A man kicked his neighbour in the back and hit him over the head with a fencepost after a dispute over a right-of-way, Killarney District Court has heard.<\/p>\n
Kevin O\u2019Connor (33) of Cleady Cross, Gortaglass, Kenmare pleaded guilty to assault and production of a firearm capable of injury, identified as \u2018an agricultural implement\u2019.<\/p>\n
The court heard that just before 6pm on July 18, 2024, a dispute arose at Tahilla, Kenmare over a right-of-access through a property that Mr O\u2019Connor could access.<\/p>\n
\u201cThere wasn\u2019t really an issue until there was,\u201d said Sergeant Stephen O\u2019Brien.<\/p>\n
The court heard he kicked his neighbour in the back, \u201cdragged him along a laneway\u201d and \u201chit him with a fencepost\u201d that happened to be nearby.<\/p>\n
\u201cIt shouldn\u2019t have gone as far as it did,\u201d said the sergeant.<\/p>\n
Solicitor for the defence*, P\u00e1draig O\u2019Connell, noted his client had accepted full responsibility and had no previous convictions.<\/p>\n
\u201cThere\u2019s been issues and dispute about the victim impact,\u201d he told the judge. \u201cI\u2019m not happy with a lot of it but I think you\u2019ll see through it.\u201d<\/p>\n
He noted there were allegations both neighbours had used cameras. <\/p>\n
\u201cIt\u2019s a novel situation when neighbours are in court, and highly regrettable,\u201d said the solicitor.<\/p>\n
His client had dealt with the dispute in \u201can unacceptable way\u201d, he said. He added, \u201cHe will never be found here again.\u201d<\/p>\n
Judge David Waters fined Mr O\u2019Connor \u20ac500 each for the two charges.<\/p>\n
\u201cThis man decided to take the law into his own hands and use a weapon,\u201d said Judge David Waters. \u201cI suspect he\u2019s sorry it happened because he\u2019s found himself in the position that he\u2019s in.\u201d<\/p>\n
