{"id":296819,"date":"2026-02-14T00:04:07","date_gmt":"2026-02-14T00:04:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/296819\/"},"modified":"2026-02-14T00:04:07","modified_gmt":"2026-02-14T00:04:07","slug":"irish-rail-claims-outbuilding-of-home-backing-on-to-dart-line-caused-embankment-slip-in-malahide-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/296819\/","title":{"rendered":"Irish Rail claims outbuilding of home backing on to Dart line caused embankment slip in Malahide \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \"><a href=\"https:\/\/www.irishtimes.com\/tags\/iarnrod-eireann\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/iarnrod-eireann\/\">Iarnr\u00f3d \u00c9ireann<\/a> is seeking a <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\">High Court<\/a> injunction against the owners of a house who have allegedly built an outbuilding backing on to a rail line which, due to run-off from the recent heavy rainfall, caused the collapse of an embankment and the temporary closure of the <a href=\"https:\/\/www.irishtimes.com\/tags\/dart\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dart\/\">Dart<\/a> line in <a href=\"https:\/\/www.irishtimes.com\/tags\/malahide\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/malahide\/\">Malahide<\/a>, Co Dublin.<\/p>\n<p class=\"c-paragraph paywall \">Iarnr\u00f3d Eireann and C\u00f3ras Iompair \u00c9ireann (<a href=\"https:\/\/www.irishtimes.com\/tags\/cie\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/cie\/\">CI\u00c9<\/a>) claim Kieran Brady and Virginia Synnott had the outbuilding constructed to \u201ca very significant extent\u201d on CI\u00c9-owned land behind their property at Ashleigh Lawn, Malahide.<\/p>\n<p class=\"c-paragraph paywall \">On Friday, Judge Brian Cregan granted barrister Raymond Delahunt, for Irish Rail and CI\u00c9, permission to serve the proceedings on Brady and Synnott with short notice.<\/p>\n<p class=\"c-paragraph paywall \">Delahunt told the judge there had been correspondence with the defendants\u2019 solicitor, who replied that the land belonged to them and that there was some negligence on the transport companies\u2019 part. They refused to give undertakings to remove the outbuilding and reinstate the boundary line with the rail lands, the court heard. <\/p>\n<p class=\"c-paragraph paywall \">Counsel said there were serious concerns, given the continuing inclement weather, for the operation of the Dart and for public safety. <\/p>\n<p class=\"c-paragraph paywall \">The judge said the case could come back next week. <\/p>\n<p class=\"c-paragraph paywall \">Irish Rail chartered engineer David Gannon said in an sworn statement that the large outbuilding structure was made of concrete blocks and the surcharge of water run-off from it on the crest of the embankment caused its failure on or about January 29th last. <\/p>\n<p class=\"c-paragraph paywall \">This soil slip led to the closure of the Dart line for a short time while it was cleared.
