{"id":412200,"date":"2026-04-22T18:56:08","date_gmt":"2026-04-22T18:56:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/412200\/"},"modified":"2026-04-22T18:56:08","modified_gmt":"2026-04-22T18:56:08","slug":"department-must-pay-e30000-to-visually-impaired-employee-over-protracted-discrimination-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/412200\/","title":{"rendered":"Department must pay \u20ac30,000 to visually impaired employee over \u2018protracted\u2019 discrimination \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A visually impaired man was left \u201chumiliated and exhausted\u201d while experiencing \u201cprotracted\u201d discrimination by his employer, the <a href=\"https:\/\/www.irishtimes.com\/tags\/department-of-social-protection\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/department-of-social-protection\">Department of Social Protection<\/a>, which has been ordered to pay him \u20ac30,000. <\/p>\n<p class=\"c-paragraph paywall \">Paul Hill, who has worked at the department as an assistant principal officer since 2012, was \u201cnot provided with reasonable accommodation\u201d for 12 years by his employer, and \u201cthis constitutes discrimination\u201d, the <a href=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\">Workplace Relations Commission<\/a> said in a ruling published on Wednesday.<\/p>\n<p class=\"c-paragraph paywall \">Hill, whose visual impairment developed when he was 16, can experience significant glare and light sensitivity, which can cause difficulty seeing his work as well as eye strain, headaches and fatigue. This impairment is a disability within the meaning of the Employment Equality Act 1998, the WRC said.<\/p>\n<p class=\"c-paragraph paywall \">The failure to provide reasonable accommodations left Hill unable to participate in training, having to work at weekends to complete tasks because of problems with technology and taking annual leave when he could not access his laptop. <\/p>\n<p class=\"c-paragraph paywall \">He was told by the department\u2019s IT section that his assistive-technology requirements were \u201coutside the norm\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Among the reasonable accommodations he needs are ZoomText, which enhances and magnifies text on screens, screen equipment, suitable office lighting and access to work and training materials in advance of meetings. <\/p>\n<p class=\"c-paragraph paywall \">The WRC\u2019s decision on his claim details extensive efforts made by Hill from 2012 to access the accommodations he was entitled. <\/p>\n<p class=\"c-paragraph paywall \">His situation was recognised by senior officials, with a 2014 email from the department\u2019s then deputy secretary general quoted in the ruling. Its subject line says: \u201cPaul Hill: Disability access \u2013 PC and laptop issues\u201d and the official tells three senior colleagues: \u201cFolks, this is just terrible on a number of levels.\u201d<\/p>\n<p class=\"c-paragraph paywall \">She asks: \u201cAny views on what we should put in place &amp; where &amp; how?\u201d Noting the department had 7,000 employees, she said \u201cwe must have a variety of different scenarios\u201d and that improved processes needed to be implemented. <\/p>\n<p class=\"c-paragraph paywall \">Additional barriers to Hill included glare through windows due to inadequate blinds, lack of control over office lighting and problems with office lay-out. None of these had been adequately addressed by 2023 when, supported by the Association of Higher Civil and Public Servants (AHCPS), Hill lodged a complaint at the WRC under the Employment Equality Acts.<\/p>\n<p class=\"c-paragraph paywall \">He told the WRC he had strived not be defined by his disability within the workplace, but had \u201cbeen left feeling humiliated and exhausted\u201d.<\/p>\n<p class=\"c-paragraph paywall \">During adjudication, the WRC suggested a reasonable accommodation working group be established to look at Hill\u2019s needs. A number of measures were implemented as a result, including the provision of hand-held digital magnifiers; provision of RG Bluetooth headsets; Zoomtext 2024 installed on his laptop; and touchscreen monitors installed on his office desk. A new learning and disability accessibility policy has been put in place. <\/p>\n<p class=\"c-paragraph paywall \">Welcoming the ruling, Hill said: \u201cI have spent more than 12 years seeking relatively straightforward supports to allow me to do my job. <\/p>\n<p class=\"c-paragraph paywall \">\u201cThese are not complex or excessive measures, but basic adjustments that should have been in place from the beginning. While I welcome the outcome, it is difficult to reflect on the impact of having to fight for so long to have such rights recognised and upheld.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Paul Malone, AHCPS deputy general secretary, said the ruling sent \u201ca clear and unambiguous message to employers across the civil and public service\u201d that providing reasonable accommodation for staff with disabilities is not optional. <\/p>\n<p class=\"c-paragraph paywall \">\u201cIt is a legal and moral imperative,\u201d he said, adding that Hill had pursued his rights \u201cwith courage and determination\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Liam Herrick, chief commissioner with the Irish Human Rights and Equality Commission, which supported Hill at the WRC, said it was deeply concerning that it took more than a decade for these issues to be formally recognised and addressed. <\/p>\n<p class=\"c-paragraph paywall \">\u201cWorkplace discrimination of this nature is unacceptable.
