Since then, he has been served with a tax demand for almost \u20ac800,000 by the <a href=\"https:\/\/www.irishtimes.com\/tags\/criminal-assets-bureau\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/criminal-assets-bureau\/\">Criminal Assets Bureau<\/a> and the <a href=\"https:\/\/www.irishtimes.com\/tags\/revenue-commissioners\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/revenue-commissioners\/\">Revenue Commissioners<\/a>. That means his tax affairs are no longer in order, though they were for many years.<\/p>\n<p class=\"c-paragraph paywall \">The Standards in Public Office Act 2001 legally obliges any new member of the Oireachtas to produce a tax clearance certificate on taking up a seat. However,<a href=\"https:\/\/www.irishtimes.com\/crime-law\/2025\/11\/29\/gerry-hutch-may-take-seat-if-he-wins-dublin-byelection-due-to-gap-in-td-tax-compliance-law\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/crime-law\/2025\/11\/29\/gerry-hutch-may-take-seat-if-he-wins-dublin-byelection-due-to-gap-in-td-tax-compliance-law\/\"> The Irish Times revealed at the weekend<\/a> that a lacuna in the law means Hutch\u2019s inability to produce a certificate would not stop him taking a D\u00e1il seat. <\/p>\n<p class=\"c-paragraph paywall \">There is no enforcement power or sanction in the legislation, which means while the Standards in Public Office Commission (Sipo) could investigate Hutch for being non-compliant, and draw up a report, it has no powers beyond that. The Department of Public Expenditure, Infrastructure, Public Service Reform and Digitalisation has confirmed there is no other legislation covering a non-tax compliant new TD.<\/p>\n<p class=\"c-paragraph paywall \">In reply to queries, the department said \u201cproposals to reform the legislative framework are currently being prepared by the Minister\u2019s department for consideration by the Government\u201d. It was unclear when Minister for Public Expenditure Jack Chambers will be presented with the proposals and whether they could be enacted in time for the Dublin Central byelection, due to take place around next April or May, to fill the seat of former minister for finance Paschal Donohoe.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/crime-law\/2025\/11\/29\/gerry-hutch-may-take-seat-if-he-wins-dublin-byelection-due-to-gap-in-td-tax-compliance-law\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Gerry Hutch can take seat if he wins Dublin byelection due to gap in TD tax compliance lawOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">Hutch ran in the constituency during the general election in November 2024, and came close to winning the fourth and final seat. He was beaten in transfers by Marie Sherlock TD (Labour).<\/p>\n<p class=\"c-paragraph paywall \">The department said the Ethics in Public Office Act 1995 \u2013 amended and supplemented by the Standards in Public Office Act 2001 \u2013 empowers members of the Oireachtas to sanction a colleague who Sipo finds \u201ccontravened their tax clearance obligations\u201d.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/crime-law\/2025\/11\/29\/candidate-hutch-why-cab-the-spanish-police-and-a-state-watchdog-cannot-stop-his-dail-run\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Candidate Hutch: Why Cab, the Spanish police and a State watchdog cannot stop his D\u00e1il runOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">The members could vote on a motion for \u201cthe suspension of the member for up to 30 sitting days\u201d. Furthermore, if Sipo or the Committee on Members\u2019 Interests is satisfied a tax-compliance contravention is ongoing \u201cthe suspension of the member until such time as they take specific steps to secure compliance\u201d.<\/p>\n<p class=\"c-paragraph paywall \">However, newly elected TDs cannot be blocked from taking up their seat if they are not tax compliant. And while they can be suspended from the D\u00e1il for their noncompliance, they cannot lose their seat.
