Court action after crane is used to install mobile home at rear of home in Limerick town

SEVERAL members of the same family are facing prosecution after a crane was allegedly used to lift a mobile home into the back garden of their council house.

Limerick City and County Council has initiated legal proceedings against four individuals who all have an address of Páirc Luachra in Abbeyfeale and the matter first came before Newcastle West Court on November 4.

The four are accused of failing to comply with an enforcement notice, requiring them to remove a caravan and mobile home from the property. The notice in question was issued on July 4, last.

Solicitor Will Leahy, representing Limerick City and County Council, told the court complaints were received earlier in the summer that a caravan had been parked in the front garden of the house and a mobile home placed in the back garden of the house.

He told Judge Carol Anne Coolican that he understands a crane was used at a “substantial cost” to place the mobile home in the back garden of the property.

Solicitor Enda O’Connor, representing the defendants, said his clients would encounter “significant difficulty” in moving the mobile home from the property and he suggested it may not be possible to do so before the end of the year.

Mr O’Connor made an application for disclosure and he sought an adjournment of the case to allow him time to assess the materials and information relating to the case.

He suggested that the case be adjourned until the New Year to avoid the busy Christmas period.

However, Mr Leahy responded by saying that he was “more than happy” to deal with the case before Christmas.

Judge Coolican adjourned the case until December 2 when she will hear evidence relating to the alleged offence.
