An Ennis ice-cream business has scooped a win in a planning row with the local authority and will now be allowed to keep their distinctive shopfront.
Gino’s Italian Limited, operating on O’Connell Street, have been successful in their appeal to An Coimisiún Pleanála against a decision by Clare County Council to refuse planning permission to retain its sliding glass door facade.
An Coimisiún Pleanála decided by a majority decision of 2:1 to grant permission generally in accordance with its inspector’s recommendations, while also deciding not to attach the inspector’s recommended condition to reduce the width of the doorway.
The contested shop entrance comprises of a full length bi-folding white PVC door which are fully open during the businesses’ operating hours.
According to the owners of the business they believed the change to the shopfront would have constituted ‘exempt development’ which is why planning permission had not been sought initially.
