{"id":304440,"date":"2026-02-18T15:27:09","date_gmt":"2026-02-18T15:27:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/304440\/"},"modified":"2026-02-18T15:27:09","modified_gmt":"2026-02-18T15:27:09","slug":"deaf-man-denied-job-interview-wins-e40000-in-ruling-against-national-council-for-special-education-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/304440\/","title":{"rendered":"Deaf man denied job interview wins \u20ac40,000 in ruling against National Council for Special Education \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">The State body overseeing special education for adults and children with <a href=\"https:\/\/www.irishtimes.com\/tags\/disability\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/disability\/\">disabilities<\/a> has been ordered to pay \u20ac40,000 in compensation to a deaf man for denying him a job interview because he lacked an academic qualification in Irish Sign Language.<\/p>\n<p class=\"c-paragraph paywall \">The <a href=\"https:\/\/www.irishtimes.com\/tags\/national-council-for-special-education\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/national-council-for-special-education\/\">National Council for Special Education<\/a> was ruled to have indirectly discriminated against the job applicant, Noel O\u2019Connell, in breach of the Employment Equality Act 1998, when it turned down his application for a post as \u201cadviser deaf\/hard of hearing\u201d in April 2022.<\/p>\n<p class=\"c-paragraph paywall \">In a significant development, the tribunal decided to set aside the \u20ac13,000 cap on compensation in an employment access case set out in Irish equality law. <\/p>\n<p class=\"c-paragraph paywall \">Michael Kinsley, appearing instructed by Sinead Lucey of the Free Legal Advice Centre (Flac), said their client was \u201cwell qualified\u201d for the job in view of the fact that he was fluent in Irish Sign Language (ISL) and holds a PhD in deaf education.<\/p>\n<p class=\"c-paragraph paywall \">O\u2019Connell\u2019s first language was ISL, as he had been deaf since childhood and does not communicate orally, the tribunal was told.<\/p>\n<p class=\"c-paragraph paywall \">The following month, he was told his application for the job \u201chad not been shortlisted\u201d. When he asked why, the NCSE told him the only reason was that he \u201cdid not have an academic qualification in ISL\u201d,  Kinsley said.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThe [assessment] board determined that the criteria was specific in wanting a formal qualification in ISL and that you had failed to demonstrate in your application that you meet this requirement,\u201d a human resources officer wrote.<\/p>\n<p class=\"c-paragraph paywall \">O\u2019Connell then sought a formal review of this decision under the code of practice for public service appointments. He argued that making a sign language qualification an essential requirement of the post was \u201cwrong\u201d because it \u201ceffectively excludes deaf people\u201d.<\/p>\n<p class=\"c-paragraph paywall \">The relevant clause in the job specification required \u201ca qualification in ISL based on the common European language framework or equivalent\u201d, the tribunal heard.<\/p>\n<p class=\"c-paragraph paywall \">When a more senior civil servant at the NCSE looked at O\u2019Connell\u2019s complaint, she read the words \u201cor equivalent\u201d as \u201cmeaning an ISL qualification or equivalent\u201d rather than an \u201cequivalent qualification\u201d.<\/p>\n<p class=\"c-paragraph paywall \">On that basis, the senior official decided O\u2019Connell did meet the requirements, acknowledging his status as a native user of ISL and additional experience met the requirement in the candidate handbook.<\/p>\n<p class=\"c-paragraph paywall \">Overruling the assessment board, the senior official declared the rejection of his application \u201cnot upheld in this case\u201d, the <a href=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\">Workplace Relations Commission<\/a> heard. By then, the recruitment competition was closed. <\/p>\n<p class=\"c-paragraph paywall \">Mary-Paula Guinnness, instructed by Eversheds Sutherland for the NCSE, said in a legal submission that the senior civil servant\u2019s decision was \u201cfundamentally flawed\u201d. <\/p>\n<p class=\"c-paragraph paywall \">\u201cA formal qualification in Irish Sign Language can be achieved by a deaf or a hearing person and therefore it is simply incorrect to assert &#8230; that it \u2018effectively excludes deaf people\u2019,\u201d Guinness said.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThere is clear, objective justification for the qualifications required for the role, and therefore there is no discrimination,\u201d  Guinness added.<\/p>\n<p class=\"c-paragraph paywall \">Kinsley said the requirement for a formal academic qualification in Irish Sign Language was a condition that disadvantaged deaf applicants \u201cdisproportionately\u201d and was indirect discrimination.<\/p>\n<p class=\"c-paragraph paywall \">Adjudicator Jim Dolan ruled in favour of  O\u2019Connell\u2019s complaint and wrote: \u201cI believe the respondent\u2019s actions amount to indirect discrimination against the complainant.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Dolan noted submissions from the NCSE that there was a \u20ac13,000 cap on compensation for an employment-access case under Ireland\u2019s domestic equality law.<\/p>\n<p class=\"c-paragraph paywall \">The complainant side had cited the requirement for \u201ceffective, proportionate and dissuasive\u201d compensation set out in European law.<\/p>\n<p class=\"c-paragraph paywall \">Setting aside the domestic legislation,  Dolan awarded \u20ac40,000 for the breach. <\/p>\n<p class=\"c-paragraph paywall \">O\u2019Connell thanked FLAC and welcomed the outcome of the case in a statement on Wednesday.<\/p>\n<p class=\"c-paragraph paywall \">\u201cI hope that this case will prompt all employers to reflect on their recruitment practices and policies and to ensure that they are compliant with the rights of people with disabilities,\u201d he remarked.<\/p>\n","protected":false},"excerpt":{"rendered":"The State body overseeing special education for adults and children with disabilities has been ordered to pay \u20ac40,000&hellip;\n","protected":false},"author":2,"featured_media":149931,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[3],"tags":[420,42,143637,43,40,38,41,39],"class_list":{"0":"post-304440","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-headlines","8":"tag-disability","9":"tag-headlines","10":"tag-national-council-for-special-education","11":"tag-news","12":"tag-top-news","13":"tag-top-stories","14":"tag-topnews","15":"tag-topstories"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts\/304440","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/comments?post=304440"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts\/304440\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/media\/149931"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/media?parent=304440"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/categories?post=304440"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/tags?post=304440"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
