A pair of legs dangling from a back window of a car caught the attention of a garda who later stopped and arrested the driver for suspected drink driving in Crosshaven.<\/p>\n
Garda Michael Harney was on duty after midnight on October 15, 2023, at Lower Road, Crosshaven, County Cork, when he saw the car approaching from Church Bay Road, near Cronin\u2019s Bar.<\/p>\n
\u201cThe windows of the car were fogged up and I could see a pair of legs dangling from the back of the car.<\/p>\n
\u201cIt crossed over the continuous white line. The vehicle came to a stop at Lower Road. I could see legs dangling from the back driver\u2019s side window.<\/p>\n
\u201cI spoke to the driver Bryan Cotter and there was a very strong smell of intoxicating liquor from him. While speaking to him there was a female sprawled out on the back seat of the vehicle. Her legs were still sticking out of the car,\u201d Garda Harney said.<\/p>\n
40-year-old Bryan Cotter of Nova Court, Carrigaline, County Cork, pleaded not guilty to the charge of driving while he had excess alcohol, namely 172 mgs of alcohol per 100mls of urine.<\/p>\n
At the conclusion of the prosecution case from Inspector Brendan McKenna, defence solicitor Daith\u00ed \u00d3 Donnabh\u00e1in cross-examined the guard.<\/p>\n
\u201cWould you say the nature of your interactions with the motorist were civil?\u201d the solicitor asked. Garda Harney replied: \u201cIt was and it wasn\u2019t, to say the least.\u201d\u00a0<\/p>\n
Judge Philip O\u2019Leary said: \u201cI don\u2019t know what that means.\u201d Mr \u00d3 Donnabh\u00e1in said he did not know either.<\/p>\n
Garda Harney explained:\u00a0<\/p>\n
\n It started hostile and it calmed down. Mr Cotter said, \u2018Barry Galvin will get me off this\u2019.\u00a0\n <\/p>\n
Mr \u00d3 Donnabh\u00e1in said he had no further questions and would not be calling evidence or making submissions.<\/p>\n
Judge Philip O\u2019Leary convicted and fined the motorist \u20ac350 and disqualified him from driving for two years. The motorist had no previous convictions.\u00a0<\/p>\n
