But they do exist \u2014 the NBC chimes are a famous example \u2014 and stars like Mathew McConaughey have recently applied for them out of growing fears about AI deepfakes and voice cloning.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tSwift also applied for a third trademark, covering an image of herself performing on stage. All three proposed registrations, if granted, would cover use of the trademarks on a wide range of \u201centertainment services.\u201d The filings were <a rel=\"nofollow noopener\" href=\"https:\/\/www.gerbenlaw.com\/blog\/taylor-swift-moves-to-trademark-her-voice-and-image-as-ai-threats-grow\/\" target=\"_blank\">first reported<\/a> by Josh Gerben, an attorney unaffiliated with the matter.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tTaken together, Swift\u2019s applications appear aimed at protecting her name and likeness against misappropriation \u2014 something the superstar has <a href=\"https:\/\/www.billboard.com\/business\/legal\/taylor-swift-deepfakes-illegal-stopped-1235593162\/\" rel=\"nofollow noopener\" target=\"_blank\">repeatedly experienced<\/a>, including <a href=\"https:\/\/www.billboard.com\/pro\/can-taylor-swift-sue-donald-trump-ai-generated-false-endorsement\/\" rel=\"nofollow noopener\" target=\"_blank\">once from President Donald Trump<\/a>. The growth of AI technology has made it far easier to mimic voices and create fake videos, flooding the internet with such misleading content and leaving stars with little recourse.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tLegally speaking, an individual\u2019s identity has historically been protected by publicity rights, a term for state law rights that allow you to sue if your name or likeness is commercially exploited without consent. Federal trademark law does cover famous names \u2014 Taylor has many such marks, and has <a href=\"https:\/\/www.billboard.com\/pro\/taylor-swift-trademark-case-swift-home\/\" rel=\"nofollow noopener\" target=\"_blank\">enforced them recently<\/a> \u2014 but is less directly designed to shield a person\u2019s likeness.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tLast year, McConaughey took a novel approach and sought to \u201ctrademark himself,\u201d as <a rel=\"nofollow noopener\" href=\"https:\/\/www.wsj.com\/tech\/ai\/matthew-mcconaughey-trademarks-himself-to-fight-ai-misuse-8ffe76a9\" target=\"_blank\">reported by the Wall Street Journal<\/a>. He sought protection over several video clips of himself, as well as audio of him saying his famous \u201cAlright, alright, alright\u201d from the film Dazed and Confused. But it remains to be seen whether such an approach, which Taylor\u2019s applications seem to mirror, would hold up in court.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tTrademarks typically cover specific words, logos and other indicia that are linked in the minds of consumers to specific goods and services; they were not designed to give blanket protection to a person\u2019s overall appearance or identity. For instance, it\u2019s unclear if Swift would be able to prove that someone infringed her proposed sound trademarks if they said something in a similar-sounding voice but with different words than \u201cHey, it\u2019s Taylor Swift.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThat Swift is turning to such unproven methods is a sign of the lack of true legal protections as the problem of AI deepfakes and voice cloning grows. Publicity rights come with key limitations and are different in each state. Lawmakers in Congress have proposed a federal <a href=\"https:\/\/www.billboard.com\/pro\/no-fakes-act-reintroduced-congress-support-ai-deepfake-bill\/\" rel=\"nofollow noopener\" target=\"_blank\">NO FAKES Act<\/a> to deal with the problem nationally, but have made little progress passing it.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIf granted, the new trademarks would be added to a huge collection for Swift, who owns federal protections on her name, song and album titles, famous lyrics and dozens of other trademarks.
