An L.A. County Superior Court judge denied a mental health diversion program for a former\u00a0California Highway Patrol\u00a0officer arrested on suspicion of domestic violence and gun charges after more than one dozen\u00a0unserialized\u00a0firearms, or \u201cghost guns,\u201d were found in his Saugus home.\u00a0<\/p>\n
Brian Timothy Powers was scheduled to return\u00a0to court\u00a0Jan. 15, when his attorney and the prosecutor would meet for a pretrial conference, with a trial possible by the following week, pending schedule changes.\u00a0<\/p>\n
Powers pleaded not guilty in June to seven charges, including assault with a deadly weapon, false\u00a0imprisonment\u00a0and negligent discharge of a firearm.\u00a0<\/p>\n
Powers allegedly threatened his ex-wife, accusing her of costing him his job and his money, according to a witness statement referenced in a court order filed by Santa Clarita Valley Sheriff\u2019s\u00a0Station\u00a0detectives\u00a0seeking\u00a0to seize Powers\u2019 weapons.\u00a0\u00a0<\/p>\n
In denying the diversion attempt at an October hearing, Judge Kevin Rosenberg said he was trying to \u201csquare\u201d conflicting reports from mental health experts on both sides, according to the\u00a0hearing\u2019s\u00a0transcript.\u00a0<\/p>\n
Powers has since changed counsel, according to court records, but his former attorney said the defendant has made real progress and formed a community since his arrest.\u00a0<\/p>\n
Rosenberg expressed more concern over the weapons allegations and testimony\u00a0regarding\u00a0some threatening statements made in denying a mental health diversion\u00a0option.\u00a0<\/p>\n
