So why was Toulon flanker Charles Ollivon deemed to be legal when he was off his feet and made the tackle that ended the Stormers\u2019 Investec Champions Cup campaign?<\/p>\n<p>We take a look at the nuances in the lawbook that led to referee Christophe Ridley\u2019s decision and why his choice of words for the final call of the game made all the difference.<\/p>\n<p>The Nonu tackle<\/p>\n<p>Before we get stuck into the final play of the game, we take a look at the incident that allowed the <a href=\"https:\/\/www.planetrugby.com\/team\/stormers\" rel=\"nofollow noopener\" target=\"_blank\">Stormers<\/a> access to <a href=\"https:\/\/www.planetrugby.com\/tournament\/top-14\" rel=\"nofollow noopener\" target=\"_blank\">Toulon\u2019s<\/a> half of the pitch, Ma\u2019a Nonu\u2019s tackle on Wandisile Simelane.<\/p>\n<p>The former All Blacks midfield was always upright and charged into making the hit on Simelane, who stepped just before Toulon fly-half Tomas Albornoz made contact. Nonu came from the side that Simelane stepped towards before making head-on-head contact with the replacement back.<\/p>\n<p>That step from the Stormer and the tackle from Albornoz were enough mitigation for the officials to issue Nonu a yellow card instead of a red.<\/p>\n<p>\u201cIt is head contact, and it is foul play because he is upright. A bit of time is taken away from him to adjust because of the second tackler. So that mitigates it down to a yellow card for us,\u201d Ridley explained after convening with his officiating team.<\/p>\n<p>It\u2019s worth noting that the TMO Bunker is not currently in play for the <a href=\"https:\/\/www.planetrugby.com\/tournament\/rugby-champions-cup\" rel=\"nofollow noopener\" target=\"_blank\">Champions Cup<\/a> and hasn\u2019t been throughout the season. Therefore, the decision was left to the referee, his assistants, and the TMO, with no Foul Play Review Officer appointed.<\/p>\n<p>Ultimately, the citing commissioner and subsequently, a disciplinary panel, disagreed with the officiating team\u2019s decision that a yellow card was warranted, with Nonu now banned for Toulon.<\/p>\n<p class=\"px-3 xs:px-4 mt-3 mb-2 font-semibold leading-snug text-base text-title\"><a href=\"https:\/\/www.planetrugby.com\/news\/sale-sharks-leinster-challenge-could-get-even-tougher-after-alleged-bite-while-maa-nonu-also-in-the-dock\" rel=\"nofollow noopener\" target=\"_blank\">Sale Sharks\u2019 Leinster challenge could get even tougher after \u2018alleged bite\u2019 while Ma\u2019a Nonu also in the dock<\/a><\/p>\n<p>On this occasion, it mattered little that the ex-All Black was yellow-carded instead of being permanently sent off, as there was just a minute and 19 seconds left on the clock when he departed proceedings. However, had the game gone well beyond the allotted 80 minutes, then Toulon could have erronously been back to 15 men.<\/p>\n<p>Nonu\u2019s indiscretion did allow Sacha Feinberg-Mngomezulu the opportunity to punt the Stormers into a threatening position and the Springboks fly-half did not waste it, finding touch on the Toulon 22-metre line.<\/p>\n<p>After an extended period of possession, JD Schickerling makes a great carry near the Toulon five-metre line but is dragged down just short. The Stormers then turn to their pick and drive tactics to get them over the line.<\/p>\n<p>Ollivon\u2019s actions<\/p>\n<p>It is at this point where the controversy starts as Toulon flanker <a href=\"https:\/\/www.planetrugby.com\/tag\/charles-ollivon\" rel=\"nofollow noopener\" target=\"_blank\">Charles Ollivon<\/a> drops onto one knee in anticipation of the next carry. At the same time, his fellow back-rower Mikheili Shioshvili rolls out of the ruck and is still on the Stormers\u2019 side of the ruck when Marcel Theunissen has a dig at the line. Theunissen makes a grazing contact on Shioshvili before he is seemingly held up by Ollivon.<\/p>\n<p>Former Springboks head coach Nick Mallett was left fuming by this as the Stormers were ultimately denied the try by the officials, as he believed that both Shioshvili and Ollivon were illegal.<\/p>\n<p><a href=\"https:\/\/twitter.com\/hashtag\/RugbyScoop?src=hash&amp;ref_src=twsrc%5Etfw\" rel=\"nofollow noopener\" target=\"_blank\">#RugbyScoop<\/a> |<\/p>\n<p>Stormers\u2019 rugby IQ was not the best on Saturday.