{"id":99339,"date":"2025-08-26T22:25:07","date_gmt":"2025-08-26T22:25:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/99339\/"},"modified":"2025-08-26T22:25:07","modified_gmt":"2025-08-26T22:25:07","slug":"cbc-to-challenge-order-requiring-disclosure-of-gem-subscriber-numbers","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/99339\/","title":{"rendered":"CBC to challenge order requiring disclosure of Gem subscriber numbers"},"content":{"rendered":"<p><a style=\"display:block\" href=\"https:\/\/www.theglobeandmail.com\/resizer\/v2\/RSC6PQMXEBHEJFSIVA4KFUIUW4.jpg?auth=9f5694f542bd825e50b7f80fe4c2897c337943ea65437e55ee464290db4c34fd&amp;width=600&amp;height=400&amp;quality=80&amp;smart=true\" aria-haspopup=\"true\" data-photo-viewer-index=\"0\" rel=\"nofollow noopener\" target=\"_blank\">Open this photo in gallery:<\/a><\/p>\n<p class=\"figcap-text\">The public broadcaster was ordered by the information commissioner in July to disclose the number of paid subscribers to Gem.Tijana Martin\/The Canadian Press<\/p>\n<p class=\"c-article-body__text text-pr-5\">CBC\/Radio-Canada is going to court to defend its refusal to disclose subscriber numbers for its Gem streaming service.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The move comes after the information commissioner ordered CBC to make available the number of paid subscribers to Gem.<\/p>\n<p class=\"c-article-body__text text-pr-5\">A CBC spokesperson said the public broadcaster believes the information commissioner\u2019s interpretation of the law is wrong. <\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cWe will make our case in our filing with the Federal Court and let the court decide,\u201d Leon Mar said in an e-mail.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Matt Malone, an assistant professor at the University of Ottawa, first asked for the information in an access-to-information request. <\/p>\n<p class=\"c-article-body__text text-pr-5\">When CBC refused, citing exemptions for programming activities and information that could harm its competitive position, Malone appealed to the federal information commissioner. The information commissioner disagreed with the CBC, and in July ordered the public broadcaster to disclose the numbers.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The fact that the CBC is willing to go to court is \u201ca very interesting use of CBC\u2019s precious resources,\u201d Malone said. <\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cIn my opinion, it\u2019s a sad but telling attempt to dodge basic transparency.\u201d<\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/arts\/article-cbc-plan-b-french-english-subtitles-netflix\/\" rel=\"nofollow noopener\" target=\"_blank\">CBC\/Radio-Canada could double its value to Canadians, if only it stopped resisting<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">Malone argued CBC\u2019s refusal to comply with the order sets a bad precedent, \u201cespecially for the CBC journalists who still use the access-to-information requests as part of their journalistic work and try to get disclosure from federal institutions.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">CBC launched the streaming service, which has both paid and free versions, in 2018. The paid version, which costs $5.99 a month, includes ad-free on-demand streaming and a stream of CBC\u2019s 24-hour news channel, CBC News Network.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Mar said CBC does not disclose either the paid or unpaid subscriber numbers. <\/p>\n<p class=\"c-article-body__text text-pr-5\">Kaan Yigit, principal at the market research company The Strategic Counsel, noted not releasing Canadian subscriber numbers has \u201cbecome a bit of an industry practice.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">He said the company\u2019s research indicates Gem garners \u201crespectable numbers on a weekly basis in the same range as Bell\u2019s Crave and a bit better than Paramount+ and Tubi.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">However, those numbers would be for all users, with paying subscribers likely making up a smaller subset. <\/p>\n<p class=\"c-article-body__text text-pr-5\">Given the number of streaming services available, some of which have implemented recent price increases, \u201cit would not be surprising that paid subscribers would only be a small portion of their base as consumers are trying to balance free and paid tier streaming subscriptions and some with cable,\u201d Yigit said in an e-mail.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cWhy take a paid tier when you can have much of what they offer for free?\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">In her final report on the access-to-information complaint, Information Commissioner Caroline Maynard wrote that she agrees the subscriber numbers relate to CBC\u2019s programming activities, but they also relate to its general administration, which means the exemption to disclosure does not apply. <\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/arts\/film\/article-consumer-protection-bc-film-classification-theatre-ratings-movies\/\" rel=\"nofollow noopener\" target=\"_blank\">As provinces move out of film classification in the streaming era, why is B.C. doubling down?<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">The report noted that CBC argued it competes with other streaming services, and that \u201creleasing the information at issue would harm its competitive position by providing sensitive data to these competitors, allowing them to use it to be more aggressive in their attempts to lure paid subscribers from the Gem platform to theirs.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">But Maynard concluded that overall, \u201cwhile CBC did identify possible harms to its competitive position or to ongoing negotiations, it did not demonstrate that there was a reasonable expectation that these harms could occur, well beyond a mere possibility.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">Barry Kiefl, president of research company Canadian Media Research, said there has been very little public information about Gem audiences. He pointed to numbers provided by CBC to industry publication C21 last year, indicating viewership of both Crave and CBC\u2019s streaming services is completely dwarfed by foreign streaming competitors and social media in Ontario.<\/p>\n<p class=\"c-article-body__text text-pr-5\">More data may soon be available.
