{"id":294178,"date":"2026-02-12T12:30:07","date_gmt":"2026-02-12T12:30:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/294178\/"},"modified":"2026-02-12T12:30:07","modified_gmt":"2026-02-12T12:30:07","slug":"eu-top-courts-adviser-says-passenger-cap-may-be-taken-into-account-on-dublin-airport-slots-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/294178\/","title":{"rendered":"EU top court\u2019s adviser says passenger cap \u2018may be taken into account\u2019 on Dublin Airport slots \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">The 32 million passenger cap at <a href=\"https:\/\/www.irishtimes.com\/tags\/dublin-airport\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dublin-airport\/\">Dublin Airport<\/a> is legally sound, an adviser to <a href=\"https:\/\/www.irishtimes.com\/tags\/european-court-of-justice\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/european-court-of-justice\/\">Europe\u2019s top court<\/a> has said, raising pressure on Minister for Transport <a href=\"https:\/\/www.irishtimes.com\/tags\/darragh-obrien\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/darragh-obrien\/\">Darragh O\u2019Brien<\/a> to enact new laws to eliminate the restriction. <\/p>\n<p class=\"c-paragraph paywall \"> In an opinion handed down on Thursday at Court of Justice of the European Union (ECJ) in Luxembourg, advocate general Manuel Campos S\u00e1nchez-Bordona said an annual passenger limit imposed by planners may be taken into account when allocating airport slots.<\/p>\n<p class=\"c-paragraph paywall \">\u201cIn his view, compliance with the limit of 32 million passengers a year can be classified as one of the operating constraints,\u201d the court said. <\/p>\n<p class=\"c-paragraph paywall \">The opinion comes days after O\u2019Brien secured Cabinet agreement to prepare legislation to scrap the cap, a move that comes after two successive years in which State airport operator <a href=\"https:\/\/www.irishtimes.com\/tags\/daa\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/daa\/\">DAA <\/a>has breached the restriction. <\/p>\n<p class=\"c-paragraph paywall \">Enforcement action was suspended for two years last April pending litigation.<\/p>\n<p class=\"c-paragraph paywall \">S\u00e1nchez-Bordona hands down advisory opinions to the European court. Although the advocate general\u2019s opinions are not binding on the court, they are influential and are often followed by the judges in their formal rulings. The ruling in this case is expected within months. <\/p>\n<p class=\"c-paragraph paywall \">The Minister promised to have legislation enacted by the end of this year to remove the cap altogether. Airlines have pressed him to move faster because they fear losing airport slots to comply with the cap.<\/p>\n<p class=\"c-paragraph paywall \">The legal challenge against the cap was initiated in the High Court in Dublin by <a href=\"https:\/\/www.irishtimes.com\/tags\/ryanair\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/ryanair\/\">Ryanair<\/a>, <a href=\"https:\/\/www.irishtimes.com\/tags\/aer-lingus\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/aer-lingus\/\">Aer Lingus<\/a> and the <a href=\"https:\/\/www.irishtimes.com\/tags\/airlines-for-america\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/airlines-for-america\/\">Airlines for America<\/a> trade body. The Irish court sent questions relating to European regulations on airport slots to the Luxembourg court.<\/p>\n<p class=\"c-paragraph paywall \">The advisory opinion said the technical, operational or environmental factors affecting airport capacity are not only physical or material factors, but also the legal constraints imposed by the rules which affect the airport\u2019s use.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThe fact that the constraint in question comes from a State planning authority does not mean that it ceases to be an operational constraint. What is decisive is that it restricts airport \u2018operational capacity\u2019,\u201d said the court. <\/p>\n<p class=\"c-paragraph paywall \">\u201cIt is therefore a relevant factor for the objective analysis of the possibilities of accommodating the air traffic.\u201d<\/p>\n<p class=\"c-paragraph paywall \">The opinion went on to say historical slots were not property rights, but authorisation to use airport infrastructure.
