{"id":367042,"date":"2026-03-26T23:54:14","date_gmt":"2026-03-26T23:54:14","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/367042\/"},"modified":"2026-03-26T23:54:14","modified_gmt":"2026-03-26T23:54:14","slug":"we-know-it-wasnt-an-accident-says-family-of-cork-man-who-died-after-incident-in-nightclub","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/367042\/","title":{"rendered":"&#8216;We know it wasn&#8217;t an accident,&#8217; says family of Cork man who died after incident in nightclub"},"content":{"rendered":"<p>The family of a Cork man who suffocated to death while being restrained in a Cork City nightclub is appealing for his case to be re\u2011examined on the 25th anniversary of his death.<\/p>\n<p>Adrian Moynihan was 23 when he died at Sidetrax nightclub on March 26, 2001.<\/p>\n<p class=\"\">An inquest in 2003 found he died from asphyxiation caused by the manner in which he was restrained. Dr Marie Cassidy, the former State pathologist told the inquest his neck had been compressed; he had been held face\u2011down, restricting his ability to breathe; and his arms were held behind his back, limiting the expansion of his chest as he attempted to breathe.<\/p>\n<p class=\"\">Bruises and abrasions on Adrian&#8217;s neck, chest, arms, and legs were also noted at the autopsy \u2014 but the bouncers involved in restraining Adrian denied kicking, beating, or biting him.<\/p>\n<p class=\"\">Garda\u00ed called to his parents\u2019 home on the morning of March 26, 2001. \u201cThey woke up to garda\u00ed saying, \u2018you need to get ready and come to the hospital straightaway\u2019. They didn&#8217;t know that was happening,\u201d Adrian&#8217;s brother Alan tells the  Irish Examiner.<\/p>\n<p class=\"\">He and his brother were called to identify the body in hospital. \u201cWe could see wounds, marks, and bruising. There were lumps and bumps all over. There were marks around his neck. I noticed one part of his chest was higher than the other.&#8221;<\/p>\n<p class=\"contextmenu caption\">Final moments<\/p>\n<p class=\"\">CCTV footage captured some of the final moments of Adrian\u2019s life. He had arrived at the nightclub with a friend who was refused entry. After a brief exchange, Adrian lashed out at one of the bouncers. Picture: Provision\/RTE\u00a0<\/p>\n<p class=\"\">When garda\u00ed arrived minutes later, they saw Mr Moynihan was unwell and called an ambulance. They believe a finding of unlawful killing should now be considered \u2014 an option that was not available under the coroner system when the inquest was held in 2003.<\/p>\n<p class=\"\">\u201cWe&#8217;re not happy with the results of the original inquest, which states that Adrian died from a misadventure, implying that it was an accident. Picture: Provision<\/p>\n<p class=\"\">The family met with justice minister Jim O\u2019Callaghan at the end of January about the death of the apprentice mason, from Ballyvolane in Cork City.<\/p>\n<p class=\"\">\u201cHe listened but said that he couldn\u2019t do anything because the DPP and the Coroner\u2019s Court are independent bodies.<\/p>\n<p class=\"\">\u201cHe told us if we wanted to do something we\u2019d have to go through the Attorney General.&#8221;<\/p>\n<p class=\"\">The family has written to the Attorney General requesting that Adrian&#8217;s case be re-examined.\u00a0<\/p>\n<p class=\"\">The family believe excessive force at Sidetrax, located on Grafton Street between Oliver Plunkett Street and the South Mall, resulted in Adrian\u2019s death that night.\u00a0<\/p>\n<p class=\"\">The family is also dissatisfied with the way garda\u00ed conducted the investigation at the time, he said.\u00a0<\/p>\n<p class=\"\">They have written to Fiosr\u00fa, the Garda ombudsman, asking it to open an investigation. Although Fiosr\u00fa declined to do so, the family has appealed.<\/p>\n<p class=\"\">\u201cWe&#8217;ve been banging on closed doors.
