{"id":160012,"date":"2025-11-26T04:12:13","date_gmt":"2025-11-26T04:12:13","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/160012\/"},"modified":"2025-11-26T04:12:13","modified_gmt":"2025-11-26T04:12:13","slug":"national-crime-fighting-agency-carried-out-dawn-raid-on-limerick-superintendents-home-trial-told","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/160012\/","title":{"rendered":"National crime fighting agency carried out dawn raid on Limerick superintendent&#8217;s home, trial told"},"content":{"rendered":"<p>Detectives attached to a specialist national crime fighting agency carried out a dawn raid on the home of a Limerick garda superintendent, whom they suspected of disclosing sensitive information to a third party, a court heard on Tuesday.<\/p>\n<p>The trial of retired superintendent Edmond \u201cEamon\u201d O\u2019Neill, and four serving garda\u00ed, deny 39 counts of \u201cengaging in conduct tending or intending to pervert the course of justice\u201d, in respect of alleged interference in road traffic prosecutions.<\/p>\n<p class=\"\">The trial being held at Limerick Circuit Court, heard that, at 6.36am, May 16, 2019, detectives attached to the Dublin-based Garda National Bureau of Criminal Investiagtion (GNBCI) conducted a search of the home of Supt O\u2019Neill and his partner Sgt Anne Marie Hassett\u2019s home and their baby.<\/p>\n<p class=\"\">Supt O\u2019Neill was arrested at the scene by Chief Supt Walter O\u2019Sullivan, GNBCI, and he was taken to Athlone Garda Station for questioning on suspicion of breaching Section 62 of the Garda Siochana Act 2005, which, the court heard, prohibits Garda members and staff from disclosing information obtained in the course of their duties that would likely have a \u201charmful effect\u201d.<\/p>\n<p class=\"\">Detective Garda Brian Reidy, GNBCI, gave evidence he was instructed to search Supt O\u2019Neill\u2019s house for mobile phones that were to be analysed.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/ie\/wp-content\/uploads\/2025\/11\/4873764_7_articleinlinemobile_Garda_20Anne_20Marie_20Hassett.jpg\" alt=\"Garda Sergeantt Anne Marie Hassett handed over her mobile phone and PIN number to the GNBCI during the search. File picture: Liam Burke\/Press 22<\/p>\n<p class=\"\">He said Sgt Hassett was not a suspect in the section 62 probe, and that the search had nothing to do with the charges before the court that she, Mr O\u2019Neill, and three other serving garda\u00ed allegedly attempted to pervert the course of justice in respect of road traffic fixed charge penalty notices.<\/p>\n<p class=\"\">Det. Sgt Reidy said he found two mobile phones charging in Supt O\u2019Neill\u2019s master bedroom, one belonging to Mr O\u2019Neill, which was sent to London for analysis, and the other belonging to Sgt Hassett.<\/p>\n<p class=\"\">The witness said he seized a further six mobile phones in a safe at the house. An Apple iPad and charging lead as well as a memory stick attached to a set of keys were also seized. A seventh phone was seized at a garda station where Eamon O\u2019Neill was working at the time.<\/p>\n<p class=\"\">Felix McEnroy, senior counsel for Mr O\u2019Neill, asked Det. Sgt Reidy if he had been aware of RT\u00c9 television cameras being in Athlone where his client was being questioned by GNBCI that day.<\/p>\n<p class=\"\">Det. File picture: Press 22<\/p>\n<p class=\"\">The witness agreed, under cross-examination by James O\u2019Mahony, senior counsel for Sgt Hassett, that his client handed over her mobile phone and PIN number to the GNBCI during the search.<\/p>\n<p class=\"\">Detective Sgt Reidy also agreed with Mr O\u2019Mahony that the search was part of a \u201cdiscreet\u201d investigation.<\/p>\n<p class=\"\">Mr O\u2019Mahony suggested that at least 10 GNBCI officers raiding his client\u2019s home, wearing \u201craid jackets\u201d, would \u201cattract attention\u201d, and that the search and arrest of a superintendent was \u201cwidely published\u201d by the media at the time.<\/p>\n<p class=\"\">Mr O\u2019Mahony added that \u201ca criminal posted\u201d a \u201cvideo\u201d on \u201csocial media\u201d about the Garda raid.<\/p>\n<p class=\"\">Detective Sergeant Maria Cassells, GNBCI, who managed the search operation at Mr O\u2019Neill\u2019s house, said the Section 62 probe was led by her superior, Detective Inspector Michael McNulty.<\/p>\n<p class=\"\">Det. Sgt Cassells said she received a \u201cbriefing document\u201d signed by DI McNulty prior to the search that included photos of Supt O\u2019Neill and his house. Det. Sgt Cassells said the GNBCI officers removed their garda \u201craid jackets\u201d on request from Sgt Hassett.<\/p>\n<p class=\"\">The witness agreed with Sgt Hassett\u2019s counsel that Sgt Hassett was \u201cmortified\u201d that her neighbours, which included other garda\u00ed, would see the officers raiding the house.<\/p>\n<p class=\"\">Det Sgt Cassells agreed that no criminal charges arose against Supt O\u2019Neill nor any other garda in respect of the Section 62 probe.<\/p>\n<p class=\"\">Mr O\u2019Neill, along with Sergeant Hassett, Sergeant Michelle Leahy, and garda\u00ed Tom McGlinchey and Colm Geary, are on trial for allegedly attempting to pervert the course of justice, in respect of road traffic prosecutions.<\/p>\n<p class=\"\">The five were arrested and charged in May 2021, arising out of a GNBCI investigation.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/ie\/wp-content\/uploads\/2025\/11\/4873761_7_articleinlinemobile_Sgt_20Michelle_20Leahy_201.jpg\" alt=\"Sergeant Michelle Leahy is accused of two counts of carrying out her duties as a Court Presenter, with intent to pervert the course of justice, by applying to a district court to have a summons withdrawn, and a summons struck out, in recent of two road traffic prosecutions. Picture: Brendan Gleeson<\/p>\n<p class=\"\">It\u2019s the State\u2019s case that citizens contacted Supt O\u2019Neill about fixed charge penalty notices (FCPN), and that Supt O\u2019Neill, in turn, allegedly contacted Garda colleagues for the purpose of terminating the FCPNs.<\/p>\n<p class=\"\">Prosecuting senior counsel, Carl Hanahoe, earlier told the jury Mr O\u2019Neill was the common denominator in respect of all 39 charges.<\/p>\n<p class=\"\">\u201cWhat all the offences have in common is the interference or involvement of Eamon O\u2019Neill,\u201d Mr Hanahoe said.<\/p>\n<p class=\"\">Between them, Sgt Hassett, Garda McGlinchey and Garda Geary, are charged with a total of 10 counts that they did communicate with another garda or garda\u00ed for the purpose of terminating a potential or pending road traffic prosecution.<\/p>\n<p class=\"\">Sergeant Leahy is accused of two counts of carrying out her duties as a Court Presenter, with intent to pervert the course of justice, by applying to a district court to have a summons withdrawn, and a summons struck out, in respect of two road traffic prosecutions.<\/p>\n<p class=\"\">All five deny the charges.