<\/p>\n<p>This should be viewed as the biggest rugby fumble ever. He [Ridley] was on completely the wrong side of the ruck, and he said I thought two hands were under it, how could he say that if he didn\u2019t even see the guy go over for the try?\u201d he said on SuperSport.<\/p>\n<p>\u201cAdded to that, Ollivon is lying on the ground, he says that he is in the in-goal area. If you are off your feet, you are not allowed to play; you can\u2019t tackle anyone or play the ball.\u201d<\/p>\n<p class=\"my-1 text-sm font-semibold leading-snug text-title line-clamp-3 sm:mb-0 sm:text-[15px] sm:leading-5 sm:line-clamp-2\"><a href=\"https:\/\/www.planetrugby.com\/news\/ex-springboks-coach-fumes-over-dreadful-referee-decisions-in-stormers-champions-cup-defeat\" rel=\"nofollow noopener\" target=\"_blank\">Ex-Springboks coach fumes over \u2018dreadful\u2019 referee decisions in Stormers\u2019 Champions Cup defeat<\/a><\/p>\n<p>So let\u2019s address that last point of Mallett\u2019s that Ollivon is not allowed to make a tackle and see what the lawbook states.<\/p>\n<p>Law 13 addresses \u2018Players on the ground in open play\u2019 with the principle of the law reading: \u201cThe game is played only by players who are on their feet.\u201d<\/p>\n<p>Law 13.3 adds: A player on the ground in the field of play, without the ball is out of the game and must:<br \/>a.\u00a0Allow opponents who are not on the ground to play or gain possession of the ball. Sanction: Penalty<br \/>b.\u00a0Not play the ball. Sanction: Penalty<br \/>c.\u00a0Not tackle or attempt to tackle an opponent. Sanction: Penalty<\/p>\n<p>A player is defined as being on their feet \u2018if no other part of their body is supported by the ground or players on the ground\u2019 and off their feet \u2018when any other part of the body is supported by the ground or players on the ground.\u2019<\/p>\n<p class=\"px-3 xs:px-4 mt-3 mb-2 font-semibold leading-snug text-base text-title\"><a href=\"https:\/\/www.planetrugby.com\/news\/sergio-parisse-exclusive-why-its-the-optimal-time-for-me-to-join-italys-coaching-team-before-the-world-cup\" rel=\"nofollow noopener\" target=\"_blank\">Sergio Parisse exclusive: Why it\u2019s the \u2018optimal\u2019 time for me to join Italy\u2019s coaching team before the World Cup<\/a><\/p>\n<p>So when looking at this image of Ollivon, he is very clearly off his feet as per the definitions above.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"ps-lazy-img alignnone size-large wp-image-1500917\" width=\"1600\" height=\"900\" src=\"https:\/\/www.newsbeep.com\/ie\/wp-content\/uploads\/2026\/04\/Charles-Ollivon-1024x576.jpg\" alt=\"\"\/><\/p>\n<p>In-goal v in the field of play<\/p>\n<p>But referee Ridley correctly explains why his actions were not penalisable and perfectly legal.<\/p>\n<p>\u201cHe is in-goal, though, he can do that in goal,\u201d Ridley told a Stormers captain, Ruhan Nel.<\/p>\n<p>\u201cThe actions of seven are absolutely fine, no issues with that.\u201d<\/p>\n<p>Ollivon being deemed \u2018in-goal\u2019 is crucial as because of 13.3 which again states \u2018A player on the ground in the field of play, without the ball is out of the game\u2026\u2019<\/p>\n<p>The first illustration on the image below, via World Rugby\u2019s website, shows what is deemed to be in the field of play and the one below it the in-goal are.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"ps-lazy-img alignnone size-large wp-image-1500920\" width=\"1600\" height=\"900\" src=\"https:\/\/www.newsbeep.com\/ie\/wp-content\/uploads\/2026\/04\/World-Rugby-playing-enclosure-1-1024x714.jpg\" alt=\"\"\/><\/p>\n<p>Simply put, Ollivon is not required to be on his feet \u2018in-goal\u2019 like he is in the \u2018field of play\u2019. So the flanker was perfectly legal in crouching down onto one knee before making the tackle and showed an astute understanding of the laws when doing so.<\/p>\n<p>As for Toulon number eight, Shioshvili, Ridley judged that \u2018he has no impact\u2019 on the Stormers\u2019 attack when he rolls out of the tackle area.<\/p>\n<p>Theunissen made glancing contact with the loose forward, leaving the officials with a two questions to answer as per law 10.4 a: Does he make an effort to retreat? And does he interfere with play?