{"id":409938,"date":"2026-04-21T11:51:08","date_gmt":"2026-04-21T11:51:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/409938\/"},"modified":"2026-04-21T11:51:08","modified_gmt":"2026-04-21T11:51:08","slug":"back-garden-modular-homes-set-to-be-exempt-from-planning-rules-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/409938\/","title":{"rendered":"Back garden modular homes set to be exempt from planning rules \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">Proposals to <a href=\"https:\/\/www.irishtimes.com\/politics\/2025\/02\/19\/government-preparing-move-to-relax-planning-rules-on-cabins-and-modular-homes-in-back-gardens\/\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/politics\/2025\/02\/19\/government-preparing-move-to-relax-planning-rules-on-cabins-and-modular-homes-in-back-gardens\/\" target=\"_blank\">exempt modular homes in back gardens from planning permission<\/a> are expected to be approved by Cabinet when it meets at Government Buildings this morning.<\/p>\n<p class=\"c-paragraph paywall \">The plans, first mooted last year, have been criticised by some planning experts but the Government insists that they can make a contribution to easing the <a href=\"https:\/\/www.irishtimes.com\/tags\/housing-crisis\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/housing-crisis\/\">housing crisis<\/a> by supplying a new class of accommodation quickly.<\/p>\n<p class=\"c-paragraph paywall \">The planning exemptions for modular homes in back gardens will be subject to some requirements, including the size of the garden \u2013 at least 25sq m (269sq ft) \u2013 and meeting building standards. Only owner occupiers will be allowed to construct such homes, while separate entrances and a minimum distance between the modular home and the main house will also be required.<\/p>\n<p class=\"c-paragraph paywall \">Significantly, it is planned that <a href=\"https:\/\/www.irishtimes.com\/ireland\/housing-planning\/2026\/04\/02\/agreement-in-principle-on-plan-to-allow-tax-free-rental-of-back-garden-cabins\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/ireland\/housing-planning\/2026\/04\/02\/agreement-in-principle-on-plan-to-allow-tax-free-rental-of-back-garden-cabins\/\">the rent-a-room tax exemption will be extended to the back garden homes<\/a> \u2013 meaning that the owner of the principal house will be able to charge rent of up to \u20ac14,000 a year tax free.<\/p>\n<p class=\"c-paragraph paywall \">On his way into Government Buildings for this morning\u2019s Cabinet meeting, T\u00e1naiste and Minister for Finance <a href=\"https:\/\/www.irishtimes.com\/tags\/simon-harris\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/simon-harris\/\">Simon Harris<\/a> said the plan would be a \u201cpositive\u201d measure.<\/p>\n<p class=\"c-paragraph paywall \">\u201cI think it\u2019s important that we take the planner out of the back garden, and that we enable planners to be freed up to work on critical infrastructure, to work on major housing developments, and provide people in this country with a degree of flexibility around what they choose to do with their own garden,\u201d he said.<\/p>\n<p class=\"c-paragraph paywall \">\u201cObviously, they\u2019ve got to operate within regulations, building standards and the likes, but I think this is a positive measure in a housing emergency, but also I think it\u2019s a positive planning reform measure too.\u201d<\/p>\n<p class=\"c-paragraph paywall \">He added: \u201cThere is a housing emergency, and we have to, and I believe this instinctively, we have to remove bureaucracy and administration and red tape and make it as easy as possible for people to be able to have homes, have shelters, use their own garden space as well.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/ireland\/housing-planning\/2026\/04\/02\/agreement-in-principle-on-plan-to-allow-tax-free-rental-of-back-garden-cabins\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Agreement in principle on plan to allow tax-free rental of back garden cabinsOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">\u201cBut it is also important we look at this and keep it under tight review. So built into the proposal today will be a review within 18 months and I think that is important.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Taoiseach Miche\u00e1l Martin said there were \u201cvery serious challenges in housing\u201d, including in the provision of rental accommodation.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThis is just an added layer of potential supply to the market, which is very, very important,\u201d he said at Government Buildings. \u201cWe have to pull out all the stops to deal with housing because the younger generation need access, and anything that takes pressure off the rental market is a positive in my view.<\/p>\n<p class=\"c-paragraph paywall \">\u201cI think there\u2019s a broader conversation about rental protections and tenancy protections for people who are in a licensed agreement outside the traditional tenancy agreement. That\u2019s not a reason not to go ahead with this and people have been waiting a long time for this.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Speaking on the way into Cabinet on Tuesday morning, Minister for Housing James Browne said the proposal would be reviewed within 18 months.<\/p>\n<p class=\"c-paragraph paywall \">Asked about whether there were figures on how many units they expected to be built under this exemption, Mr Browne said: \u201cIt\u2019s about simplification, it\u2019s not about trying to extrapolate how many there\u2019s going to be.\u201d<\/p>\n<p class=\"c-paragraph paywall \">He said the units would not be included in the Government\u2019s yearly housing figures.<\/p>\n<p class=\"c-paragraph paywall \"><a href=\"https:\/\/www.irishtimes.com\/tags\/sinn-fein\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/sinn-fein\/\">Sinn F\u00e9in<\/a> housing spokesman Eoin \u00d3 Broin criticised the plan. <\/p>\n<p class=\"c-paragraph paywall \">He said that the plans were \u201cpotentially very problematic\u201d, and pointed out that when the plans were first suggested last year, it was intended that the back garden units would be for family members only.
