{"id":161486,"date":"2025-11-26T23:07:07","date_gmt":"2025-11-26T23:07:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/161486\/"},"modified":"2025-11-26T23:07:07","modified_gmt":"2025-11-26T23:07:07","slug":"california-prosecutors-office-used-ai-to-file-inaccurate-motion-in-criminal-case-california","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/161486\/","title":{"rendered":"California prosecutors\u2019 office used AI to file inaccurate motion in criminal case | California"},"content":{"rendered":"<p class=\"dcr-130mj7b\">A <a href=\"https:\/\/www.theguardian.com\/us-news\/california\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">California<\/a> prosecutors\u2019 office used artificial intelligence to file a motion in at least one criminal case, which contained errors known as \u201challucinations\u201d.<\/p>\n<p class=\"dcr-130mj7b\">A prosecutor at the Nevada county district attorney\u2019s office in northern California \u201crecently used artificial intelligence in preparing a filing, which resulted in an inaccurate citation,\u201d district attorney Jesse Wilson said in a statement to <a href=\"https:\/\/www.sacbee.com\/news\/local\/article312815223.html\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">the Sacramento Bee<\/a>. \u201cOnce the error was discovered, the filing was immediately withdrawn.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Defense and civil rights attorneys argue the prosecutors\u2019 office used artificial intelligence in other criminal court filings.<\/p>\n<p class=\"dcr-130mj7b\">In October, lawyers for Kyle Kjoller filed a motion with the third district court of appeal, calling for prosecutors to be subjected to sanctions over a number of errors in the prosecution\u2019s filings in Kjoller\u2019s case. Kjoller is being represented by a public defender and the non-profit Civil Rights Corps.<\/p>\n<p class=\"dcr-130mj7b\">The appeals court denied the sanction request without explanation. Then, Kjoller\u2019s lawyers identified similar errors in a filing by the prosecutors\u2019 office in another case. The defense filed another appeal, which was denied when Kjoller was convicted in his criminal case.<\/p>\n<p class=\"dcr-130mj7b\">Kjoller\u2019s lawyers then filed a petition with the California supreme court, identifying three cases they say contain errors typical of generative AI. The court has not yet issued a decision on whether it will take up the case.<\/p>\n<p class=\"dcr-130mj7b\">\u201cProsecutors\u2019 reliance on inaccurate legal authority can violate ethical rules, and represents an existential threat to the due process rights of criminal defendants and the legitimacy of the courts,\u201d Kjoller\u2019s attorneys wrote. Their filing included examples of instances where the prosecutor\u2019s brief cited nonexistent quotations or misinterpreted court rulings \u2013 errors common for artificial intelligence.<\/p>\n<p class=\"dcr-130mj7b\">On Friday, a group of 22 scholars, lawyers and criminal justice advocates filed a brief in support of Kjoller\u2019s case with the California supreme court.<\/p>\n<p class=\"dcr-130mj7b\">In a statement to <a href=\"https:\/\/www.sacbee.com\/news\/local\/article312815223.html\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">the Sacramento Bee<\/a>, the Nevada county district attorney\u2019s office admitted to using artificial intelligence in one of its filings, but not in Kjoller\u2019s case. After the errors were identified he said, \u201call of the attorneys in the office were reminded to verify all legal citations independently and not rely on AI-generated material without confirmation from reliable sources.\u201d<\/p>\n<p class=\"dcr-130mj7b\">In a statement to <a href=\"https:\/\/www.nytimes.com\/2025\/11\/25\/us\/prosecutor-artificial-intelligence-errors-lawyers-california.html\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">the New York Times<\/a>, he added that the office has conducted new trainings for staff and implemented an artificial intelligence policy.<\/p>\n<p class=\"dcr-130mj7b\">The California case is likely the first instance of a prosecutors\u2019 office using generative AI in a court filing in the United States. Although lawyers from <a href=\"https:\/\/www.theguardian.com\/world\/2024\/feb\/29\/canada-lawyer-chatgpt-fake-cases-ai\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Canada<\/a>, <a href=\"https:\/\/www.theguardian.com\/law\/2025\/sep\/03\/lawyer-caught-using-ai-generated-false-citations-in-court-case-penalised-in-australian-first\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Australia<\/a>, the <a href=\"https:\/\/www.theguardian.com\/technology\/2025\/jun\/06\/high-court-tells-uk-lawyers-to-urgently-stop-misuse-of-ai-in-legal-work\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">United Kingdom<\/a> and the <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/aug\/20\/wa-lawyer-referred-to-regulator-after-preparing-documents-with-ai-generated-case-citations-that-did-not-exist-ntwnfb\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">United States<\/a> have been fined for their use of artificial intelligence, those cases have not generally involved the prosecution. Researchers at the business school HEC Paris maintain a database of court cases that have included AI errors, according to the <a href=\"https:\/\/www.nytimes.com\/2025\/11\/25\/us\/prosecutor-artificial-intelligence-errors-lawyers-california.html\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Times<\/a>.
