A man who claims to have escaped Al Shabaab in Somalia has been jailed for 16 months after what Judge Martin Nolan called an \u201carrogant\u201d attack on a stranger.\u00a0<\/p>\n
The Circuit Criminal Court heard that on the 24th of June 2024, Dek Abdi Hassan (31) of Basin View, Dublin 8 pushed Lawrence Kane in the chest causing him to fall to the ground causing a serious hip fracture which necessitated a replacement surgery.<\/p>\n
The court heard that Mr Kane, who was 66-years-old at the time, was walking to get lunch at Midnight Express at approximately 12:45pm on North Frederick Street.<\/p>\n
After pushing Kane, Hassan \u2013 who was aided in court by a Somali interpreter, continued on his way down the road after the \u201cunprovoked\u201d attack which caused the injured party to be \u201cvery badly injured\u201d.\u00a0\u00a0<\/p>\n
After passers-by stopped to assist Mr. Kane was conveyed to the Mater Hospital where two fractures in his wrist and another in his pelvis were discovered.\u00a0<\/p>\n
When Garda Michelle Heffernan of Mountjoy Garda Station was on mobile patrol on the 10th of July 2024 she recognised the accused and arrested him in relation to the assault.<\/p>\n
When interviewed, Hassan said he did not remember pushing Mr. Kane, but said that if he did, he would have had a reason.<\/p>\n
On the day of the assault, Hassan said he had been put out of the hostel he was staying in, did not sleep for two nights, and \u201chad a drink\u201d after an incident at work. He said that at the time he was \u201cstressed\u201d and accepted that he was \u201cdrunk\u201d.<\/p>\n
Garda Heffernan told the court that when the accused was questioned, he \u201cdidn\u2019t understand the seriousness of the charge\u201d.\u00a0<\/p>\n
He has 1 previous conviction in relation to breaches of Section 4 of the Public Order Act.\u00a0\u00a0<\/p>\n
In a victim impact statement, the injured party described an \u201cextended period of recovery\u201d and how he is still unable to walk unaided and suffers with \u201congoing stiffness\u201d.\u00a0<\/p>\n
Before the assault, Mr Kane was in full time employment, but was forced into early retirement as his \u201cindependence\u201d is now \u201crestricted\u201d.\u00a0<\/p>\n
He described a loss of a \u201csense of purpose\u201d and how his sister now has to perform basic tasks on his behalf such as shopping, paying bills, and looking after the house.\u00a0<\/p>\n
Hassan\u2019s defending counsel, Kevin McKrave BL said that his client \u201csimply pushed Mr. Kane K out of the way,\u201d and that he had been \u201cremoved\u201d from his hostel.\u00a0<\/p>\n
McKrave said that Hassan\u2019s father had been killed by Al Shabaab in 2008 and that two of his brothers had also been killed due to \u201ctribal\u201d conflicts in their home country where his client \u201cwitnessed summary executions\u201d.\u00a0<\/p>\n
In 2013 he \u201cescaped\u201d by travelling through Ethiopia and eventually reaching France -after being picked up in a boat by the Italian Navy \u2013 where he \u201cgot involved with drink\u201d before coming to Ireland in 2022.\u00a0<\/p>\n
He previously lived in Waterford but is now in Dublin where he had an address on Gardiner Street.<\/p>\n
The court heard he is \u201cquite religious now\u201d, \u201chas little or no English\u201d,\u00a0 and wants to \u201cregularise his situation\u201d in Ireland.\u00a0<\/p>\n
Judge Nolan said that the attack was an \u201carrogant type of offence\u201d in which it \u201cseems the defendant was thinking this unfortunate man was in his way\u201d and he \u201cjust pushed him out of the way,\u201d in a display of \u201carrogant behaviour\u201d.\u00a0<\/p>\n
