A man who drove a friend\u2019s car after concerns over the wellbeing of that person were raised by An Garda Siochana has been convicted of driving without insurance.<\/p>\n
Gerard McCauley was before Letterkenny District Court following an incident on December 28, 2025.<\/p>\n
Gardai stopped a vehicle in Lifford and spoke with the driver, McCauley, a 40-year-old of Drumdoit, Castlefin. <\/p>\n
Sergeant Jim Collins told the court that officers made a lawful demand for McCauley to produce a driving licence and insurance, but this was not complied with.<\/p>\n
Sergeant Collins said the accused man was \u201cquite compliant and cooperative\u201d with Gardai.<\/p>\n
Mr Rory O\u2019Brien, solicitor for McCauley, told the court that there was a \u201cslightly complicated set of facts\u201d in the matter, which provided \u201csignificant mitigation but not an excuse\u201d.<\/p>\n
Mr O\u2019Brien told the court: \u201cHe was telephoned by an Garda Siochana seeking the location and the whereabouts of a friend.\u201d<\/p>\n
Mr O\u2019Brien explained that McCauley had access to the other person\u2019s vehicle and \u201cin haste\u201d went to a property to see if he could locate them. <\/p>\n
\u201cGardai were present as they were looking for him,\u201d Mr O\u2019Brien added. \u201cIt was only in those circumstances that the vehicle was used.\u201d<\/p>\n
Sergeant Collins said he was not aware of this, but accepted what the solicitor had put forward.<\/p>\n
Judge Emile Daly noted that \u201cvery compelling circumstances\u201d had been outlined whereby the accused man had taken the car as a result of a plea.<\/p>\n
She said that penalty points will be imposed and a conviction will also affect McCauley\u2019s premium.<\/p>\n
Judge Daly said she would impose the \u201clowest penalty possible\u201d and fined McCauley \u20ac260 for driving without insurance. <\/p>\n
A charge of driving without a licence was taken into consideration.<\/p>\n
Legal aid was granted to Mr O\u2019Brien.<\/p>\n
