A worker who was called a \u201cnegative virus\u201d by his manager and had his hours cut when he objected to CCTV being installed at his workplace without consultation has won \u20ac40,000 for whistleblower penalisation.<\/p>\n
Timber Frame Projects Ltd, trading as Timber Frame Ireland, was directed to pay the sum to its former employee Norbert Batho on foot of a complaint under the Protected Disclosures Act 2014.<\/p>\n
Batho raised a verbal complaint with the general manager at the Stranorlar, Co Donegal<\/a>, firm in 2022 complaining that CCTV was being installed without consultation or prior notice to staff, the Workplace Relations Commission<\/a> (WRC) heard. <\/p>\n Batho claimed this was done \u201cwithout lawful basis\u201d under data protection law \u2013 refusing to sign a sheet acknowledging that he had been given notice of the installation.<\/p>\n He said in evidence that the company installed the CCTV without \u201cproper notification and consent from employees\u201d.<\/p>\n This was disputed by the company. A director, Declan Bourke, told a hearing in January this year the CCTV was installed in response to the theft of tools on the premises and \u201cin compliance with GDPR\u201d.<\/p>\n WhatsApp messages from the general manager at the firm and Karen Bourke, a member of senior management, on the morning of October 26th, 2022, were seen by the adjudicator.<\/p>\n In the texts, the general manager wrote: \u201cIt\u2019s mainly only Norbert causing all this ruckus … but everyone feels like they are being monitored.\u201d<\/p>\n He went on to write: \u201cNo-one complained or moaned or b***hed about the cameras once yesterday until Norbert came in this morning … It\u2019s just Norbert, he is a negative virus that stirs sh*t always.\u201d<\/p>\n The general manager told Bourke that Batho was taking pictures of the camera set-up and the sign-off sheets handed around to the workers and said \u201che is on to the Citizens\u2019 Advice regarding all this\u201d.<\/p>\n \u201cEveryone signed without issue or even mention and then said now while Norbert isn\u2019t around they are OK with it … so just Norbert as usual,\u201d the manager added.<\/p>\n The last of the manager\u2019s WhatsApps was sent at 10.37am on the day in question, it was submitted by Jane O\u2019Sullivan of Community Law and Mediation, for Bathos.<\/p>\n Some 35 minutes later at 11.10am, the company director, Bourke wrote to Batho telling him that it was \u201cno longer feasible\u201d to employ him for any hours other than driving duties because of \u201creduced demand\u201d.<\/p>\n Bourke argued the installation of CCTV \u201cdoes not constitute a wrongdoing capable of founding a protected disclosure\u201d and denied any link to the contract change.<\/p>\n O\u2019Sullivan pointed out in a legal submission that the employer advertised a full-time vacancy for a \u201cdriver\/welder\u201d soon after Batho resigned his employment two days later.<\/p>\n In a decision published on Monday, WRC adjudicator Shay Henry wrote that Batho was first told of the new contract and the cut to his hours \u201ca matter of minutes\u201d after the text exchange between the manager and Bourke.<\/p>\n \u201cThe complainant was penalised for making a protected disclosure and the complaint is well-founded,\u201d Henry wrote.<\/p>\n He awarded \u20ac40,000 in compensation for the breach, a sum equivalent to a year\u2019s pay.<\/p>\n Henry found further that Batho was entitled to take the view he was constructively dismissed in breach of the Unfair Dismissals Act 1977 due to the \u201cunilateral\u201d pay cut and awarded \u20ac3,056 in compensation.<\/p>\n There was a third award of \u20ac1,000 on foot of a finding that Batho\u2019s rights under European regulations governing hours in road transport were breached by the failure to issue payslips documenting his working time.<\/p>\n This brought the total compensation awarded in the case to \u20ac44,056.<\/p>\n","protected":false},"excerpt":{"rendered":"A worker who was called a \u201cnegative virus\u201d by his manager and had his hours cut when he…\n","protected":false},"author":2,"featured_media":466743,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[5],"tags":[72,1485,61,60,1962,6465],"class_list":["post-466742","post","type-post","status-publish","format-standard","has-post-thumbnail","category-business","tag-business","tag-donegal","tag-ie","tag-ireland","tag-work","tag-workplace-relations-commission"],"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts\/466742","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/comments?post=466742"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/posts\/466742\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/media\/466743"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/media?parent=466742"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/categories?post=466742"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/ie\/wp-json\/wp\/v2\/tags?post=466742"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
