A \u201cqualified doctor\u201d has been denied bail after he was arrested while being removed from a hostel in the Liberties, Dublin 8, yesterday.\u00a0<\/p>\n
Garda Ross Kavanagh gave evidence that Abdel Higazi (36) of Back Lane, Dublin 8, made threats to kill or cause serious harm contrary to Section 5 of the Non-Fatal Offences Against the Person Act when he is alleged to have told a member of staff at the DePaul hostel he was living at that he would \u201cspill your blood\u201d and \u201ccut your throat\u201d while making \u201creferences to Allah\u201d on the 26th of March.\u00a0<\/p>\n
Garda Kavanagh said that a 999 call was made from the hostel yesterday after staff had asked the accused to leave as his \u201cbed had been closed\u201d after he had received a prior warning about his alleged \u201caggression\u201d.<\/p>\n
After he refused to leave, Garda\u00ed attended the scene and were shown to Higazi\u2019s room, which Garda Kavanagh said had a smell of cannabis coming from it, although the accused claims to be drug-free.<\/p>\n
Hagazi then allegedly tried to close the door on Garda Kavanagh and \u201cbecame aggressive within inches\u201d of his face, that the accused\u2019s face was \u201cvibrating\u201d and that he could see \u201csomething black in his pocket\u201d. When the accused allegedly failed to desist from his behaviour, he was arrested for trespass contrary to Section 13 of the Criminal Justice Public Order Act 1994 and Section 6 of the same act for threatening and abusive behaviour.<\/p>\n
It was also alleged that when four Garda\u00ed attempted to remove the accused from the hostel, as they were bringing him down the stairs, he attempted to walk faster than them to \u201cpull\u201d them \u201cdown\u201d and \u201ccause harm\u201d, the court heard.<\/p>\n
As he \u201ccontinued to resist arrest\u201d, the accused is alleged to have made \u201csome alarming comments\u201d such as referring to Garda Kavanagh and his colleague a \u201cqueer on multiple occasions\u201d as well as \u201clicking his lips in a disturbing and inappropriate manner\u201d\u00a0while looking at the two female Garda\u00ed present.<\/p>\n
Hagazi, who claims to be a \u201cqualified doctor\u201d who is the son of a \u201cworking qualified doctor\u201d, is also alleged to have made comments about \u201cstabbing children\u201d before he was \u201ceventually brought to the ground\u201d.<\/p>\n
After he was refused station bail, speaking about one of the female Garda\u00ed, the accused is alleged to have told a jailor he would, \u201cFind her in the streets and cut her head off as I am working for Allah.\u201d\u00a0<\/p>\n
It was also alleged that he told a female staff member at the hostel who was carrying out a routine daily room check, \u201cGet out, you\u2019re a woman, this is sacred ground\u201d.<\/p>\n
Garda Kavanagh said that this woman was \u201cplaced in fear\u201d due to Higazy\u2019s alleged \u201caggression and misogyny\u201d.<\/p>\n
Defending counsel, Paddy Flynn BL, argued that his client has no previous convictions and is an Irish citizen who has lived here for almost all his life, although Garda Kavanagh said it was his belief that he was Egyptian.<\/p>\n
Mr Flynn said that his client no longer had an Egyptian passport and that he claims to be living in the hostel as a means of studying sociology \u201cfor medical research\u201d. Hearing this, Judge Conor Fottrell quipped, \u201cHe could come down to here for that.\u201d<\/p>\n
Flynn argued that his client was entitled to the presumption of innocence, was a man with no previous convictions and was living a \u201cmonastic medical life in hostels\u201d.\u00a0<\/p>\n
Pleading for bail, he argued that his clients\u2019 alleged \u201caggressive\u201d comments in Arabic were \u201cspeculative\u201d as we \u201chave to acknowledge other people\u2019s faiths\u201d and that \u201can expletive to one man is a Bible verse to another\u201d.<\/p>\n
\u201cA lot of the allegations are strange to say the least and may come out to mean nothing,\u201d he argued.\u00a0<\/p>\n
Garda Kavanagh said that he was \u201cfearful that this man will intimidate witnesses\u201d due to his \u201cobserved\u201d behaviour during and after his arrest when he had \u201cspent multiple hours with his man\u201d.<\/p>\n
Having heard the evidence, Judge Fotrell said that the Garda\u2019s objections were \u201cwell established and well founded\u201d and that on that basis he was refusing bail.<\/p>\n
The accused was remanded in custody to appear before Cloverhill District Court via video link on the 5th of May next.<\/p>\n
