A historian who lost out to a candidate 25 or 30 years her junior in a \u201cvery tight\u201d race for a lecturing role at the University of Galway<\/a> has failed to make out an age discrimination claim. <\/p>\n

Jackie U\u00ed Chionna pursued the complaint under the Employment Equality Act 2000, challenging a 2024 recruitment competition which appointed a part-time lecturer in history at the university.<\/p>\n

Six candidates were shortlisted from a field of 17 applicants for the post. U\u00ed Chionna, a teaching assistant at the university since 2004, was placed last in the rankings after interview, the Workplace Relations Commission<\/a> heard in March.<\/p>\n

U\u00ed Chionna\u2019s trade union, Siptu, argued it was \u201cnot plausible\u201d that the winning candidate \u2013 identified only as Dr X in a decision published on Friday by the tribunal \u2013 could have outscored the complainant at interview. <\/p>\n

X, the union representative argued, was \u201cat most in her late 20s [or] early 30s\u201d and had two years\u2019 experience in teaching \u201cat best\u201d; while U\u00ed Chionna was 62 when she went for interview in June 2024 and had \u201cover 20 years\u2019 teaching and research experience\u201d. <\/p>\n

The union argued that U\u00ed Chionna\u2019s marks for research \u201cdo not reflect her excellence\u201d, having secured a Bodleian fellowship at Oxford and published three books.<\/p>\n

\u201cAt the time of interview, [X] had not yet published her first book,\u201d it was submitted.<\/p>\n

It was \u201cnot plausible\u201d for the complainant to have been outscored by X on leadership and strategy in view of the winning candidate\u2019s \u201crelative youth\u201d, the union rep also argued.<\/p>\n

U\u00ed Chionna was \u201cwell known in Galway\u201d and had made an \u201cexceptional\u201d contribution to community and the college as a historian, the union argued \u2013 adding that it believed X \u201ccould not have such experience\u201d.<\/p>\n

U\u00ed Chionna had \u201cdelivered countless public lectures in person and online\u201d and \u201cpresented on radio and on television in both Irish and English\u201d.<\/p>\n

\u201cIt is her opinion that she performed better the assessment portrays,\u201d her union said of the public presentation and interview performance score.<\/p>\n

Ibec, which appeared for the university, argued: \u201cIf the complainant\u2019s logic were accepted, it would render it legally impossible for a university to appoint a younger candidate over an older candidate, regardless of merit.<\/p>\n

\u201cThe first-ranked candidate was appointed purely on merit.\u201d <\/p>\n

Kevin O\u2019Sullivan, deputy head of history and philosophy at the University of Galway, said in evidence that the six candidates scored between 76 and 86 at interview.<\/p>\n

U\u00ed Chionna \u201cwent over time in her interview and did not show good time management\u201d.<\/p>\n

X, he said, \u201cshowed very strong performance\u201d in presentation skills, module drafting and timing, as well as \u201cstrong teaching attributes\u201d.<\/p>\n

Adjudication officer Peter O\u2019Brien dismissed U\u00ed Chionna\u2019s complaint. <\/p>\n

U\u00ed Chionna \u201cdisplayed the education and experience for the post\u201d, but \u201cso did all the other successful candidates\u201d, he wrote.<\/p>\n

The decision came down to \u201cvery fine distinctions\u201d, he found.<\/p>\n

Having received and examined the interview notes for all six candidates after his hearing, O\u2019Brien wrote: \u201cNothing is apparent in the notes to lead the adjudicator to determine that the interview panel displayed any age bias. <\/p>\n

\u201cThe scoring was very tight, and the successful candidate outscored the complainant on three of the six areas.\u201d <\/p>\n

He did not document specifics in his decision, for confidentiality reasons, as the other candidates were not party to the case, he wrote.<\/p>\n

O\u2019Brien wrote that it was \u201ca stretch too far\u201d to conclude that the panel \u201cwere biased, in some shape or form\u201d in favour of all five candidates who placed in advance of U\u00ed Chionna.<\/p>\n
