.gov\/story\/2022-04\/florida-panther\" rel=\"nofollow noopener\" target=\"_blank\">habitat loss in southwest Florida\u2019s Caloosahatchee River basin<\/a> and undermine many years of effort put into the <a href=\"https:\/\/theconversation.com\/florida-panthers-and-black-bears-need-a-literal-path-for-survival-heres-how-the-florida-wildlife-corridor-provides-it-in-one-of-the-fastest-growing-us-states-251790\" rel=\"nofollow noopener\" target=\"_blank\">Florida Wildlife Corridor<\/a>, a connected network of public and private lands that allow the Florida panther and other species to roam.<\/p>\n<p>North Atlantic right whale: Noisy, dangerous seas<\/p>\n<p>In the ocean, habitat is influenced not only by the water but also by sounds that travel through it. That\u2019s particularly true for whale habitat.<\/p>\n<p>The <a href=\"https:\/\/www.fisheries.noaa.gov\/species\/north-atlantic-right-whale\" rel=\"nofollow noopener\" target=\"_blank\">North Atlantic right whale<\/a> (Eubalaena glacialis) is one of the most endangered whale species, with an estimated population of about <a href=\"https:\/\/www.fisheries.noaa.gov\/national\/endangered-species-conservation\/north-atlantic-right-whale-calving-season-2026\" rel=\"nofollow noopener\" target=\"_blank\">380 animals and only around 70 breeding females<\/a> remaining, primarily along the North American Atlantic coast.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/762191\/original\/file-20260924-60-gdni0p.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"A right whale and its calf\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2026\/10\/file-20260924-60-gdni0p.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              North Atlantic right whales rely on sound traveling long distances through water to communicate. That communication gets harder as the ocean becomes noisier.<br \/>\n              <a class=\"source\" href=\"https:\/\/commons.wikimedia.org\/wiki\/File:SBNMS_-right_whale_(27907275651).jpg\" rel=\"nofollow noopener\" target=\"_blank\">NOAA<\/a><\/p>\n<p>Right whales communicate with <a href=\"https:\/\/dosits.org\/galleries\/audio-gallery\/marine-mammals\/baleen-whales\/north-atlantic-right-whale\/\" rel=\"nofollow noopener\" target=\"_blank\">low-frequency sounds<\/a> that help them navigate, locate food and connect with their calves. <\/p>\n<p>The noise caused by ships, seismic surveys used in oil exploration, and pile-driving associated with offshore energy projects <a href=\"https:\/\/sanctuaries.noaa.gov\/science\/sentinel-site-program\/monterey-bay\/noise.html\" rel=\"nofollow noopener\" target=\"_blank\">results in background noise<\/a> that can disrupt these signals. <\/p>\n<\/p>\n<p>In addition to sound interference, whales face physical risks from being struck by boats and becoming entangled in fishing gear. The new interpretations of the Endangered Species Act remove some of the legal basis for enforcing rules for noisy seismic surveys, speed limits on vessels and restrictions on shipping routes designed to help protect the whales from harm.<\/p>\n<p>Monarch butterfly: Living in a regulatory limbo<\/p>\n<p>The <a href=\"https:\/\/www.fws.gov\/species\/monarch-danaus-plexippus\" rel=\"nofollow noopener\" target=\"_blank\">eastern migratory monarch butterfly<\/a> (Danaus plexippus), a delicate orange-and-black butterfly that was once plentiful across North America\u2019s prairies in summer, is an example of a species that would benefit from the <a href=\"https:\/\/earthjustice.org\/wp-content\/uploads\/2026\/07\/2026-07-21-60-day-letter-on-4d-rule-final-pdf.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Blanket 4(d) Rule<\/a>.<\/p>\n<p>The <a href=\"https:\/\/www.umesc.usgs.gov\/management\/dss\/monarch.html\" rel=\"nofollow noopener\" target=\"_blank\">butterfly\u2019s population has fallen by about 80%<\/a> over the past decade, largely due to habitat loss. In the U.S., that includes the <a href=\"https:\/\/www.usgs.gov\/news\/national-news-release\/billions-more-milkweeds-needed-restore-monarchs\" rel=\"nofollow noopener\" target=\"_blank\">loss of milkweed<\/a>, which the butterflies <a href=\"https:\/\/coastalbg.uga.edu\/2023\/10\/the-connection-between-milkweed-and-monarch-butterflies\/\" rel=\"nofollow noopener\" target=\"_blank\">rely on for food and laying eggs<\/a> as they travel through the Midwest, but that can compete with crops.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/762192\/original\/file-20260924-50-yrs1dm.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"An orange and black butterfly on a pink constellation of tiny flowers.\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2026\/10\/file-20260924-50-yrs1dm.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              A monarch butterfly on a milkweed flower. Monarchs are considered threatened, and changes to rules around the Endangered Species Act mean they may wait much longer for protective actions.<br \/>\n              <a class=\"source\" href=\"https:\/\/upload.wikimedia.org\/wikipedia\/commons\/3\/3d\/Monarch_butterfly_swamp_milkweed_Michigan_15_August_2016.png?utm_source=commons.wikimedia.org&amp;utm_campaign=index&amp;utm_content=thumbnail_unscaled\" rel=\"nofollow noopener\" target=\"_blank\">Jim Hudgins\/USFWS<\/a><\/p>\n<p>In the past, whenever a species was <a href=\"https:\/\/www.fws.gov\/sites\/default\/files\/documents\/ESA-Section-4-Listing.pdf\" rel=\"nofollow noopener\" target=\"_blank\">listed as threatened<\/a> \u2013 a step below endangered, and the status being <a href=\"https:\/\/www.fws.gov\/our-work\/pollinators\/save-monarch\" rel=\"nofollow noopener\" target=\"_blank\">recommended for the monarch butterfly<\/a> \u2013 it automatically received protections under the Blanket 4(d) Rule. <\/p>\n<p><a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/07\/21\/2026-14633\/endangered-and-threatened-wildlife-and-plants-regulations-pertaining-to-endangered-and-threatened\" rel=\"nofollow noopener\" target=\"_blank\">Without that rule<\/a>, threatened species no longer get automatic protections and instead rely on agencies drawing up species-specific rules for each one, a process that can take years.<\/p>\n<p>Losing proactive protection<\/p>\n<p>The reinterpretations of the Endangered Species Act change the law from one that is proactive to one that takes action only after there has been immediate and intentional physical harm.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/762210\/original\/file-20260925-50-r70ajq.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"A whale sticking its nose up above the water.\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2026\/10\/file-20260925-50-r70ajq.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              A North American right whale sticks its rostrum \u2013 its jaw and snout \u2013 above the water.<br \/>\n              <a class=\"source\" href=\"https:\/\/commons.wikimedia.org\/wiki\/File:North_Atlantic_right_whale.jpg\" rel=\"nofollow noopener\" target=\"_blank\">Moira Brown\/New England Aquarium<\/a><\/p>\n<p>Hunting is not the primary threat today to the Florida panther, the North Atlantic right whale or the monarch butterfly.
