Dublin<\/a>, for a \u201cpeaceful and voluntary handover\u201d.<\/p>\nContrary to allegations made by tenant Muhammad Amjad, no \u201cforceful removal\u201d occurred, Khan said, adding he \u201cdid not hold a hammer\u201d or \u201cany other object in hand from entry to exit\u201d. <\/p>\n
The court heard Amjad stands over his claims, and Judge Brian Cregan noted the pictures painted by the opposing sides were \u201csharply divergent\u201d.<\/p>\n
Amjad, represented by RNL Solicitors, alleged Khan arrived at the rental property accompanied by eight others and carrying a hammer. He alleged Khan issued \u201cexplicit threats to strike me if I did not vacate within three minutes\u201d. He said his children were \u201cvisibly traumatised\u201d after witnessing the incident and the family could not regain access. <\/p>\n
Amjad said Khan and IMK Property had issued a purported notice of termination, but he was advised it was invalid.<\/p>\n
After hearing Amjad\u2019s allegations earlier this month, Cregan granted him temporary orders restraining Khan or IMK Property from interfering with the family\u2019s quiet enjoyment of the premises. He ordered the landlord to facilitate their re-entry to the home.<\/p>\n
Khan and IMK Property on Tuesday told the court Amjad\u2019s claims were \u201cextremely serious and entirely untrue\u201d, causing \u201cconsiderable stress and reputational damage\u201d. <\/p>\n
In a sworn statement to the court, Khan alleged no incident was reported to garda\u00ed about the events of February 28th. He claimed an inspection on behalf of Fingal County Council in February 2025 found the property was not compliant with regulations, and needed a gas safety check and carbon monoxide and smoke alarms installed. <\/p>\n
The property needed to be vacated so works could be safely carried out, and IMK Property determined the tenancy should be terminated due to the \u201cextensive nature\u201d of the repairs, he said.<\/p>\n
He said the tenants were properly served with notice of lease termination and there was no \u201ccoercive or intimidatory campaign\u201d as alleged by Amjad. The family had agreed the property could be handed over on February 28th, Khan claimed, adding Amjad was not \u201ccoerced\u201d into sending a message confirming this. <\/p>\n
Khan denied an unlawful eviction occurred because new rental laws were due to come into force two days later.<\/p>\n
He said the case must be viewed in light of the plaintiff\u2019s lawyers, RNL Solicitors, operating in substantially the same client pool as his company, IMK Law. He said he fears RNL\u2019s \u201czeal\u201d has \u201ctainted\u201d the proceedings.<\/p>\n
Khan\u2019s barrister, Alan Cormack, said his client\u2019s primary concern has been the \u201csafety and welfare\u201d of Amjad\u2019s children and other residents of the complex.<\/p>\n
David O\u2019Brien, counsel for Amjad, said Khan\u2019s version of events is \u201cnot accepted . . . by any stretch\u201d.<\/p>\n
The case returns in mid-April when a date is expected to be scheduled for the court to hear Amjad\u2019s application for longer-term orders.
