{"id":415783,"date":"2026-04-24T20:37:14","date_gmt":"2026-04-24T20:37:14","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/415783\/"},"modified":"2026-04-24T20:37:14","modified_gmt":"2026-04-24T20:37:14","slug":"leak-by-mandate-general-secretary-scuppered-e1m-deal-for-debenhams-staff-official-claims-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/415783\/","title":{"rendered":"Leak by Mandate general secretary scuppered \u20ac1m deal for Debenhams staff, official claims \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A former official at the <a href=\"https:\/\/www.irishtimes.com\/tags\/mandate\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/mandate\/\">Mandate<\/a> trade union claims a leak to the media by its then general secretary sank a secret deal to pay more than \u20ac1 million to former <a href=\"https:\/\/www.irishtimes.com\/tags\/debenhams\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/debenhams\/\">Debenhams<\/a> staff, who were \u201cwrongly blamed\u201d for the collapse of the proposal, <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\">High Court<\/a> papers show.<\/p>\n<p class=\"c-paragraph paywall \">Details of the allegation, made by former Mandate press officer Dave Gibney, are contained in legal papers filed in a separate dispute before the High Court on Friday.<\/p>\n<p class=\"c-paragraph paywall \">In an April 2024 document, one of a number of alleged protected disclosures, Gibney wrote that a deal proposed by Debenhams liquidator <a href=\"https:\/\/www.irishtimes.com\/tags\/kpmg\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/kpmg\/\">KPMG<\/a> would have seen payments to Mandate members worth more than \u20ac1 million, a one-third share in the profits of the sell-off of stock and 300 jobs saved.<\/p>\n<p class=\"c-paragraph paywall \">At the time, more than a thousand workers were facing unemployment due to the closure of the department store group across Ireland and Britain \u2013 more than 750 of them represented by Mandate.<\/p>\n<p class=\"c-paragraph paywall \">Gibney said he had been instructed to issue a statement to the media on September 4th, 2020, that a potential resolution was imminent and that full details would be published the following week.<\/p>\n<p class=\"c-paragraph paywall \">The document setting out the proposed deal included a confidentiality clause, Gibney said.<\/p>\n<p><img decoding=\"async\" alt=\"\" class=\"c-image audio_image\" src=\"https:\/\/www.newsbeep.com\/ie\/wp-content\/uploads\/2025\/11\/1754647931518-c07d65db-55b5-463e-ae51-976300c5837e.jpeg\"\/>Kerry Group CEO on the impact of Middle East conflict, AI and drive to keep bread fresher for longer<\/p>\n<p class=\"c-paragraph paywall \">\u201cFollowing the issuing of the statement, I believe Gerry Light breached this clause &#8230; when the specifics of the proposal were given to RT\u00c9 industrial relations correspondent Ingrid Miley,\u201d Gibney said in his statement.<\/p>\n<p class=\"c-paragraph paywall \">Gibney said Miley had made a series of posts on social media with \u201cspecific details of the proposals which would only be known to those who had seen the document\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Later that day, KPMG issued its own statement stating that \u201cno settlement has yet been agreed,\u201d Gibney said.<\/p>\n<p class=\"c-paragraph paywall \">Gibney said he tried to get in touch with Light repeatedly that day as he was fielding media requests.<\/p>\n<p class=\"c-paragraph paywall \">He said that his line manager, Brian Forbes, then told him that KPMG had \u201cpotentially withdrawn the proposals\u201d and that Light had \u201cgone to ground\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Forbes then said he was there when Light and Miley spoke by phone and that he had warned Light \u201cnot to give Ingrid further details\u201d, Gibney\u2019s document stated.<\/p>\n<p class=\"c-paragraph paywall \">The following Monday, September 7th, Light confirmed to Mandate staff involved in the Debenhams process that \u201cKPMG had officially withdrawn the proposal\u201d.<\/p>\n<p class=\"c-paragraph paywall \">\u201cI asked why it had been pulled and what KPMG were going to say. Gerry explained to us that KPMG said they did not care who got the blame &#8230; and that Mandate could write whatever they wanted,\u201d Gibney wrote.<\/p>\n<p class=\"c-paragraph paywall \">It was later that night that former staff of Debenhams occupied a number of stores in Dublin and Cork, Gibney said.<\/p>\n<p class=\"c-paragraph paywall \">The following morning, a KPMG statement was published stating that it had \u201cformally withdrawn\u201d support for the settlement deal in light of \u201cthe actions of certain people overnight\u201d.<\/p>\n<p class=\"c-paragraph paywall \">\u201cTheir statement blamed the occupations, when the Debenhams team within Mandate was informed the previous day that the proposal had already been withdrawn,\u201d Gibney said.<\/p>\n<p class=\"c-paragraph paywall \">The following day, Gibney wrote, divisional organiser Robert McNamara directed him to log into the back end of Mandate\u2019s website and take down a document uploaded to the site.