{"id":293711,"date":"2026-02-12T06:25:11","date_gmt":"2026-02-12T06:25:11","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/293711\/"},"modified":"2026-02-12T06:25:11","modified_gmt":"2026-02-12T06:25:11","slug":"lawyer-complains-about-hearing-delays-in-case-over-e6m-apartments-alleged-heating-defects-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/293711\/","title":{"rendered":"Lawyer complains about hearing delays in case over \u20ac6m apartment\u2019s alleged heating defects \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A lawyer opposing a <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\">High Court<\/a> action over alleged defects in the heating system in a \u20ac6 million penthouse apartment has complained about the delay in getting the case to hearing. <\/p>\n<p class=\"c-paragraph paywall \">The case concerns claims by businesswoman Aideen O\u2019Byrne that the apartment she paid more than \u20ac6 million for at Lansdowne Place, Ballsbridge, Dublin 4 has endured temperatures of up to 33 degrees due to an alleged failure to maintain or repair the district heating system. <\/p>\n<p class=\"c-paragraph paywall \">She first issued proceedings against the developer, Copper Bridge C 2015 ICAV, and against O\u2019Connor Sutton Cronin and Associates Ltd, for alleged breach of contract, negligence and breach of duty, including by failing to repair\/maintain the heating system and common areas. The Lansdowne Place apartment owners\u2019 management company was later joined as a third defendant.<\/p>\n<p class=\"c-paragraph paywall \">On Wednesday, barrister Fiona Forde, for O\u2019Byrne, said her client was to issue an amended statement of claim. She wanted the matter to be case-managed.<\/p>\n<p class=\"c-paragraph paywall \">Paul Gallagher, counsel for O\u2019Connor Sutton Cronin, said the amended statement was supposed to have been issued a year ago and he had \u201cnever encountered\u201d anything like this. <\/p>\n<p class=\"c-paragraph paywall \">He said his client was concerned that when they receive the amended statement, the nature of the claim might have changed completely. \u201cWe have not been told about it until today and it is as though they [the O\u2019Byrne side] don\u2019t know what they are at,\u201d he said. <\/p>\n<p class=\"c-paragraph paywall \">The proceedings had been issued five years ago, he said, and yet the O\u2019Byrne side \u201cdon\u2019t know what claim to make\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Hugh O\u2019Keeffe, counsel for Copper Bridge, said his side had been looking for the amended statement and wanted the case expedited. <\/p>\n<p class=\"c-paragraph paywall \">Judge Brian Cregan said he had been minded to have a monthly case-management of the matter because it was clearly of some complexity. Nothing can happen until the amended statement of claim is filed, he said.<\/p>\n<p class=\"c-paragraph paywall \">He gave directions for the issuing of papers and made the case returnable to the end of April. <\/p>\n<p class=\"c-paragraph paywall \">Last year, O\u2019Byrne got an interim order preventing the developer from transferring its beneficial interest in the apartment buildings and common areas to the owners\u2019 management company until problems are resolved. <\/p>\n<p class=\"c-paragraph paywall \">O\u2019Byrne has said, in an affidavit, that in 2017 she agreed to pay some \u20ac6.5 million off the plans for the penthouse, with a construction period of two years. The price was ultimately reduced by \u20ac335,000, and she moved in in 2021. <\/p>\n<p class=\"c-paragraph paywall \">She said the developer maintained the apartments were of the highest standard and her property was publicised by agents as \u201cthought to be the most expensive apartment sold in Ireland\u201d at the time.<\/p>\n<p class=\"c-paragraph paywall \">However, she said she did not receive full value for the price paid due to issues including the internal temperature frequently making occupation uncomfortable and \u201coccasionally unbearable\u201d.<\/p>\n<p class=\"c-paragraph paywall \">An expert report found that during summer 2024, which was of moderate\/below average temperatures, there was a threshold internal temperature  in the apartment of 33.4 degrees.  That is well above acceptable temperatures, including those recommended by the World Health Organisation.<\/p>\n<p class=\"c-paragraph paywall \">She said the owners\u2019 management company was aware of the problem, and a report was provided in 2021 showing lobby areas were consistently showing temperatures of 29 degrees.<\/p>\n<p class=\"c-paragraph paywall \">The report recommended, among other things, \u201cdoor hold open\u201d devices and the opening of high-level stair ventilators, while  the operating temperatures of the district heating system were also reduced. <\/p>\n<p class=\"c-paragraph paywall \">O\u2019Byrne said the opening of the automatic vents on her roof garden was  a security risk, visual eyesore and noise nuisance. <\/p>\n<p class=\"c-paragraph paywall \">In February 2025, the management company said a report had been sent to the developer with certain recommendations in relation to heating in the lobby areas and was \u201cin hand\u201d.<\/p>\n","protected":false},"excerpt":{"rendered":"A lawyer opposing a High Court action over alleged defects in the heating system in a \u20ac6 million&hellip;\n","protected":false},"author":2,"featured_media":293712,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[2],"tags":[4506,73,61,60,43],"class_list":{"0":"post-293711","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-ireland","8":"tag-dublin-4","9":"tag-high-court","10":"tag-ie","11":"tag-ireland","12":"tag-news"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts\/293711","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/comments?post=293711"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts\/293711\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/media\/293712"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/media?parent=293711"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/categories?post=293711"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/tags?post=293711"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
