\u20ac944,000 award to Mark Keane<\/a> for injuries to his right hand, arm and shoulder as a result of the 2018 incident.<\/p>\nAt the time Keane told the court that since the injury he was not the man he was, nor the one he hoped to become, and felt \u201clet down\u201d by the multinational company.<\/p>\n
An accomplished hurler, Keane won three consecutive All-Irelands with Limerick under-21s between 2000 and 2002 and played senior hurling from 2000 to 2006.<\/p>\n
Johnson & Johnson had said the company \u201cabsolutely\u201d accepted responsibility for the injury Keane suffered in the form of the nerve damage and injury to his right hand. <\/p>\n
However, the company did not accept responsibility for his claim of injury to his right shoulder. Johnson & Johnson appealed the award, saying the judge\u2019s findings were unsupported in law.<\/p>\n
In a newly published judgment, the Court of Appeal reduced the payout to Keane to \u20ac886,000, a reduction of \u20ac58,000.<\/p>\n
The court said the reduction reflected that Keane had already been awarded \u20ac42,000 in 2019 for a road traffic incident in 2014. The reduction also reflected an adjustment in Keane\u2019s expected future earnings after the court considered previous case law on how that should be calculated.<\/p>\n
The Court of Appeal said Johnson & Johnson had argued that any loss of earnings was partly due to that earlier accident and therefore the award made by the lower court amounted to a double counting.<\/p>\n
Johnson & Johnson, at the High Court, said Keane gave \u201cevidence that he had not cycled a bicycle in years, which he subsequently accepted was untruthful in cross examination\u201d.<\/p>\n
Keane accepted he had gone cycling socially with friends to get out of the house for his mental health after the injury, but he did not enter any races. <\/p>\n
He said he cycled in June 2019, but had not done so since. Keane took his High Court case against Johnson & Johnson Vision Care (Ireland). <\/p>\n
The 45-year-old alleged Johnson & Johnson was negligent and breached its duty of care towards him on September 10th, 2018, while he was working as a technician making contact lenses.
