{"id":282228,"date":"2026-02-05T14:18:09","date_gmt":"2026-02-05T14:18:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/282228\/"},"modified":"2026-02-05T14:18:09","modified_gmt":"2026-02-05T14:18:09","slug":"with-ice-using-medicaid-data-hospitals-and-states-are-in-a-bind-over-warning-immigrant-patients","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/282228\/","title":{"rendered":"With ICE using Medicaid data, hospitals and states are in a bind over warning immigrant patients"},"content":{"rendered":"<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8e9yh9000x26qfbkas57p1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Trump administration\u2019s move to give deportation officials <a href=\"https:\/\/apnews.com\/article\/immigration-medicaid-trump-ice-ab9c2267ce596089410387bfcb40eeb7\" target=\"_blank\" rel=\"nofollow noopener\">access to Medicaid data<\/a> is putting hospitals and states in a bind as they weigh whether to alert immigrant patients that their personal information, including home addresses, could be used in efforts to remove them from the country.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh3400063b6sbog56cec@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Warning patients could deter them from signing up for a program called Emergency Medicaid, through which the <a href=\"https:\/\/kffhealthnews.org\/news\/medicaid-illegal-immigrant-emergency-care\/\" target=\"_blank\" rel=\"nofollow noopener\">government reimburses hospitals<\/a> for the cost of emergency treatment for immigrants who are ineligible for standard Medicaid coverage.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh3400073b6stpl38lyl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But if hospitals don\u2019t disclose that the patients\u2019 information is shared with federal law enforcement, they might not know that their medical coverage puts them at risk of being located by Immigration and Customs Enforcement.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh3400083b6s7sdyy8u1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIf hospitals tell people that their Emergency Medicaid information will be shared with ICE, it is foreseeable that many immigrants would simply stop getting emergency medical treatment,\u201d said <a href=\"https:\/\/ccf.georgetown.edu\/author\/leonardo-cuello\/\" target=\"_blank\" rel=\"nofollow noopener\">Leonardo Cuello<\/a>, a research professor at Georgetown University\u2019s Center for Children and Families. \u201cHalf of the Emergency Medicaid cases are for the delivery of U.S. citizen babies. Do we want these mothers avoiding the hospital when they go into labor?\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh3400093b6su7gwhqu8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            For more than a decade, hospitals and states have assured patients that their personal information, including their home addresses and immigration status, would not be shared with immigration enforcement officials when they apply for federal health care coverage. <a href=\"https:\/\/www.ice.gov\/doclib\/ero-outreach\/pdf\/ice-aca-memo.pdf\" target=\"_blank\" rel=\"nofollow noopener\">A 2013 ICE policy memo<\/a> guaranteed the agency would not use information from health coverage applications for enforcement activities.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000a3b6s153huai1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But that changed last year, after President Donald Trump returned to the White House and ordered one of the most aggressive immigration crackdowns in recent history. His administration began funneling data from a variety of government agencies to the Department of Homeland Security, including <a href=\"https:\/\/www.propublica.org\/article\/trump-irs-share-tax-records-ice-dhs-deportations\" target=\"_blank\" rel=\"nofollow noopener\">tax information<\/a> filed with the IRS.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000b3b6snggopu6c@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Centers for Medicare &amp; Medicaid Services, part of the Department of Health and Human Services, agreed last spring to give ICE officials direct access to a Medicaid database that includes enrollees\u2019 addresses and citizenship status.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000c3b6su4q932ub@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Twenty-two states, all but one led by Democratic governors, <a href=\"https:\/\/apnews.com\/article\/trump-medicaid-immigrant-california-161f7e1b9087512d674258f32f822878\" target=\"_blank\" rel=\"nofollow noopener\">sued to block<\/a> the Medicaid data-sharing agreement, which the administration did not formally announce until a federal judge ordered it to do so last summer. The judge <a href=\"https:\/\/apnews.com\/article\/medicaid-data-hhs-rfk-sharing-immigration-trump-30784ce01a403a16aca504980e4c7bc9\" target=\"_blank\" rel=\"nofollow noopener\">ruled in December<\/a> that in those states, ICE could access information in the Medicaid database only about people in the country unlawfully. KFF Health News contacted more than a dozen hospitals and hospital associations in states and cities that have been targets of ICE sweeps. Many declined to comment on whether they\u2019ve updated their disclosure policies after the ruling.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000d3b6s29gataq1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Of those that responded, none said they are directly warning patients that their personal information may be shared with ICE when they apply for Medicaid coverage.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000e3b6sbqh4eg5j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe do not provide legal advice about federal government data-sharing between agencies,\u201d Aimee Jordon, a spokesperson for M Health Fairview, a Minneapolis-based hospital system, said in an email to KFF Health News. \u201cWe encourage patients with questions about benefits or immigration-related concerns to seek guidance from appropriate state resources and qualified legal counsel.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000g3b6sotuc3e55@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Some states\u2019 Emergency Medicaid applications specifically ask for a patient\u2019s immigration status \u2014 and still assure people that their information will be kept secure and out of the hands of immigration enforcement officials.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000h3b6sz3l9d9ty@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            For example, as of Feb. 3, California\u2019s application still included language advising applicants that their immigration information is \u201cconfidential.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000i3b6sccm3huq6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe only use it to see if you qualify for health insurance,\u201d states the 44-page form, which the state\u2019s Medicaid program, known as Medi-Cal, <a href=\"https:\/\/www.instagram.com\/p\/DTlTg7xjdGl\/\" target=\"_blank\" rel=\"nofollow noopener\">posted on social media<\/a> in January.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000j3b6siu9v0v7r@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            California Department of Health Care Services spokesperson Anthony Cava said in a statement that the agency, which oversees Medi-Cal, will \u201censure that Californians have accurate information on the privacy of their data, including by revising additional publications as necessary.