What happens now?"},"content":{"rendered":"<p><a style=\"display:block\" href=\"https:\/\/www.theglobeandmail.com\/resizer\/v2\/X5QSSLKOTFERNGYMSZZJEHNTPA.jpg?auth=d780b08d48a54083b8acf0cbb2d03285d3cd8fa32adcdff3c2efbc9fa8135208&amp;width=600&amp;height=400&amp;quality=80&amp;smart=true\" aria-haspopup=\"true\" data-photo-viewer-index=\"0\" rel=\"nofollow noopener\" target=\"_blank\">Open this photo in gallery:<\/a><\/p>\n<p class=\"figcap-text\">Activist Joshua Rubin protests at the entrance to &#8216;Alligator Alcatraz&#8217; at the Dade-Collier Training and Transition Airport on Thursday in Ochopee, Fla.Joe Raedle\/Getty Images<\/p>\n<p class=\"c-article-body__text text-pr-5\">A federal judge has put a stop to further expansion of the immigration detention centre built in the <a href=\"https:\/\/www.theglobeandmail.com\/topics\/florida\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/topics\/florida\/\">Florida<\/a> Everglades and dubbed \u201cAlligator Alcatraz,\u201d ordering that its operations wind down within two months.<\/p>\n<p class=\"c-article-body__text text-pr-5\">U.S. District Judge Kathleen Williams in Miami wrote in her 82-page order late Thursday that Florida officials never sufficiently explained why an <a href=\"https:\/\/www.theglobeandmail.com\/topics\/immigration\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/topics\/immigration\/\">immigration<\/a> detention centre needed to be located in the middle of sensitive wetlands cherished by environmentalists and outdoors people.<\/p>\n<p class=\"c-article-body__text text-pr-5\">She also said that state and federal authorities never undertook an environmental review as required by federal law before Florida officials hastily built the detention camp which they championed as a model for U.S. President <a href=\"https:\/\/www.theglobeandmail.com\/topics\/donald-trump\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/topics\/donald-trump\/\">Donald Trump\u2019s<\/a> immigration policies. That failure adversely affected the \u201crecreational, conservational, and aesthetic interests\u201d of the environmental groups and Miccosukee Tribe which brought the lawsuit, she said.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Republican Governor Ron DeSantis on Friday reacted to the ruling, saying he would not be deterred by \u201can activist judge.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cWe knew this would be something that would likely happen,\u201d DeSantis said at a news conference in Panama City. \u201cWe will respond accordingly. You either have a country or you don\u2019t.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">Here\u2019s what to know about the situation and what might come next:<\/p>\n<p>A federal judge has put a stop to further expansion of the immigration detention centre built in the Florida Everglades and dubbed \u201cAlligator Alcatraz,&#8221; ordering that its operations wind down within two months.<\/p>\n<p class=\"text-gmr-5\">The Associated Press<\/p>\n<p>What did the judge say?<\/p>\n<p class=\"c-article-body__text text-pr-5\">Williams said she expected the population at the facility to drop within 60 days by transferring detainees to other facilities. Once that happens, fencing, lighting, gas, waste, generators and other equipment should be removed from the site. No additional detainees can be sent to the facility, and no more additional lighting, fencing, paving, buildings or tents can be added to the camp. The only repairs that can be made to the existing facility are for safety purposes. However, the judge allowed for the existing dormitories and housing to stay in place as long as they are maintained to prevent deterioration or damage.<\/p>\n<p>Here\u2019s where detainees might end up<\/p>\n<p class=\"c-article-body__text text-pr-5\">During court hearings, lawyers said at one point there were fewer than 1,000 detainees at the facility, which state officials had planned to hold up to 3,000 people. Although the detainees could be sent to other facilities out of state, Florida has other immigration detention centres including the Krome North Processing Center in Miami, the Broward Transitional Center in Pompano Beach and the Baker County Detention Center managed by the local sheriff\u2019s office. Earlier this month, DeSantis announced plans for a second state-initiated immigration detention facility dubbed \u201cDeportation Depot\u201d at a state prison about 69 kilometres west of downtown Jacksonville. State officials say it is expected to hold 1,300 immigration detention beds, though that capacity could be expanded to 2,000 beds.<\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/world\/article-florida-migrant-centre-detainees-inhumane-conditions-alligator\/\" rel=\"nofollow noopener\" target=\"_blank\">U.S. detainees describe worm-filled food, inhuman treatment at \u2018Alligator Alcatraz\u2019 migrant centre<\/a><\/p>\n<p>How does this decision impact the other \u2018Alligator Alcatraz\u2019 lawsuit?<\/p>\n<p class=\"c-article-body__text text-pr-5\">Civil rights lawyers had filed a second lawsuit over practices at \u201cAlligator Alcatraz,\u201d claiming that detainees weren\u2019t able to meet with their attorneys privately and were denied access to immigration courts. Another federal judge in Miami dismissed part of the lawsuit earlier this week after the Trump administration designated the Krome North Processing Center as the court for their cases to be heard. The judge moved the remaining counts of the case from Florida\u2019s southern district to the middle district. Eunice Cho, the lead attorney for the detainees, said Friday that the decision in the environmental lawsuit won\u2019t have an impact on the civil rights case since there could be detainees at the facility for the next two months.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cOur case addresses the lack of access to counsel for people detained at Alligator Alcatraz, and there are still people detained there,\u201d Cho said.<\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/world\/us-politics\/article-immigrants-fear-trumps-deportation-documented-or-not\/\" rel=\"nofollow noopener\" target=\"_blank\">Documented or not, immigrants in the U.S. fear they\u2019ll be swept up in Trump\u2019s mass deportation crackdown<\/a><\/p>\n<p>Status of the hundreds of millions of dollars in contracts<\/p>\n<p class=\"c-article-body__text text-pr-5\">No one has said publicly what will happen to the hundreds of millions of dollars in contracts involved in the facility. DeSantis\u2019 administration in July signed contracts with private vendors to pay at least US$245-million to set up and run the centre, according to a public database. That amount \u2013 to be fronted by Florida taxpayers \u2013 was in line with the US$450-million a year officials have estimated the facility was going to cost. The governor\u2019s office and the Florida Division of Emergency Management on Friday didn\u2019t respond to questions about whether Florida taxpayers would still be on the hook for the contracts if the facility is shuttered.<\/p>\n<p>Is this a final decision?<\/p>\n<p class=\"c-article-body__text text-pr-5\">No. This case will continue to be litigated. The state of Florida filed a notice of appeal Thursday night, shortly after the ruling was issued.
