His lawsuit in the United States District Court for the Northern District of California is seeking $130 billion in damages from OpenAI and wants the company to return to a nonprofit structure and remove Altman and Brockman from its board.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoj2yf4p000x356qph33vm7n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI have extreme concerns over AI,\u201d Musk, who has his own AI company, said on the stand in an Oakland, California courtroom. AI can make everyone prosperous but could also lead to dire consequences for humanity, he said, which motivated him to start a non-profit devoted to \u201csafe\u201d and \u201copen\u201d AI systems.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoj31ekc0016356ql24fbx12@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe don\u2019t want to have a \u2018Terminator\u2019 outcome,\u201d he said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoj2ypld0011356qyv0tya8a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The trial threatens to derail one of the world\u2019s largest AI companies \u2013 and one of Musk\u2019s biggest artificial intelligence rivals \u2013 <a href=\"https:\/\/www.cnn.com\/2025\/11\/10\/business\/ipo-openai-private-public\" rel=\"nofollow noopener\" target=\"_blank\">as it makes plans to go public<\/a> as early as this year. OpenAI has consistently pushed back against Musk\u2019s claims and says his suit is one based on jealousy and regret.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoj2pnnn000r356q1chrtlkj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe are here because Mr. Musk turned out to be very wrong about OpenAI. We\u2019re here now because Mr. Musk now competes with OpenAI,\u201d OpenAI\u2019s lead attorney Bill Savitt said in his opening statement Tuesday. \u201cBecause he\u2019s a competitor, Mr. Musk will do anything he can do to attack OpenAI.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoj1q5wn000o3b6qei72lexr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The jury\u2019s verdict will advise Judge Yvonne Gonzalez Rogers as she decides whether Musk gets his wish: reversion of OpenAI to a nonprofit structure, the removal of Altman and Brockman from OpenAI\u2019s board, and around $130 billion in damages to go back into OpenAI\u2019s nonprofit foundation.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoj1qnc6000q3b6qb5m09dt9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Beyond the remedies Musk is demanding, the trial threatens to derail one of the world\u2019s largest AI companies \u2013 and one of Musk\u2019s biggest artificial intelligence rivals \u2013 <a href=\"https:\/\/www.cnn.com\/2025\/11\/10\/business\/ipo-openai-private-public\" rel=\"nofollow noopener\" target=\"_blank\">as it makes plans to go public<\/a> as early as this year. OpenAI\u2019s IPO is expected to be a blockbuster, and the money it raises could help it dominate an industry in which it had an early lead. On the other hand, if Musk wins, his own xAI company could set back a major rival and potentially leap ahead.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoi51y9m000i356qiimuukos@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The trial was already contentious even before any testimony.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoj1stvh000u3b6qfp62eza4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Musk spent part of Monday posting on his social media platform X about his lawsuit against OpenAI, its CEO Sam Altman and president Greg Brockman, and Musk\u2019s claims in the suit that the ChatGPT maker deceived him and betrayed its original mission.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoj1t40n000w3b6qy18j359z@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cScam Altman and Greg Stockman stole a charity. Full stop,\u201d read one of Musk\u2019s missives.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoj1ssq0000s3b6qvady5b40@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Rogers scolded Musk on Tuesday morning for his recent social media posts about the trial and threatened a gag order before the jury arrived in the courtroom.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoitjdzo0002356qcxaygjh8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Musk\u2019s posts will \u201conly make things worse,\u201d she said. Musk agreed to limit his social media posts about the suit; Altman and Brockman similarly agreed.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoitgxd30000356q6pl6r7os@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            And Musk could face other hurdles in his quest. Musk\u2019s lawyers on Monday struck several potential jurors who harshly criticized their billionaire client, including one who referred to Musk as \u201cgreedy\u201d and a \u201cpiece of garbage\u201d in their pre-questionnaire form and another who said their partner\u2019s job was \u201charmed\u201d by the Department of Government Efficiency (DOGE) cost-cutting initiative that Musk lead in the Trump administration.\n    <\/p>\n<p>       <img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ie\/wp-content\/uploads\/2026\/04\/gettyimages-2273015995.jpg\" alt=\"Boxes from MoloLamken, a firm representing Elon Musk arrives to court at the Ronald V. Many people don\u2019t like him. That does not mean that Americans can\u2019t have integrity for the judicial process,\u201d Judge Rogers told Musk\u2019s attorneys.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoi51y9m000k356qf02slv5e@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Jurors expressed few opinions about Altman, who was in court for jury selection. In the end, the jurors selected were largely those who said they had a neutral opinion of Musk or of AI.\n    <\/p>\n<p>        Emails, text, call logs and more<\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoi51y9n000m356qrb1w8r6k@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Musk cofounded and helped fund OpenAI as a nonprofit in 2015, giving what he says amounted to at least $44 million in its first few years. But he split from the company in 2018 after an acrimonious power struggle. (Musk went on to later found his own AI company, xAI.)\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoi51y9n000n356qxekydrc7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A year after his exit, OpenAI created a for-profit subsidiary to raise more cash. In 2025, the company further evolved into a for-profit public benefit corporation, under the OpenAI foundation. Musk claims the shift betrayed OpenAI\u2019s original nonprofit mission to develop safe, open-source AI technology for the public good \u2013 and that the company\u2019s leaders, including Altman and Brockman, wrongfully profited from his charitable contributions, according to the lawsuit.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoi51y9n000o356qrdgtwg54@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Microsoft, which Musk named as a co-defendant in the case, is accused of aiding and abetting OpenAI\u2019s breach of charitable trust.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoiwvu3z0009356q9hsphdcg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            OpenAI, its executives Sam Altman and Greg Brockman, and investor Microsoft \u201cenriched themselves, made themselves more powerful and they breached the very basic principles on which the charity was founded,\u201d Musk\u2019s attorney, Steven Molo, alleged in his opening statement Tuesday.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoiwq4hv00083b6qi6n63hy4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In early discussions, Musk and others talked OpenAI\u2019s structure and whether it should be a for-profit company, Molo said. Musk stepped down from the board because he had \u201cstuff going on in his other businesses\u201d when OpenAI struck a deal with Microsoft that fundamentally meant OpenAI was \u201cno longer operating for the good of humanity as a whole,\u201d Molo added.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoiwoor200063b6q2jz25c70@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In a motion to dismiss before the trial began, Microsoft called Musk\u2019s arguments \u201cdevoid of factual specificity and substantiation, repeatedly relying on unsupported \u2018information and belief.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoi51y9n000p356qe75esx9d@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But OpenAI says Musk himself pushed for a for-profit structure. Musk left the company because he was not able to assume total control, OpenAI said in a statement, and his suit is \u201cmotivated by jealousy, regret for walking away from OpenAI and a desire to derail a competing AI company.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoizfwrp000g3b6q7ijus1yh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            When OpenAI realized they needed more money for computer power and made plans for a for-profit subsidiary, Musk wanted to have full control, OpenAI\u2019s lead attorney Bill Savitt said in his opening statement. When the others did not agree, Musk left the company.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoizfxdc000i3b6qjg0cm82n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe\u2019re here because Mr. Musk didn\u2019t get his way at OpenAI. My clients had the nerve to go on and succeed without him.
