A man accused of assaulting another man on St Patrick\u2019s Day by allegedly stamping on his head as he lay unconscious on a street, told garda\u00ed the victim stabbed him first, a court heard Thursday.<\/p>\n
Darren Mason (22), St Munchin\u2019s Street, St Mary\u2019s Park, Limerick, told garda\u00ed he was acting in \u201cself-defence\u201d on the night, Limerick District Court heard.<\/p>\n
Mason was charged in court with assault causing harm to Liam Higgins, (55), at Athlunkard Street, Limerick City, on last Tuesday, March 17th.<\/p>\n
Mason, originally from Rhebogue, Limerick, and living in Grove Island, Corbally, was also charged with violent disorder and with producing an article, namely a traffic bollard, capable of inflicting serious injury during the course of a dispute, at the same location on the same date.<\/p>\n
CCTV footage<\/p>\n
Opposing bail, Detective Garda Aoife Keane, Mayorstone Station, told the court that in interviews with gardai following his arrest, Mason \u201cidentified himself\u201d in CCTV footage of the alleged attack, located outside Radcliffe\u2019s Pub, Athlunkard Street, on the night.<\/p>\n
Detective Garda Keane said the CCTV footage shows Mason initially approached from behind by Higgins, who was not known to him and Higgins,who was allegedly armed with two knives, stabbing Mason.<\/p>\n
Detective Garda Keane said the footage also showed Higgins throwing a traffic bollard in the direction of Mason as Mason and others approach him on the street.<\/p>\n
The garda witness said the footage shows Mason and others throwing traffic bollards in the direction of Higgins.<\/p>\n
The CCTV footage, which was played in court, shows an unidentified male throwing a traffic bollard at Higgins, striking him on his head and knocking him to the ground.<\/p>\n
Another unidentified male is then seen on the footage kicking Higgins in the head as he lies on the ground motionless.<\/p>\n
The footage then showed a man identified as Mason stamping his foot on Higgins\u2019 head as Higgins remains motionless on the street.<\/p>\n
Another unidentified male is also seen on the footage slamming a traffic bollard onto Higgins\u2019 head.<\/p>\n
The footage then allegedly shows Mason approaching Higgins, who remains motionless, and leaning down towards him before being led away by two females.<\/p>\n
Detective Garda Keane said a number of other persons were being sought by gardai for questioning about the events.<\/p>\n
Detective Garda Keane agreed with Mason\u2019s solicitor, John Herbert, that Higgins was identified on the CCTV footage allegedly stabbing Mr Mason initially.<\/p>\n
Detective Garda Keane agreed with Herbert that Mason told garda\u00ed following his arrest that Higgins, who he did not know, was \u201ctaunting\u201d him prior to stabbing him.<\/p>\n
Detective Garda Keane said Mason received stitches in hospital afterwards for two stab wounds, as well as a slash wound to one of his arms.<\/p>\n
Herbert said the accused has worked as a block-layer and has a partner and two young children.<\/p>\n
Herbert argued that Higgins was \u201cresponsible for the beginning\u201d of the alleged events on the night, not Mr Mason\u201d.<\/p>\n
Prosecuting Inspector Liam Wallace said he accepted that while Higgins may have initially posed a threat to Mason, he posed \u201cno risk\u201d to the accused or anyone else while his head was being stamped on as he lay unconscious on the street after being struck by a bollard.<\/p>\n
Bail<\/p>\n
Detective Garda Keane objected to bail and told the court it was her belief that Mason would commit offences while on bail, not abide by any bail conditions, and intimidate witnesses.<\/p>\n
Detective Keane said the CCTV footage from the night was of \u201cexcellent quality\u201d.<\/p>\n
Judge Patricia Harney said Mason was, like all accused persons before a court, entitled to the presumption of innocence until proven otherwise.<\/p>\n
The judge said she was satisfied having heard the evidence of Detective Keane, to refuse bail.<\/p>\n
The judge remanded Mr Mason in custody to appear before Limerick District Court again on March 24th, for further directions from the Director of Public Prosecutions.<\/p>\n
As Mason was appearing in court garda\u00ed arrested two men as part of the ongoing investigation.<\/p>\n
