{"id":24066,"date":"2025-09-16T02:42:09","date_gmt":"2025-09-16T02:42:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/24066\/"},"modified":"2025-09-16T02:42:09","modified_gmt":"2025-09-16T02:42:09","slug":"worker-loses-challenge-to-sacking-in-english-bastard-remark-row-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/24066\/","title":{"rendered":"Worker loses challenge to sacking in \u2018English bastard\u2019 remark row \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A worker who said he only \u201clocked horns\u201d with a colleague because he was provoked by rebel music and being called a \u201cEnglish bastard\u201d has lost a challenge over his sacking. <\/p>\n<p class=\"c-paragraph paywall \">Management at Breffni Air Ireland Unlimited told the Workplace Relations Commission (WRC) that it decided to dismiss the worker, Timothy Seaton, after they said he \u201cheadbutted\u201d another worker on 7th March, 2022. <\/p>\n<p class=\"c-paragraph paywall \">Mr Seaton did not dispute initiating the assault, but denied the headbutt, and said he only gave his colleague \u201ca nudge\u201d he pleaded to be let keep his \u20ac585-a-week job in the aftermath of the incident, which saw both workers sacked, the WRC heard. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">His complaint under the Unfair Dismissals Act 1977 was not upheld in a decision published on Monday , following a series of hearings between November 2022 and January 2024. <\/p>\n<p class=\"c-paragraph paywall \">The company\u2019s production manager Gary Johnston said he had noticed Mr Seaton was \u201cagitated\u201d on the day of the incident, and was \u201cprovoked\u201d by the other worker moving into his work area and \u201cplunging his hammer into his work bench\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Mr Johnston told the tribunal he interviewed both workers for a company investigation. He said the other worker denied using the expression \u201cEnglish bastard\u201d, but accepted that he \u201cdid play rebel music\u201d in another part of the workshop. <\/p>\n<p class=\"c-paragraph paywall \">The witness said he \u201chadn\u2019t heard the rebel music being played\u201d, though he said there had been an investigation carried out when it was put to him it was mentioned in a witness statement. <\/p>\n<p class=\"c-paragraph paywall \">Mr Seaton walked into the other worker\u2019s area and they \u201cboth started fighting\u201d, Mr Johnston said. His evidence was that Mr Seaton \u201cheadbutted\u201d the other worker and followed that with a slap to the head before he was able to separate them. <\/p>\n<p class=\"c-paragraph paywall \">Mr Seaton was immediately suspended and both workers were sacked on foot of separate investigations, it was submitted on behalf of the business. <\/p>\n<p><img decoding=\"async\" alt=\"\" class=\"c-image audio_image\" src=\"https:\/\/www.newsbeep.com\/ie\/wp-content\/uploads\/2025\/09\/1754647931518-c07d65db-55b5-463e-ae51-976300c5837e.jpeg\"\/>What can we potentially look forward to in Budget 2026?<\/p>\n<p class=\"c-paragraph paywall \">The company\u2019s operations director David O\u2019Doherty said he decided to dismiss Mr Seaton after he \u201cadmitted to assault\u201d. <\/p>\n<p class=\"c-paragraph paywall \">The witness said he had to take the environment at the ventilation company\u2019s workshop into account, particularly \u201cthe risk of a future assault\u201d. He said it was a \u201chigh-risk\u201d environment where 30-40 men were at work with power tools, hammers and Stanley knives on hand. <\/p>\n<p class=\"c-paragraph paywall \">Mr Seaton said in his evidence to the WRC that the other worker was \u201cmouthing\u201d at him and told him \u201cYou f**king English bastard you are in my space now.\u201d <\/p>\n<p class=\"c-paragraph paywall \">He said he felt \u201ctotally threatened\u201d and \u201cprovoked\u201d, adding that the other worker \u201chad a hammer in his hand and was playing rebel music in the background when he approached\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Adjudicator Moya de Paor noted that Mr Seaton \u201cdenied that he headbutted\u201d the other worker but \u201cjust approached him quite closely and raised his arm to him\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Asked why he didn\u2019t report the man to his line manager, Mr Seaton said he was not thinking clearly at the time. <\/p>\n<p class=\"c-paragraph paywall \">\u201cIf I could turn the clock back, I would never have put myself in that situation,\u201d he said. He added that the other worker could have \u201csmashed [my] head in\u201d with the hammer. <\/p>\n<p class=\"c-paragraph paywall \">Mr Seaton stated in his complaint form: \u201cI did reach and nudged him, as identified in CCTV. We both locked horns, as I would describe and then one of my colleagues and line manager separated us.\u201d <\/p>\n<p class=\"c-paragraph paywall \">\u201c[I] was so upset that I allowed myself to be drawn into such behaviour, however it was, and still is, the only time I had encountered this bigotry,\u201d he added. <\/p>\n<p class=\"c-paragraph paywall \">He confirmed signing the investigation meeting minutes, but stated that they did not \u201calways reflect the reality of the meeting\u201d. <\/p>\n<p class=\"c-paragraph paywall \">His representative argued before the WRC that the company\u2019s investigation and disciplinary process was \u201ccompromised\u201d by fact Mr O\u2019Doherty was at both the investigation and disciplinary meetings, calling his ability to be impartial in the process into question. <\/p>\n<p class=\"c-paragraph paywall \">It was further submitted on behalf of Mr Seaton that the human resources (HR) officer who conducted the appeal was \u201cmore junior than Mr O\u2019Doherty\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Ms de Paor wrote in her decision that she could see Mr Seaton\u2019s difficulty with \u201cthe playing of Irish rebel music\u201d that he thought was \u201caimed at him\u201d, along with the alleged discriminatory remarks about his nationality. <\/p>\n<p class=\"c-paragraph paywall \">\u201cI can understand that the complainant felt threatened by the named employee on the day of the incident given his aggressive demeanour,\u201d she wrote. <\/p>\n<p class=\"c-paragraph paywall \">However, she wrote that as Mr Seaton had his line manager \u201cbeside him\u201d at the time, he could have gone to him instead of choosing to \u201cresolve the matter by way of physical violence\u201d. <\/p>\n<p class=\"c-paragraph paywall \">She noted that in his evidence, the complainant did not dispute that he initiated a serious physical assault.<\/p>\n<p class=\"c-paragraph paywall \">She wrote that Mr O\u2019Doherty should have had no role in the investigation process, and that someone more senior ought to have heard Mr Seaton\u2019s appeal. <\/p>\n<p class=\"c-paragraph paywall \">However, she wrote that she was required to weigh up \u201call the circumstances\u201d and concluded that the Mr Seaton\u2019s conduct in carrying out \u201ca serious physical assault which amounted to gross misconduct was the main and only reason for his dismissal\u201d. <\/p>\n<p class=\"c-paragraph paywall \">She ruled that his sacking was within the \u201cband of reasonable responses\u201d open to an employer in the circumstances, and dismissed his claim. <\/p>\n","protected":false},"excerpt":{"rendered":"A worker who said he only \u201clocked horns\u201d with a colleague because he was provoked by rebel music&hellip;\n","protected":false},"author":2,"featured_media":24067,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[2],"tags":[20646,61,60,43,20647,20648],"class_list":{"0":"post-24066","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-ireland","8":"tag-gender","9":"tag-ie","10":"tag-ireland","11":"tag-news","12":"tag-pay-gap","13":"tag-workplace-issue"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts\/24066","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/comments?post=24066"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts\/24066\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/media\/24067"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/media?parent=24066"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/categories?post=24066"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/tags?post=24066"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