<\/p>\n<p>The answer to the first question is yes, he is still attempting to move into an onside position when the carry is made. The answer to the second question is no, according to Ridley. Many will try and debate that call but ultimately, the Stormers ball carrier still progressed forward, Shioshvili doesn\u2019t choose to make contact with the player, the carrier bounces him off and carries on and therefore, it\u2019s easy to see why the officiating team deemed that he didn\u2019t have an influence.<\/p>\n<p class=\"px-3 xs:px-4 mt-3 mb-2 font-semibold leading-snug text-base text-title\"><a href=\"https:\/\/www.planetrugby.com\/news\/rugby-transfers-bulls-could-lose-springboks-snub-without-help-all-blacks-bruiser-to-boost-world-cup-bid-and-stormers-want-to-keep-malherbe\" rel=\"nofollow noopener\" target=\"_blank\">Rugby Transfers: Bulls could lose Springboks snub without help, All Blacks bruiser to boost World Cup bid and Stormers want to keep Malherbe<\/a><\/p>\n<p>Stormers\u2019 gripe<\/p>\n<p>The one gripe that the Stormers could have with the final passage of play is the question that Ridley asked TMO Ian Tempest when he referred the decision.<\/p>\n<p>\u201cMy on-field decision is hands under the ball and holding up but we\u2019d like to check because it\u2019s a big decision,\u201d he said.<\/p>\n<p>\u201cSo on-field decision is no try,\u201d Tempest said, seeking clarity.<\/p>\n<p>\u201cOn-field decision is no try,\u201d Ridley confirmed.<\/p>\n<p>The official made this call despite being on the other side of the ruck than the carry occurred and needed to run in between players before arriving at the tackle area, by which stage the tackle was completed.<\/p>\n<p>Want more from Planet Rugby? Add us as <a rel=\"noopener nofollow\" href=\"https:\/\/www.google.com\/preferences\/source?q=planetrugby.com\" target=\"_blank\">a preferred source on Google to your favourites list<\/a> for world-class coverage you can trust.<\/p>\n<p>But by making the call of \u2018no try\u2019, the TMO needed to find compelling evidence of a grounding to overturn Ridley\u2019s on-field decision.<\/p>\n<p>Speaking after the match, Stormers boss John Dobson said that his team was \u2018very unlucky\u2019 with that final decision but conceded that they didn\u2019t make it easy for the officials either.<\/p>\n<p>\u201cThe guy scored the try, but it wasn\u2019t the right circumstance to allow the referee to award it,\u201d he said.<\/p>\n<p>\u201cOur player grounded the ball and I believe him, but it\u2019s not the referee\u2019s fault, he couldn\u2019t see that.\u201d<\/p>\n<p class=\"my-1 text-sm font-semibold leading-snug text-title line-clamp-3 sm:mb-0 sm:text-[15px] sm:leading-5 sm:line-clamp-2\"><a href=\"https:\/\/www.planetrugby.com\/news\/sacha-feinberg-mngomezulu-opens-up-on-late-decision-that-allowed-best-flank-around-to-break-stormers-hearts1\" rel=\"nofollow noopener\" target=\"_blank\">Sacha Feinberg-Mngomezulu opens up on late decision that allowed \u2018best flank around\u2019 to break Stormers hearts<\/a><\/p>\n<p>Can the Stormers feel aggrieved?<\/p>\n<p>As Dobson said above, the Stormers did not make the final decision easy for the officials and considering that Toulon were down to 15 men, they had several other options at their disposal to get the winning points.<\/p>\n<p>A drop goal was certainly on the cards and there was space to exploit on either side of the final ruck if they took the braver option of spreading the ball wider. Both those options come with their own risks but so does the safer route which could bring the officials into the game more, and it did.<\/p>\n<p>In the 72nd minute, though, they were unlucky not to be awarded a penalty try after Matthias Halagahu clearly collapsed a threatening Stormers maul. When he did so, the Stormers were barely a metre away from the tryline and Ridley deemed that the replacement\u2019s actions warranted a yellow card but not a penalty try.<\/p>\n<p>\u201cI actually wondered whether it\u2019d be a penalty try,\u201d former Ulster back Darren Cave remarked on commentary.<\/p>\n<p>\u201cIt looked like it was sealing over and deliberately brought down.\u201d<\/p>\n<p>From the ensuing lineout, the Stormers\u2019 maul was held up, but this time legally by Dany Priso.
