{"id":514875,"date":"2026-06-23T20:01:09","date_gmt":"2026-06-23T20:01:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/ie\/514875\/"},"modified":"2026-06-23T20:01:09","modified_gmt":"2026-06-23T20:01:09","slug":"woman-87-to-be-sentenced-for-careless-driving-causing-death-of-a-pensioner-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ie\/514875\/","title":{"rendered":"Woman (87) to be sentenced for careless driving causing death of a pensioner \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">An 87-year-old woman who pleaded guilty to careless driving causing the death of 72-year-old Mary Fehilly in <a href=\"https:\/\/www.irishtimes.com\/tags\/charleville\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/charleville\/\">Charleville<\/a>, Co <a href=\"https:\/\/www.irishtimes.com\/tags\/cork\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/cork\/\">Cork<\/a>, will be sentenced in October. <\/p>\n<p class=\"c-paragraph paywall \">Fehilly was brought to hospital after she was struck by a car as she stood on the footpath of Charleville\u2019s Main Street on November 2nd, 2024. She subsequently died at <a href=\"https:\/\/www.irishtimes.com\/tags\/cork-university-hospital\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/cork-university-hospital\/\">Cork University Hospital<\/a>. <\/p>\n<p class=\"c-paragraph paywall \">John Collins, who was also on the footpath, was seriously injured in the incident.<\/p>\n<p class=\"c-paragraph paywall \">The case of Agnes Foley of Farran in Charleville was on the list for sentencing at Cork Circuit Criminal Court on Tuesday.<\/p>\n<p class=\"c-paragraph paywall \">Foley had appeared before the court at the end of April. She confirmed her signed guilty pleas at that juncture. <\/p>\n<p class=\"c-paragraph paywall \">She had entered a guilty plea to driving without due care and attention on November 2nd, 2024 at Main Street, Rathgoggin, Charleville, thereby causing the death of Fehilly. <\/p>\n<p class=\"c-paragraph paywall \">The pensioner also pleaded guilty to driving without due care and attention on the same date and at the same place thereby causing serious bodily harm to Collins.<\/p>\n<p class=\"c-paragraph paywall \">On Tuesday prosecution barrister Imelda Kelly asked that the case be listed for sentence on a date \u201cas early as possible in the Michaelmas sessions\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Judge Helen Boyle adjourned sentencing in the case until October 29th. Victim impact statements will be delivered at the sentencing hearing. <\/p>\n<p class=\"c-paragraph paywall \"> Defence barrister Majorie Farrelly told the court her client had driven for six decades without incident.<\/p>\n<p class=\"c-paragraph paywall \">She said that Foley was carrying out a parking manoeuvre when she \u201caccidentally put her foot on the accelerator instead of the brake\u201d.<\/p>\n<p class=\"c-paragraph paywall \">The senior counsel said the pensioner had not driven since.