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000k3b6st3brbl1m@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Until late January, Utah\u2019s Medicaid website also claimed its Emergency Medicaid program did not share its information with immigration officials. After KFF Health News contacted the state agency, Kolbi Young, a spokesperson, said Jan. 23 that the language would be taken down immediately. It was removed that day.\n    <\/p>\n<p>       <img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ie\/wp-content\/uploads\/2026\/02\/gettyimages-2219519819.jpg\" alt=\"The Trump administration\u2019s efforts to deport immigrants living in the country illegally have had implications on immigrant families seeking care.\" class=\"image_large__dam-img image_large__dam-img--loading\" onload=\"this.classList.remove('image_large__dam-img--loading')\" onerror=\"imageLoadError(this)\" height=\"1333\" width=\"2000\" loading=\"lazy\"\/><\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000l3b6s09sp94ul@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Oregon Health &amp; Science University, a hospital system based in Portland, offers immigrant patients <a href=\"https:\/\/sharedsystems.dhsoha.state.or.us\/DHSForms\/Served\/le-1086100c.pdf\" target=\"_blank\" rel=\"nofollow noopener\">a Q&amp;A document<\/a> developed by the state Medicaid program for those with concerns about how their information might be used. The document does not directly say that Medicaid enrollees\u2019 information is shared with ICE officials.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000m3b6svdlvj8k5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Hospitals rely on Emergency Medicaid to reimburse them for treating people who would qualify for Medicaid if not for their citizenship status \u2014 those in the country illegally and lawfully present immigrants, such as those with a student or work visa. The coverage pays only for emergency medical and pregnancy care. Typically, hospital representatives help patients apply while they are still in the medical facility.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000n3b6s3gk6drxc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The main Medicaid program, which covers a much broader range of services for over 77 million low-income and disabled people, does not cover people living in the country illegally.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000o3b6sjc6yywow@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Examining Emergency Medicaid enrollment is the most obvious way, then, for deportation officials to identify immigrants, including those who might not reside in the U.S. lawfully.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000p3b6swbiqigsg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            HHS spokesperson Rich Danker said in an email that CMS \u2014 which oversees Medicaid, a joint state-federal program \u2014 is sharing data with ICE after the judge\u2019s ruling. But he would not answer how the agency is ensuring it is sharing information only on people who are not lawfully present, as the judge required.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000q3b6sqsxc3kt9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            With ICE now getting direct access to the personal information of millions of Medicaid enrollees, hospitals \u2014 while \u201cdefinitely in a tough position\u201d \u2014 should be up-front about the changes, said Sarah Grusin, <a href=\"https:\/\/healthlaw.org\/team\/sarah-grusin\/\" target=\"_blank\" rel=\"nofollow noopener\">an attorney<\/a> at the National Health Law Program, an advocacy group.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000r3b6sh9e07ncc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThey need to be telling people that the judge has permitted sharing of information, including their address, for people who are not lawfully residing,\u201d she said. \u201cOnce this information is submitted, you can\u2019t protect it from disclosure at this point.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000s3b6sevon23kc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Grusin said she advises families to weigh the importance of seeking medical care against the risk of having their information shared with ICE.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000t3b6s0yjs4rtu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe want to give candid, honest information even if it means the decision people have to make is really hard,\u201d she said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000u3b6sfq2cr8xf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Those who have previously enrolled in Medicaid or can easily search their address online should assume that immigration officials already have their information, she added.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000w3b6sq5c8lv12@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Emergency Medicaid coverage was established in the mid-1980s, when a federal law began requiring hospitals to treat and stabilize all patients who show up at their doors with a life-threatening condition.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000x3b6szuqqlxc7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Federal government spending on Emergency Medicaid accounted for nearly $4 billion in 2023, or <a href=\"https:\/\/www.kff.org\/racial-equity-and-health-policy\/5-key-facts-about-immigrants-and-medicaid\/#:~:text=3.,in%20FY%202023:%20$860%20Billion\" target=\"_blank\" rel=\"nofollow noopener\">about 0.4%<\/a> of total federal spending on Medicaid.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000y3b6skoi244mj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            States send monthly reports to the federal government with detailed information about who enrolls in Medicaid and what services they receive. The judge\u2019s ruling in December limited what CMS can share with ICE to only basic information, including addresses, about Medicaid enrollees in the 22 states that sued over the data-sharing arrangement. ICE officials are not supposed to access information about the medical services people receive, per the judge\u2019s order.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh34000z3b6sfztuxv40@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The judge also prohibited the agency from sharing the data of U.S. citizens or lawfully present immigrants from those states.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh3400103b6sdoxzng54@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Deportation officials have access to personal Medicaid information of all enrollees in the remaining 28 states.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh3400113b6sk8gzimrd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The federal health agency has not clarified how it is ensuring that certain states\u2019 information on citizens and legal residents is not shared with ICE. But Medicaid experts say it would be nearly impossible for the agency to separate the data, raising questions about whether the Trump administration is complying with the judge\u2019s order.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cml8ebh3400123b6sqkc11rb4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Trump administration\u2019s efforts to deport immigrants living in the country illegally have had implications on immigrant families seeking care. About a third of adult immigrants reported skipping or postponing health care in the past year, according to a <a href=\"https:\/\/www.kff.org\/immigrant-health\/kff-new-york-times-2025-survey-of-immigrants-health-and-health-care-experiences-during-the-second-trump-administration\/\" target=\"_blank\" rel=\"nofollow noopener\">KFF\/New York Times poll<\/a> released in November.
