The sentencing of a woman for the murder of her four-year-old stepson, who suffered injuries that would typically be associated with car crashes or serious assaults, has been adjourned to January.<\/p>\n
Murder carries a mandatory life sentence, but a statement from the child\u2019s mother was expected to form part of the sentencing hearing at the Central Criminal Court on Monday.<\/p>\n
Mr Justice Paul McDermott, having been told the child\u2019s mother is ill and is \u201cextremely anxious\u201d to be in court when sentence is imposed, agreed to adjourn the hearing to January 12th.<\/p>\n
The stepmother, aged in her 30s, cannot be identified as a result of a court order previously imposed to protect the identity of a child witness in the case.<\/p>\n
On Monday, Ronan Kennedy SC said he was appearing for The Irish Times, RT\u00c9 and Mediahuis, and wanted to address the court about the order preventing identification.<\/p>\n
The judge said he will deal with all matters on January 12th.<\/p>\n
The accused had pleaded not guilty to murder but guilty to manslaughter of the child at her home in March 2021 when her trial opened last month. <\/p>\n
On the fourth day of the trial, after evidence of the child witness was read into the record, the defence secured a brief adjournment after which the accused was re-arraigned and pleaded guilty to murder. <\/p>\n
When opening the trial, Anne Rowland SC, prosecuting, said the defendant told garda\u00ed about keeping her stepson in his room in the days prior to his death, where he had to sit on the floor and was only allowed out to go to the bathroom or for emergencies.<\/p>\n
The boy was a \u201cbold, cheeky child\u201d and often had to be grounded, the defendant told garda\u00ed. <\/p>\n
On the day the boy suffered fatal injuries, she said she \u201csnapped\u201d. She recalled \u201cshaking him and screaming at him to behave\u201d before he fell on the floor.<\/p>\n
State Pathologist Dr Heidi Okkers told the trial the cause of death was a traumatic head injury in association with blunt force trauma to the abdomen.<\/p>\n
The child\u2019s father was jailed for seven years in November 2024 after pleading guilty to endangerment, neglect and impeding the apprehension or prosecution of the stepmother, knowing or believing she had murdered his son.<\/p>\n
When sentencing him, Mr Justice McDermott described his actions as \u201cshameful\u201d and said he bore a high level of criminal responsibility for failing to nurture and protect his son.<\/p>\n
The father had called 999 on March 13th, 2021, claiming the boy had injured his head by falling off the top bunk of a bunk bed. He had put older injuries seen on the child down to falls and running into a door. <\/p>\n
An advanced paramedic noted \u201cyellowish\u201d bruising, suggesting older injuries, and a bump or haematoma on the back of the child\u2019s head and other indications of a significant head injury<\/p>\n
Dr Stephen O\u2019Riordan, who was asked to review the child\u2019s case after he was taken to hospital, said the \u201cwhole theatre gasped\u201d when they pulled back the drapes and saw the child covered in bruises.<\/p>\n
He documented 17 areas of bruising or injury to both eyes, the ears, arms, legs and back. The \u201cblack eyes,\u201d combined with bruises around both ears are \u201cclassic signs of physical abuse,\u201d he said. There were possible \u201cgrab marks\u201d on one shoulder and to the left elbow, multiple bruises on the back and chest and a \u201chugely extensive injury\u201d to the back of the head.<\/p>\n
A laceration to the boy\u2019s liver, Dr O\u2019Riordan said, would have been caused by \u201cextreme force\u201d and would normally be associated with a car crash.<\/p>\n
