A landlord in Co Laois<\/a> has been ordered to pay \u20ac6,000 in damages by a Residential Tenancies Board<\/a> (RTB) tribunal after it heard he failed to evict tenants despite their alleged \u201cegregious\u201d and \u201cchaotic\u201d behaviour over a 10-year period.<\/p>\n

Several residents living in a development in Mountmellick lodged a dispute with the RTB against landlord Seamus Spollen, saying they \u201cwished their nightmare would end\u201d.<\/p>\n

Ann Kiernan, who spoke on behalf of five other residents, told the tribunal there had been \u201cproblems from the beginning\u201d with Mr Spollen\u2019s tenants.<\/p>\n

Having lived there for 15 years, she claimed antisocial behaviour initially included drug use and drug dealing when they moved in a decade ago, though this escalated over time.<\/p>\n

She claimed before the tribunal that CCTV footage showed her cat being taken into the tenants\u2019 apartment on one occasion and \u201cwas never seen again\u201d, believing it \u201cmet its end in the flat\u201d.<\/p>\n

Ms Kiernan further claimed residents were frequently woken at night by shouting and fighting, and \u201ccars being driven around the courtyard\u201d.<\/p>\n

She said garda\u00ed, including the Armed Support Unit, have attended the development in the past.<\/p>\n

Ms Kiernan further claimed some of the tenants would \u201cintimidate and threaten residents\u201d, and on one occasion, she alleged a resident was physically assaulted.<\/p>\n

While Mr Spollen had issued a notice of termination due to antisocial behaviour in October 2024, Ms Kiernan said he had not progressed the termination and appeared to be \u201csitting back and making excuses\u201d.<\/p>\n

She said residents had suffered \u201cemotional distress\u201d due to the behaviour and were \u201calways on edge\u201d, adding that some had \u201cgiven up and moved out\u201d.<\/p>\n

Mr Spollen told the tribunal he was \u201cunaware\u201d of some of the incidents raised, adding that he was \u201cequally anxious to have his tenants vacate\u201d.<\/p>\n

He said his tenants have been overholding since November 2024 and had gone to see them but was \u201cthreatened\u201d that he would be \u201cburnt out\u201d, he claimed.<\/p>\n

He told the tribunal he had not made an official complaint to garda\u00ed.<\/p>\n

The tribunal found Mr Spollen to be in breach of his landlord obligations to the other residents, and had failed in his duty to them in not diligently pursuing the termination of his tenants\u2019 lease.<\/p>\n

\u201cThe complained of behaviour was not only egregious but was also long-running,\u201d it said, adding that it caused \u201cconsiderable distress\u201d to the residents.<\/p>\n

In awarding \u20ac1,000 to each of the six residents, it said the damages reflect the \u201cinconvenience suffered by each of them and, in particular, the distress and upset as a result of sleep deprivation and loss of quiet enjoyment of their homes arising from the ongoing chaotic events\u201d.<\/p>\n
