The sentencing of a man for the assault of a young woman at Letterkenny\u2019s Market Square has been adjourned to allow for a psychiatric report on the accused.<\/p>\n
Seamus Cooley appeared at Donegal Circuit Court by video link from Castlerea Prison for sentencing in the case.<\/p>\n
The 50-year-old is charged with assaulting Ms Shanan Reid McDaid and causing her harm on October 15, 2017 at Castle Street, Letterkenny.<\/p>\n
However, the court was told that an application was being sought to have the case adjourned to the February sitting of Letterkenny Circuit Court.<\/p>\n
Barrister for the state, Ms Fiona Crawford, BL, said the victim in the case had returned from Australia for three weeks during the last sitting of the court.<\/p>\n
However, the case had been adjourned at the behest of the defence who were seeking the benefit of a medical report before the sentencing.<\/p>\n
Barrister for Cooley, Mr Senan Crawford, BL, said his client had indicated that he wished to proceed with the matter in the absence of a psychiatric report.<\/p>\n
The court was told that this report will be available by the February sessions of the court.<\/p>\n
Judge John Aylmer said he will \u201cdeal with the matters as they arise\u201d adding that he knew the state is anxious to proceed with the matter.<\/p>\n
He remanded Cooley in custody under the next sitting of Letterkenny Circuit Court for sentencing.<\/p>\n
