{"id":333360,"date":"2026-03-07T06:40:17","date_gmt":"2026-03-07T06:40:17","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/333360\/"},"modified":"2026-03-07T06:40:17","modified_gmt":"2026-03-07T06:40:17","slug":"misclassification-of-family-members-a-common-issue-in-prsi-cases-pac-hears-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/333360\/","title":{"rendered":"Misclassification of family members a common issue in PRSI cases, PAC hears \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">The bulk of the money recovered by the Department of Social Protection\u2019s Employment Status Investigation Unit (ESIU) last year came from the misclassification of family members rather than those who were falsely described as self-employed the D\u00e1il\u2019s Committee of Public Accounts has been told.<\/p>\n<p class=\"c-paragraph paywall \">Secretary general at the Department of Social Protection, John McKeon, told the committee\u2019s members the ESIU had recovered \u20ac3.4 million in unpaid social insurance contributions last year after examining the employment status more than 3,000 individuals but fewer than 1 per cent involved a reclassification of the individual from Class S, the category covering the majority of self-employed workers, to Class A, the category covering the majority of people in regular paid employment for a private enterprise.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/business\/2026\/03\/05\/revenue-could-collect-27m-in-taxes-flowing-from-gig-economy-ruling\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Revenue could collect nearly \u20ac27m in taxes via gig economy rulingOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">Far more common, he suggested, was the reclassification of family members from Class M, a zero PRSI rate intended to cover, among other things, family members employed in work associated with the family home, to Class A. These cases, he said, generated the vast majority of the \u20ac3.4 million figure.<\/p>\n<p class=\"c-paragraph paywall \">\u201cI\u2019d say the biggest issue we have, and it definitely doesn\u2019t get a lot of attention, is Class M. Class M is a zero rated PRSI rate and is meant to be used in cases of what\u2019s known as subsidiary employment or prescribed relatives in family businesses. <\/p>\n<p class=\"c-paragraph paywall \">\u201cThe law says that if you\u2019re a prescribed relative of somebody who is self-employed \u2013 a sibling, child, a parent or a grandparent \u2013 if you\u2019re a prescribed relative and you\u2019re working in a family business associated with the home, you do not pay social insurance. <\/p>\n<p class=\"c-paragraph paywall \">\u201cHowever, if you\u2019re a relative, and, for example, you\u2019re working as part of your father\u2019s law firm, or you\u2019re working as part of your father\u2019s\u2019 pub, that\u2019s not associated with the home and you should be paying Class S insurance. <\/p>\n<p class=\"c-paragraph paywall \">\u201cAnd what we find is that the highest level of misclassification is people on Class M, who should be Class A.<\/p>\n<p class=\"c-paragraph paywall \">\u201cIn terms of what the ESIU did, we looked at 3,262 workers. There were 25 of those reclassified from Class S to class A. Most of the others were people in Class M.
