A salesman who said an industry \u201crumour mill\u201d made him \u201cdamaged goods\u201d after he was unfairly dismissed by an international medical devices firm has been awarded nearly \u20ac40,000.<\/p>\n

The Workplace Relations Commission<\/a> (WRC) directed Ambu Ltd to pay redress to Kevin Joyce after it admitted his dismissal last July was unfair. <\/p>\n

Joyce, who said he was earning more than \u20ac160,000 at Ambu, spent more than 10 months out of work after what he called his \u201cunceremonious dismissal\u201d as territory manager for its urology and ear, nose and throat products in Ireland. <\/p>\n

He told the WRC in May how his former employer set an industry \u201crumour mill\u201d turning against him with an email to staff announcing it had decided to \u201cpart ways\u201d with him. <\/p>\n

Joyce\u2019s lawyers said their client had filed a grievance about a \u201cdisparity\u201d in performance-related pay to sales staff, with an \u20ac18,000 bonus at issue. <\/p>\n

An external investigator concluded the matter \u201cneeded addressing\u201d, Joyce said. <\/p>\n

He then found himself subject to a \u201cno-fault\u201d dismissal, he said. <\/p>\n

An email to staff announcing his departure read: \u201cDear all, today we have decided to part ways with Kevin Joyce with immediate effect,\u201d the tribunal heard. <\/p>\n

Joyce said: \u201cThe medical device industry is a small industry … everyone knows everyone, and word got out very quickly.\u201d There were rumours he had \u201cdone something gravely wrong\u201d amounting to \u201cserious misconduct\u201d, he said. <\/p>\n

He contrasted the email with one sent referring to one of his former colleagues leaving the country, which highlighted her achievements in the job and wished her well for the future. <\/p>\n

Joyce said he had to be \u201ctransparent\u201d with one hiring manager when the man asked him: \u201cWhy are you leaving Ambu, given your track record and all the awards?\u201d <\/p>\n

He said: \u201cI let him know what happened and that I was completely unfairly dismissed through a no-fault termination on 2 July [2025].\u201d<\/p>\n

After that, there was a change in tone and his job application went no further. <\/p>\n

\u201cI was completely damaged goods and not an attractive employee for anyone to deal with,\u201d he said. \u201cI was doing my own credibility, my own reputation, my own character, damage by putting my CV out there and having these conversations.\u201d<\/p>\n

Under cross-examination, Joyce set out how in the 10 months since his dismissal he had documented 63 instances where he had inquired about new work, including 23 formal job applications.<\/p>\n

Rosemary Mallon, for the firm, told the hearing: \u201cI confirm, for the avoidance of all doubt, there was no fault on the part of Joyce.\u201d <\/p>\n
