\u201cJust because people are from Israel doesn\u2019t mean they\u2019ve malicious intent,\u201d he said.<\/p>\n
He said he responded to say \u201cshut them off completely\u201d because it was \u201cstandard operating procedure if you see something like an anomaly, you contain and isolate\u201d.<\/p>\n
Counsel for the respondent, Mary-Paula Guinness BL, appearing instructed by Byrne Wallace put it to him that \u00d3 Laoi said the CEO had been \u201cvery angry\u201d on a conference call the following day.<\/p>\n
\u201cI was upset because I was told we had a cybersecurity breach. Obviously this was an error, retrospectively, it was an error,\u201d he said.<\/p>\n
The matter was examined by his fellow co-founder, Rahim Jina, whom he said was highly experienced in digital forensics, and by his chief technology officer, Eoin Mooney.<\/p>\n
\u201c[They] are very skilled operators as well. They couldn\u2019t find any evidence of any breach,\u201d he said.<\/p>\n
On the 3 July 2024 call, Keary said \u00d3 Laoi expressed the view that DoIT was \u201ca mass social engineering experiment hiding behind Google and AWS certifications and was \u201cmasquerading as a real company but they\u2019re actually Israeli military\u201d.<\/p>\n
\u201cWe had to take issue with, one, that anybody from Israel is a bad person, and, if you follow that chain of thought, you have to accept that accusing people based on their nationality or their hereditary, it\u2019s borderline, well it is, xenophobia,\u201d he said.<\/p>\n
Keary went on to say: \u201cI did not want other staff members in my business to feel uncomfortable because we had an anti-Semite in our midst.\u201d<\/p>\n
\u00d3 Laoi told the WRC he did not believe what he said was \u201cinappropriate\u201d and that any mention of Israel was \u201cin relation to the supply chain risk of Unit 8200\u201d, an Israeli military intelligence unit.<\/p>\n
Keary and Jina told the WRC in their evidence this week they had never heard of Israel\u2019s Unit 8200 before \u00d3 Laoi brought it up in July 2024.<\/p>\n
In an email of 20 September 2024 to Keary, \u00d3 Laoi said he was considering taking a case to the WRC, and sought an apology in writing, the reimbursement of legal fees, and \u201cfair compensation\u201d of \u20ac10,000 which he said he would donate to aid agency UNWRA.<\/p>\n
Keary said the email convinced him \u00d3 Laoi was \u201can insider threat to the business\u201d and ordered his access shut off.<\/p>\n
\u201cIt was a shakedown, in my view, we were being blackmailed,\u201d Keary said. \u201cThe apology could have been arranged, there could have been a kumbaya, but he went nuclear,\u201d Mr Keary said.<\/p>\n
\u00d3 Laoi quit the following month.<\/p>\n
Counsel for the complainant, Cillian McGovern BL, appearing instructed by Crushell & Co Solicitors, put it to the CEO in cross-examination that there were statements in correspondence to his client contradicting the firm\u2019s position that no breach took place.<\/p>\n
\u201cYou said the incident was a \u2018bad joke\u2019; the [chief financial officer] said the access was \u2018excessive\u2019,\u201d McGovern said. \u201cI said it was a \u2018bad joke\u2019; what I meant was the absurdity of accusing a company like DoIT because they have some Israeli founders that they\u2019re part of the IDF military complex and the whole company is a social engineering experiment, what Cian said to me, that\u2019s a bad joke \u2013 that\u2019s James Bond stuff,\u201d Keary said.<\/p>\n
Adjudicator Penelope McGrath said it seemed to her from the wording of Keary\u2019s email that it was \u201cthe level of access given to DoIT was a bad joke\u201d.<\/p>\n
\u201cI\u2019ve told you what I meant. What I said is this whole thing is a bad joke, this third party access issue is a bad joke. The fact we\u2019re being accused of being hacked by Mossad,\u201d Keary said.<\/p>\n
\u201cThere\u2019s nothing in there that suggests that,\u201d McGrath said.<\/p>\n
\u201cI wrote it,\u201d the CEO said.<\/p>\n
\u201cEverything Mr Keary put into his evidence-in-chief was a PR spin. He sought to smear Mr \u00d3 Laoi,\u201d McGovern later said. <\/p>\n
Edgescan\u2019s chief operating officer, Mr Jina, said \u201cany kind of breach or hack\u201d would leave behind \u201cartefacts\u201d but that he investigated personally and found \u201cnothing suspicious at all\u201d.<\/p>\n
\u201cI did ask Cian to several times to provide me with any evidence of a breach … everything came back to the fact they were Israeli \u2013 as if being Israeli was the evidence,\u201d Jina said. \u201c[It was] not just his language, but his tone was completely unprofessional, completely inappropriate. I\u2019m going to have to imitate, it was also the way he said \u2018Israeli\u2019, like with proper venom,\u201d Jina of the conference call on 3 July.<\/p>\n
He accepted Edgescan failed to adhere to its own disciplinary policy when he gave \u00d3 Laoi a formal reprimand in September 2024 for \u201cdiscriminatory conduct … specifically in relation to comments on Israel\u201d. <\/p>\n
The company\u2019s chief security architect, Eoin Mooney, said the arrangement with DoIT in May 2023 was a \u201cvery effective way\u201d to cut its cloud hosting bill with Amazon Web Services (AWS). The level of access was the industry practice at the time, he said.<\/p>\n