<\/p>\n<p class=\"c-paragraph paywall \">The document was the original proposal from KPMG, Gibney wrote in his statement.<\/p>\n<p class=\"c-paragraph paywall \">In the April 2024 document, Gibney wrote that he later learned on foot of a freedom-of-information request that the <a href=\"https:\/\/www.irishtimes.com\/tags\/department-of-social-protection\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/department-of-social-protection\/\">Department of Social Protection<\/a> \u2013 another creditor in the liquidation \u2013 wrote to KPMG twice on September 4th referencing the RT\u00c9 news report on the deal. One official sought the particulars of the agreement reported by RT\u00c9, according to the material quoted in Gibney\u2019s document.<\/p>\n<p class=\"c-paragraph paywall \">Another wrote that the department would issue no payments unless there was \u201cconfirmation from the joint liquidators that the redundancy and insolvency claims will not be impacted by any agreement with the workers\u201d, the document stated.<\/p>\n<p class=\"c-paragraph paywall \">Gibney wrote in the April 2024 document that any sum received by the workers could have led to some or all of the workers\u2019 statutory redundancy payments from the employers\u2019 insolvency fund being docked by the department.<\/p>\n<p class=\"c-paragraph paywall \">\u201cKPMG arguably had no legal right to make the proposals and now a senior creditor had been made aware of them by the RT\u00c9 article that came about through the leak from Gerry Light,\u201d Gibney wrote.<\/p>\n<p class=\"c-paragraph paywall \">\u201cIt is my sincere belief that a number of our Debenhams members &#8230; were wrongly blamed for the collapse of the KPMG\/Debenhams proposals,\u201d Gibney wrote.<\/p>\n<p class=\"c-paragraph paywall \">\u201cShop stewards were routinely lied to and even muted when attempting to make their points at meetings. Many officials refused to attend pickets or give any support to the strikers,\u201d Gibney wrote.<\/p>\n<p class=\"c-paragraph paywall \">He said it had caused \u201chuge damage to the reputation of Mandate\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Staff blockades of the shuttered stores delayed the removal of stock by the liquidators for more than 400 days until the pickets were broken up by garda\u00ed in April 2021.<\/p>\n<p class=\"c-paragraph paywall \">Gibney\u2019s April 2024 document is dated subsequent to the commencement of proceedings seeking redress for alleged penalisation at the <a href=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\">Workplace Relations Commission<\/a>, first heard in November 2023.<\/p>\n<p class=\"c-paragraph paywall \">His case was last listed for hearing before the tribunal in 2025, but did not proceed to public hearing \u2013 with the parties and their lawyers spending about five hours in talks at Lansdowne House in Dublin 4.<\/p>\n<p class=\"c-paragraph paywall \">A member of Mandate\u2019s national executive council, Lorna Langan, is pursuing separate legal action against the union and was granted an injunction at the High Court on Friday lifting her suspension, allowing her to stand for re-election next week.<\/p>\n<p class=\"c-paragraph paywall \">The legal filings filed for her case contain Gibney\u2019s April 2024 document \u2013 and state that a proposal by Gibney to \u201cresolve his protected disclosure complaint at no or minimal cost was withheld from the NEC on multiple occasions\u201d.<\/p>\n<p class=\"c-paragraph paywall \">That, her lawyers submitted, contributed to the union incurring a legal bill of about \u20ac500,000, including fees and \u201csettlement expenditure\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Langan\u2019s case is that she and other members of the NEC went to garda\u00ed about the level of spending on settlements with former staff and legal fees, a communication she has advanced as a protected disclosure.<\/p>\n<p class=\"c-paragraph paywall \">Her suspension, she claims, was penalisation for that disclosure.<\/p>\n","protected":false},"excerpt":{"rendered":"A former official at the Mandate trade union claims a leak to the media by its then general&hellip;\n","protected":false},"author":2,"featured_media":415784,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[5],"tags":[72,42613,14313,73,61,60,18040,46710,6465],"class_list":{"0":"post-415783","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-business","8":"tag-business","9":"tag-debenhams","10":"tag-department-of-social-protection","11":"tag-high-court","12":"tag-ie","13":"tag-ireland","14":"tag-kpmg","15":"tag-mandate","16":"tag-workplace-relations-commission"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts\/415783","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/comments?post=415783"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts\/415783\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/media\/415784"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/media?parent=415783"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/categories?post=415783"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/tags?post=415783"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
