A Letterkenny man who was caught behind the wheel while banned from driving has avoided being sent to prison.
James Browne (59), of Sylvan Park, was also before Letterkenny District Court charged with driving without insurance at Gortlee, Letterkenny, on January 4, 2026.
The court heard Browne received a three-year driving ban in 2025 for driving without insurance and a suspended prison sentence was also handed down on the same court date. Sergeant Maurice Doyle informed Judge Emile Daly that a four-month prison sentence was previously imposed with the entire term suspended for 18 months in July 2025.
In relation to the latest detection, Judge Daly said, she had the option of ordering Browne to do Community Service in lieu of a prison sentence. However the defendant said Community Service ‘did not suit’ him as he was working full-time.
Sgt Doyle told the court Browne was observed driving at 1pm on January 4 last at Gortlee.
Browne was stopped and was known to the Garda member who made a demand for the production of insurance documents, and this was not complied with.

Mr Jason Laverty, solicitor, told a previous sitting that a probation and welfare report was “favourable” to Browne.

“He is a businessman and he moved the jeep a short distance out of absolute necessity,” Mr Laverty said, adding that his client now employs the services of a driver.
The solicitor said the latest matters before the court were ‘undisputed’.
“He put his hands up immediately and has admitted that he has done wrong,” he said.
He added that a lot of Browne’s previous convictions came from abuse of alcohol, but that he had engaged in addiction services in relation to his drinking.
“This (latest offences) was a blip on that road to recovery,” Mr Laverty added.
Judge Daly said that, as the community service option was off the table, she could either serve him with another ban or send him to prison.
Mr Laverty said his client was fully aware of the position he was in and was dealing with his alcohol addiction.
“He is now employed on a full time basis in the family business, appreciates the gravity of what he has done and assures me he will not drive again. He has rebuilt his life considerably over the last number of years. All this centres around drink and he is currently undergoing rehab,” he said.
Asked by Judge Daly if he was currently sober, Browne replied: “I haven’t drank since the last time I was caught drink driving.”
The judge told Browne the penalties had ‘started off low’ but that he had ‘continuously reoffended’.
She said, usually, there is an automatic prison sentence for ‘flagrant abuse’ of the law. In relation to driving without insurance, she convicted and fined Browne €550 and disqualified him from driving for four years. For driving while disqualified, she banned him for an additional four months and sentenced him to four months in prison. However, she said she would suspend the sentences for 18 months as Mr Laverty said he had turned his life around.
“What has happened is you have stopped drinking, and that’s a significant change,” Judge Daly said.
“The matter is in your hands, otherwise the other suspended sentence will be revisited.”
